Impairment on the water is far worse than in a vehicle, it's up there with phone usage in a vehicle. No brakes, 1 or 2 meat slicers, adults with no requirements to wear PFDs, and rules not normally followed because of sporadic use of the vessel. Other idiots to watch out for on the water beside yourself. Hell, he didn't even have his registration which is the very first rule for removing a line off the dock.

I don't believe you were a cop at all. These guys saw an infraction and then contacted the "captain" of the boat. He struggled with following basic instructions ON the boat and had slurred speech. The then utterly failed the field test at the most basic of levels. If you WERE a cop then I fear how many drunk drivers you let go over your time on the road.

Even if you understood what this cop rambled, the 4-way test is trap! Even if you perform that 4-way test correct, they will say it was either too slow or too fast so they book you and fuck up your evening or worse! I am from the Netherlands, if cops stop you for DUI check they straight away ask you to blow in the device, no stupid tests! Under 0.5, go on your merry way, above (depending how much) a ticket and a few hours waiting to continue or somebody else drives but no 8 hours in jail!

Good point and that is why you NEVER do the "field sobriety tests." Never. Make them get a blood draw - it is the most accurate test for blood alcohol.

I did not drink any alcohol for 10+ years, and I was unable to do the first "clap" test with high speed. And tested guy did it with amazing precision. What I can see is that I'm unable to operate a boat, even if I do not drink alcohol at all.

If you have the boat for a year it should have numbers on it and for the love of god don’t fail to produce your registration on top of that. As soon as I heard had the boat a year and I don’t know where my registration is I knew they had him. Then he agrees to those stupid tests. 🤦🏼♂️. They ask your consent because you’re allowed to say no. Everyone thinks if I’m friendly they’ll be cool but cops don’t have a cool bone in their body if they did they wouldn’t have chose law enforcement as a career.

I'm not into boating and never have owned one, but just from what I've seen on bodycams and other videos about boat cops, they are relentless and try their absolute hardest to find something to pin on you. It's like road cops on steroids. I mean shit, whistlindiesel got arrested for splashing water on a jet ski. You would think being out on the water would be freeing, but it seems annoying as shit to be worried about the boat gestapo at all times.

These waterborne field sobriety exercises are impossible. I am home trying to do them, perfectly sober, and I'm sure the cop would use my performance to haul me in.

TASK 1 -Count out loud from 1 to 4 while you move your fists in a step-like fashion making contact between your fists at each step
TASK 2- Memorize the position of your fists after you have counted to four and clap your hands 3 times and return your fists to the memorized position (this seems like more than a single task lol)
TASK 3- Move your fists in a step-like fashion in reverse order counting out loud from 5-8 and returning your left fist to your chest
TASK 4- open your hands with palms down and place them in your lap

The procedure is to continue testing indefinitely until there's anything at all that you can plausibly mischaracterize as impairment. These field tests are not reasonable and should be banned. They should be replaced with something that does not rely on the possibly biased judgment of the cop.
I also am a former deputy sheriff and could never pass those Grooper Trooper tests; when he says "we're not out here to get you,""my senses tell me that is exactly why he is doing those tests. The officer has to read the instructions too get them right; these officers are a disgrace and what a good attorney is waiting for in court.
From the way the officer was constantly swaying and couldn’t stand still, using his own standards of observation, I’d say the officer was intoxicated.
Self-soothing. I would FOIA request the radio dispatch and transmissions between the 2 kkkops, along with ALL body cam footage and audio. I guarantee the "self-soothing" kkkop is nervous that he has to work with the bearded Pirate kkkop who is SIMPly flexing on this guy, because his hot girlfriend was looking too good in public. The body cam audio will show SIMPly how the bearded Pirate probably planned the entire encounter because his own Home life, and Personal; life are as wonderful and exciting as a box of rocks.

I was making fun of how ridiculous the test was by sarcastically saying even the cop can't remember the test without looking at the instructions. This comment would usually invoke what is called laughter or maybe even the emotion of joy in some individuals, but there is always one person who doesn't understand the joke. Hopefully this was educational for you and gives for some inspiration to learn about the world of comedy.

The field sobriety tests are designed for ONE reason only . . . To establish objective probable cause for the arrest when you fail them. NEVER take an FST . . . . . . . you have a choice. But you must take a blood, urine, or breach test under most if not all state laws. Go directly to that.

I have problems with balance so I couldn't do the tests stone cold sober. Plus several concussions in my life.

I live in Ontario Canada, 2 years ago I got pulled over by 2 police cruisers.. after a LONG day at the beach with some friends that’s all I will say..lol cop came up to my window and said some BS about they got a call of people drinking on the beach.. etc etc it’s BS the beach spot is out in the middle of nowhere where in the country. Cop says after license and registration.. that he can smell alcohol and if I would submit to a field sobriety test or a breathalyzer I said NO ( my dad told me when I was 14 years old if they ever ask you and you know you have been drinking ) always say no it will be easier for your lawyer (a skilled lawyer) to fight in court. I declined got charged and arrested for the night.. released in the morning 1 year and 10 months later DUi charges got totally dropped and my driving record stays clean. Never accept!!! Always decline trust me!! It worked for me it takes a long time and you might be without a license for the court time which on and off was almost 2 years for me but trust me it’s worth it. ALWAYS DECLINE

This is ridiculous! There is no way I would pass these tests 100 percent sober. If you don't naturally have great coordination, then you are totally screwed! Also, he gave him dozens of directions that would be almost impossible to remember.
I'm now retired after 40 years as a police officer. I am a court certified expert on DUI/BUI. Have you ever seen two boats collide head-on at 45 mph? I have more than once, and it's not pretty. In every case alcohol was involved. Those of you who hate cops, or at least dislike them, aren't going to give an unbiased response to this. You only saw a portion of what these officers observed. If you watch the video again, you will know that the officer stated that they observed him operating the boat in a manner consistent with a BUI, and they followed him to the bar that they were headed to. On his clipboard is a Coast Guard standardized field sobriety test. If you look at the form, you'll see that there are many things the officer needs to observe and make a decision based on. From what I observed, the individual was intoxicated. He didn't have just one mixed drink.

