In This Video -How does argument happen with the judge regarding junior senior in the High Court.
The Gujarat High Court also suggested senior advocates to allow their juniors to argue cases so as to make ensure that the young lawyers gain experience and the bar becomes more robust.
What does it mean to pass over in a court case?
If an advocate is appearing in another court on another matter, he may ask for a pass over. In that situation, after finishing the complete list of cases, the Hon'ble Judges take up the pass over matter. Both these concepts have been incorporated into the Judiciary in order to ease the justice delivery mechanism.
Can junior appear on behalf of senior advocate?
A senior advocate is not permitted to appear without an Advocate-on-record or without any junior. A senior cannot file any pleading or represent his client neither can draft an application by his own handwriting.
What is Section 16 of advocate Act?
An advocate may, with his consent, be designated as senior advocate if the Supreme Court or a High Court is of opinion that by virtue of his ability 1[standing at the Bar or special knowledge or experience in law] he is deserving of such distinction.

जनता इन काले कोट वाले वकीलों पर बहुत ही उम्मीद रखती है और इसी कारण सम्मान भी करती है।
लेकिन जब न्यायालय की कार्यवाही देखते हैं तो किसी छात्र द्वारा होमवर्क पूरा न करके आने पर शिक्षक द्वारा डांटे जाने जैसा देखकर बहुत दुख होता है कि देश के वकील ऐसे होंगे तो जनता को कैसा न्याय मिलेगा?

Sir is absolutely right bcoz juniors can’t question their seniors and have to follow their instructions even if they knows that they are being bait.But that senior advocate was not willing to understand this simple thing.

I'm big fan of this Respected judge
Advocate who was Replying to Hon'ble Judge Sir, was not very polite and Rude at the same time. No one is compelled to giver her hours more than if others are approaching her to spare her time. Simple though Common sense, but at the same time, our senses gets bewildered by our ego.

फर्स्ट अपील और सेकंड अपील की 1998 के हाई कोर्ट इंदौर बेंच में पेंडिंग है 10 से 15 साल निकली कोर्ट में चक्कर खाने के बाद मामला हाई कोर्ट में आता है और यहां भी 25 साल से पेंडिंग है तो हो गया न्याय और हो गया इस देश का भला ,,
Jub wakil peskar chahenge tub nahi to maximum court me yahi karke clients ko paresan kiya jata hai jiska main ek bhukt bhogi hoon Jo SDM ka diya date peskar ke sath milkar dusra date file me likh deta hai jub SDM ke date par hajri dene ke liye jata hoon tub peskar bolta hai ki aap ka aaj date nahi hai do din baad ya do din pahle ka date batta hai aisa mere sath 6.5sal me 20-25baar hua hai kyoki wakil or peskar ko malum hai ki main 7ghante ka train suffer karke date attend karn jata hoon or vapas aata hoon Aisa 2nd party se milkar paresan karta hai

इस देश की न्याय प्रणाली में गम्भीर सुधारों की बहुत आवश्यक्ता है।
न्याय के नाम पर 10,20,30,40 बरस तक तारीख पर तारीख पर तारीख पर तारीख पर तारीख देने वाली यह व्यवस्था अपना औचित्य खोती चली गई है।
मैं स्वयं इस पीड़ादायी व्यवस्था का भुगतभोगी हूं, एक Senior वकील ने 2 लाख रुपए की advance फीस लेकर भी डेढ़ साल तक मेरे केस को आगे बढ़ाने की कोई गंभीरता नहीं दिखाई !!!
3 साल के बाद 6-6, 8-8 महीनों की तारीखों पर तारीखों के थपेड़े सहने के बाद मुझे यह केस वापिस लेना पड़ा !!!
ये है इस देश की न्याय प्रणाली !!!!
इसमें हमारी सत्ताओं की ज्यादा गलती हैं जो यह सब अन्याय देखते सुनते हुए भी चुप हैं।

I don't understand why that arguing lady advocate got so offended.... And the manner she talked to the judge was very disrespectful and unprofessional.... There should be a strict norms, juniors work under senior so that they can learn but many are treated like a servant, until and unless you can actually teach it's better not to have anyone under you just for the sake of getting free employees... I especially hate it when they make their juniors do their personal works...

It's not the fault of juniors, some of the seniors are so arrogant, they don't feel it necessary to give all the details to the juniors.
