      He won't get a favourable judgement for sure. Date of arrest has no legal binding in granting bail. Only date of Fir and Fir number have binding. These dates can be corrected on oral requests. Good arguments which cannot get relief for your client are of no use. Parity cases need least arguments and this lawyer gave a big spin to such an easy case.

      not exactly it is a bogus plea to me as a non legal person because from what I understand the accused was already convicted by a lower court now that may not take away the right to bail but it does put pressure on the higher court to make sure they don't grant bail to the perceived threat in their eyes because other anyone who applied in a higher court will get a bail and subsequent chance to escape authorities.

    Awesome lawyer. He explained courageously and confidently. A lot of times, we see the judge becoming angry on lawyers. For the first time, I saw a lawyer giving a good responses.

      As a non-lawyer, but an observer of power dynamics in general,
      The lawyer had to tread a fine line here between bravely stating his points, and sounding arrogant.
      In many interactions, the person with more power will see anything other than subservience as arrogance.
      In this case, the judge maintained his professionalism

    Wow! Superb!! I have seen this judge in the past look down upon lawyers & threaten them with contempt notice & silent the argument of lawyers. This is superb show of knowledge, intelligence, preparedness, humility by this advocate. It was enough for the judge to know that he has been the same lawyer answering contempt notices issued to other lawyers as well.

    I have faith in this guy coz he said "My Lord" less number of times than the older advocates with more experience. Hats off buddy.     Typical NLS/NALSAR-type young man. Coming from that kind of privilege (and rigour) he wouldn't be easily overawed by even a HC judge. And a judge like Justice Agarwal will be hard but fair and will probably secretly enjoy hearing him and pushing his buttons. A pleasure to watch.

    Awesome argument on general principles of Bail is rule and jail not, and the doctrine of parity.. but the Judge out of ego finally threw the file on the point that date of arrest is wrongly mentioned.

    I am in no stature to tell if the JUDGE did right or wrong but what I felt was he was already sure he didn't wanted to give bail from the starting only. As you can see the prosecution was giving valid arguments but the judge only saw that the date was wrong.
    What a Judicial system where the judge will give new date because of typo!

      @@pranavp2345 no clue man. But, I did find a memorandum on the internet citing the details of this case.Maybe, I am not sure but some of the details seems to match so by that means, I guess the advocate is Shri Vishnu Upadhyay.

      Western nation's IDEAS n Goals are not Dharma/Not genuine since 900+ years.
      Their ideas are Hegemonic governance not good governance (Dharma).
      Their ideas have more Complexity than clarity in definition of good governance Dharma.

      5. Most western ideas are Capitalism. Using Capitalism they use financial gains and use it and do military centric businesses.
      And Manifestation of Military centric businesses leads to Hegemony and will resulting to 100s of battles, fights and wars.
      Outcomes are 100s of war since last couple of centuries.
      In 19th century, World War 1 and 2 are best examples which lead to wars by Western nations Hegemony n Dictatorship principles n rules n governance all together.
      SUMMARY:
      Western IDEAS n western politicians n western media n western universities n western institutions n others always does manipulation of indexing n indoctrination of facts n indoctrination of surveys n indoctrination of Educational Values n indoctrination of truth n facts.
      Almost everything they try to do indoctrination n Golmal.
      OXFORD UNIVERSITY does indoctrination of facts n truth.
      They mislead the entire Educational System n Educational process n Educational values.

      Most of the times, British, Britain, UK, European nations and USA wants to win at any cost Ie., By hook or crooks Hegemony n Dictatorship governance.
