(i) Sir Section 115(1) ka proviso except k baad kya khe rha h
(ii) Rafique case ka 1st point and 3rd point samajh nhi aaya (agar incompetent h Court to try the suit then it can be challenge in an appeal or in revision or in a execution proceeding)

Court of Small causes are established under the Presidency Small Cause Courts Act-1882. As per the Act, The State Government may, by order in writing, establish a Court of Small Causes at any place within its territory. Also, these courts decide only civil cases of small value in a summary manner.

Jmic has no power to remand the case but to commit the same to higher court having the jurisdiction
