No you can not refile something dismissed with prejudice. You can appeal the dismissal with a higher court. . . Good luck wasting the money on that appeal
First letter from HOA you inform them you are not part of it, don't mention legal possible action. Second letter blindside them when you file for an emergency injunction against them, telling them to cease all HOA activity against you including, any form of inspecting of the property. You want to give them as little time as possible to get their ducks in a row. Then when you do things after the injunction that they don't like and it show up in court as part of their claims, you got them violating a court order.

You can appeal until you get to the highest court. "With prejudice" just means there is no refiling, but the decision to dismiss is always appealable.