I understand why the tests and directions are designed as they are - they cant tell you if you are doing it right or wrong, they can only reiterate the directions because they are trying to test your ability to perceive, understand, and respond to directions.... its very fishy and as someone who just wants to ensure they are doing the task properly, you get little to no direction at all and are met with an ego-minded cop trying to pin an OWI

I have and more than once. I've worked at Lake Patrol for extra duty for almost 20 years. You understand the test and describe them somewhat accurately. But there are far more tests being done than what you visually see. Please take a look at the Coast Guard standard field sobriety test for boating. Only then will you have a full grasp of what the officer has to accomplish. And yes, the officer is trying to get an impaired boater off the lake. It has nothing to do with ego. It is to protect the boater, his passengers, and others on the lake.

Never take a Field sobriety test. Always refuse a breath test in the field,per prove its calibrated. When they take you to the cop shop you have to blow if they demand it. No problem because even if you're over the limit they had no probable cause to take you to the station. Lawyer will beat it 99% of the time. Wake up people, cops and judges work for us. If an LEO commands you to do a field sobriety test, you're going to jail.
They don't request it to prove whether you're intoxicated or not - it's for the following paperwork afterwards... they've already decided you're going to jail at that point, intoxicated or not.

My husband and I just had a conversation about how we’re sitting here on our couch, no alcohol for WEEKS now… and we couldn’t do that dumbass test! I’d be furious about having to get arrested and go to the station in order to do a breath test. This happens to me, I’d go to the station and blow all zeroes and then get my attorney going to work on a civil suit. These cops are harassing perfectly sober people.

This is not a sobriety task, it is a memory task. He had no impairment with movement or coordination just remembering the complex instructions. His instructions were not clear as he read them. I loved “ I’m not trying to set you up”. He sure was.

I was a police officer over 33 years. I was on one of the largest task forces to get drunk drivers off the streets. His instructions are dog 💩. He was not explaining them in a way a normal person would understand. The biggest thing is. He is making the guy perform these tasks sitting on a tailgate where his stability is compromised. No normal person can perform these tasks 100% under these conditions. That warden is an embarrassment to law enforcement

As someone who frequently hangs out at durney key and anclote island and doesn’t drink at all for health reasons it’s good to know I’ll still be getting a BUI…..because being sober on my couch I couldn’t follow along that was insane….
That sobriety test is ridiculous. I sitting here drinking my morning coffee (sober of course) and I'm not sure I did that task perfectly. The cop must have given this test a hundred times, and yet he has to read it off to make sure HE gets it right. He demonstrated it so fast it would be hard for anyone to comprehend what he wants; and then add to that when you are under stress (just for being stopped) it compounds the difficulty. Designed to fail. I'm very much opposed to reckless or impaired boating, but this is not how you enforce it.
Seems to me that the field sobriety test was designed to fail suspects. Only someone that practiced these tests could pass them. The guy literally was calm and cooperative the entire time. Hope the judge threw this out.

Yes, surprisingly, they are intended to fail people who are impaired.... Interesting concept, huh? Get caught doing wrong, be expected to get called out on it... what a concept... do your time and pay your fines.
That's the part nobody gets. It's not a pass/fail test. It's an evidence gathering tool. They want you to take them because there is zero chance of doing one perfectly. That way, if they get you back to the station for the breathalyzer and you blow clean, they can claim they were still justified in taking you in because of "the indicators." They don't even use them in court, unless someone is suing for false arrest. That's when they bust out the FST sheet.
Never take the FST. They are a waste of time and don't help you, ever. Insist on taking the breathalyzer. It's the _only_ way to prove you aren't above the limit.

I was arrested in 2019 for a dui because I failed a field sobriety test and refused the breathalyzer. when we got to the police station for booking they asked me if i wanted to do a blood test and i agreed because i knew i had only had 1 pint of lagunitas ale. I was booked and charged with a DUI. I posted my own 10k bail. my blood test came back that i had a .035 and had all charges dropped.
I would go so far as to say that I'm probably a law enforcement apologist, but this arrest was total BS. Dickless behavior from all officers involved. 👎👎👎

He had every opportunity not to take those tests. I can’t stand the police in most situations, particularly in instances of “victimless” crimes. However, none of us know if he was sober for certain. For me, he appeared above the legal limit. They were just doing their job and these people were stupid enough to give the cops a few reasons to fuck with them.

Yes well, the cop knew the captain was lying about why the stickers were not on his boat like they should be. Thus a red-flag. Remember, the captain said his guy was going to do it but had a heart attack. It's possible it might have been true of the heart attack, but the cop wasn't going to believe it. I would not have believed it either.
The captain did admit that he didn't know that it was illegal for the girl to be dancing on the end of the boat and was understanding of that being a hazard. The girl could fall and hit her head.

This is crazy. There is no way the FWC could do this himself. He could barely read the test off his sheet without stumbling his through his own words.
The whole point of reading them from a paper is so the officer doesn't make mistakes. You would still cry if he had memorized them and read without the paper. The officer also literally showed everything very clearly. Problem was that this moron drunk was not listening and instead tried to do the tests while he was being told and shown how to do them.
