Thank you for very clearly explaining the Section sir. However, I just have one doubt. QUESTION- At what stage can a review be filed? I mean say today a Court passes an order. I am aggrieved by the order and the grounds for review appear to be satisfied in my view. So, could I file a review just after the order or should I wait till the judgment is passed?
Cross-objections: Where the decree passed is partly in favour of any party against the respondent and such decree is appealed from, the respondent can take objection to that part of the decree which is against him as he could have taken by way of a separate appeal. Such objections are called cross-objections and are filed in the form of a memorandum. Cross-appeals: In a cross-appeal also, the decree of the lower court is partly in favour of and partly against the respondent, in which case both the appellant and the respondent may separately appeal to the higher court to set aside that part of the decree which affects him adversely. If each of them appeals, we get a case of cross-appeal. Any respondent, though he may not have appealed from any part of the decree may not only support the decree but may also state that the finding against him in respect of any issue ought to have been in his favour; and may also take any cross-objection to the decree which he could have taken by way of appeal. [O. 41, R. 22 (1)]. When to be filed? Cross-objection must be filed by the respondent in the appellate court within one month from the date of service on him or his pleader of notice of the day fixed for hearing the appeal, or within such further time as the appellate court may allow.
sir if party is filing review against order which is appealable and its review has been rejected. So can a party go in appeal against the order in respect of which it filed review?
Sir agar Hc ne review Application ko reject kiya kyuki party appear nahi huvi ab usko set aside ki bhi application reject huvi to kya ab Review ko restore karane ke liye supreme court me appeal kar sakte hai set aside ke regarding?
Are both sub rule 4 and 7 contradictory....? Rule 4 :- says that court can reject our review application. But Order 43 permit us to file appeal against this order. Rule 7 :- says we can not file appeal if our review application is rejected. ● Ek keh reha appeal kr skde , ek keh reha nhi kr skde.
see carefully order 43(w) says granting an application for review and order 47 r.4(2) deal with it and order 47 r. (7) also says if an application is granted then it may be objected they did not say to appeal the application for rejected review don't be confused just read carefully
Hello Sir.... If a review petition is pending in the court and the other party filed appeal in higher court then us case m kya hoga.... And Agar review ki judgement and appeal ki judgement differ kre to us case m Kya hoga Lastly agar high court m appeal jaati hai and review petition daali hui lower court mein then high Court lower court ko dubara hearing k liye kahega yaa fir... Khud decide krega??? Thank you
When you filled an appeal then higher court always called the record from the lower court. So not possible for a room of 2 judgments contradictory to each other
Sir Agar ek party ne pehle review application file ki hai and wo abhi pending hai and fir usi case mein usne appeal bhi file kar di hai....toh wahan kse decide hoga fir....????? Appeal ka judgement pehle aaya toh kya hoga ya review ka judgment pehle aaya toh kya hoga...??? Iss case mein fir second wali court par jo pending case hai uss par kya effect hoga...??? Kya wo dismiss hoga ya nhi...???
@@harpreetsinghkahlon2827 But sir agar review ka judgement pehle aa jaye toh kya appeal will be dismissed...as that decree stands modified or changed on which appeal is preferred...??
But if it happened that trial Court changed its decision then obviously no sense for the higher court to continue it's proceedings. Appellant is always adviced to withdraw his appeal in that case

Sir can civil court review its own order suo moto???
Sir after review accepted and review will heard can either party who is aggrieved can apply appeal
Thank you sir 😊 how cross appeal is different from cross objection ?

[O. 41, R. 22 (1)].

Cross-objection must be filed by the respondent in the appellate court within one month from the date of service on him or his pleader of notice of the day fixed for hearing the appeal, or within such further time as the appellate court may allow.
