- The plaintiff’s ex and father of her children is now dating the defendant. She says the defendant and her ex kidnapped the plaintiff’s children for 31 days. The plaintiff says the defendant got her arrested, so she’s suing for a bail bond and false imprisonment. The defendant insists the plaintiff attacked her, which is why she got arrested. She’s countersuing for defamation and harassment.

Depends. In this case the girlfriend said his name is on the birth certificate. If a man doesn’t sign a birth certificate the law automatically gives the mother full custody at birth. If a guy doesn’t sign he has no rights without going to court. On these court shows there is a lot of talk about men shouldn’t sign if they aren’t sure it’s their kid which I agree. But the gamble is no parental rights until paternity is legally established, IF it’s ever established.
Guys, the girlfriend is actually wrong. If you’re not married & you sign the birth certificate, you STILL have no legal rights over the child. Signing the birth certificate establishes paternity. He’s still have to go through the legal process of having his child legitimized in order to have rights to the child. These two were able to supplant that legal process because they both acknowledged that the child was his via their custody case.
In court shows, they advise men not to sign birth certificates because if you acknowledge paternity without a paternity test, then you can be put on child support & become financially responsible for a child that you have no rights over & said child, may not even be your child.
I’m so glad my husband and I are on the same page with his kids mothers. All 4 of us know the main goal is to raise happy and healthy children. This nonsense sounds so toxic and horrific for all involved, especially the kids

I think she meant that there was nothing legally stating that he couldn't have them because the mother kept saying "kidnapped" just to make the dad out to be trash like some women love to do (use their kids to hurt the father). These same women will say that when the father keeps his kids for her (not visitation, doing her a favor) it isn't "babysitting" because it's "his" child, but then if he wants to keep him on his own and she wants to control the situation, suddenly it isn't "his" child anymore, it's "her" child. Yes kids can be kidnapped by their parents...but this case was not a kidnapping. It was a bitter woman trying to hurt her ex and his new woman.
I think what she was trying to say is that both parents can legally take the kids for as long as they want if there’s no court order. That’s a fact and it’s legal.
Technically she did help a point when she said. By law if a woman has a child and she is not married to that man that man can take the child and she cannot get a child back the police cannot even get that child.
Amber alert is ONLY if the child is in known eminent danger or child was taken without your permission or knowledge. When you allow and send them to Dads with no court order he can keep them as long as he pleases until you file for visitation through the courts. I have personally been through this and I tell any woman before you allow your children to go to their dad’s make sure an order is in place.

Major salute to this young brother for having primary custody of his kids! Sooooooo many fathers are actually the more stable and level headed of the two parents and really should be the primary decision makers, but have to sit back and watch poor decision after poor decision be made with their child simply because the courts refuse to let go of biases and update antiquated laws and practices that have no place in today's world that is completely different than when those laws were created.
