- On October 7th 2023 , FWC Officer Givens Was on Water Patrol near Duck Key, Monroe County. When he observed a 20 ft vessel with 12 young adults backing away from a large white cabin motorboat.
While approaching the vessel to conduct a safety inspection
Officer Givens observed multiple alcoholic beverage containers
floating in the water downwind of the vessel. The officer will soon make contact with the vessel, noting several intoxicated occupants
And the operator, later identified as Adam.

I had a teacher at boarding school, who said that he wouldn't tell anyone, if I told him where my drunk underage friends were at, but that he needed to know. I was taught to respect and trust adults, especially teachers. I would never blindly snitch on my friends. As soon as I told him, he said "sorry man you're all in big trouble now". Well, the end of the story was that we had a hearing in school where my friends and I were punished for drinking. In the hearing I told everyone what the teacher had told me, i.e. that he wouldn't tell anyone, if I told him. It ruined his reputation with the other teachers for years to come. What goes around comes around.

I can’t even feel bad for this guy. Littering, no registration, no life jackets, and he doesn’t even know if it has a horn. On top of all that the kids clearly hammered. Everyone thinks being in control of a boat is super easy but when you’re the captain of a vessel, there’s a ton of responsibility on you.

Not to mention they're literally taking the boat a tiny distance from the dock, it's really not a big deal to have some beers while doing that, nearly everyone in that area does it. The fact it was even legal to upload this video when he was 17 is baffling to me, it shouldn't be online. This kid is going to be ridiculed for this for the rest of his life, he's a 17 year old who made a mistake, he does not deserve this. Also all of the people mocking him for crying probably would have done the same thing, he's a 17 year old convinced he's about to go to the adult jail.

As the captain of my friend group (22-25 years old) I completely agree. I used to drink and try and have a good time with them. Took me 1 good scare from the coast guard during a very busy weekend on the water, and I haven’t had a sip while floating since 2021.

Regardless, everyone has a different pain threshold. Some people feel like paper cuts are terrible and some people can handle losing a leg awake. It’s a personal thing. It’s perfectly normal and fine for her to be afraid and want to make sure she’s ok because she’s in pain.

The girl who drove the boat back told the officer, “he needed a sober driver to bring the boat back,” she inadvertently busted the original driver of the boat. 😂

Lol no she didn't. The reason she drove the boat back is because the cop asked her to drive it back because he knew the driver was drunk, that's why he asked people at the start who hasn't been drinking. She didn't snitch on him at all.

It's not so much a matter of getting it all right, but the opportunity for the officer to evaluate how you go through the process. What you see watching someone sober doing the tests is very different from what you'd see from someone impared even if they got the exact things wrong. That said... the tests sure are different than in the 80's!

In the 80's, my friends & I ran into cops occasionally as teens because we would have parties in the woods. Teen boys would get arrested often. They would've preferred death to crying like a baby in front of friends & the girls. I NEVER saw any of them cry. If anything, they acted like tough guys. What is happening to our boys & men today?

I was just the opposite, I was a hellraiser and found out very quickly how to get around the rules. I have since taught my children the opposite of what I did. I am a hypocrite, but I’m also a doctor who learned how to stay somewhat safe. I’ve never lied to my kids, but I also told them to learn from my mistakes.

1) Don't drive and boat if you've had alcohol (or any drug).
2) if you're asked to submit to voluntary tests, refuse. And tell them you're refusing on advice of your attorney.
3) refuse to answer questions without your attorney present
4) if you are arrested, don't blubber like a child. Just suck it up and fight it in court.

Florida does have implied consent for BUI, but you only get a fine for refusing. You can still be arrested for suspected BUI without ever submitting to a test. But the officer needs probable cause.

There are no penalties for refusing the field sobriety test, though the fact that you refused to be tested can be used against you in court which is why you should tell the officer you're refusing on advice of counsel.
@@notpublic8961 I know what implied consent is. On the road, you have already given the state your consent to a chemical test when you got your license. If you refuse those chemical tests, your license will automatically be suspended in most states. You can also face fines and even jail time. You do not have to consent to field sobriety tests, but the officer can still arrest you on probable cause for smell, eyes, driving, and other indicators. Once arrested, you have to submit to the chemical test. I always recommend not taking the field sobriety test. It will hurt you more than it helps you. This is different from BUI (boating under the influence)

That's a CYOA measure, just like reading the Miranda Rights from a card, it so there's no room to interpret if he said everything necessary. Mess up a Miranda Warning, testimony can get thrown out, mess up the instructions to the field sobriety test and then it can be inadmissable. And when the officer goes to court he can produce the card/instructions to show what he used to recite what he spoke (memory can be called into question or given doubt).

They didn't seem that hard. The last one was kinda excessive but as long as you pass the more basic tests and then miss one or two instructions on the harder ones, you'll probably be okay. I don't know for sure, but they do multiple tests for a reason so I can't see them failing you completely for missing an instruction on one of the tests

The answer is yes, the FWC has the legal right to look in every compartment and cooler of any vessel if they have probable cause. So in this case the officer smelled alcohol, saw many underage teens, saw signs the "captain" was impaired, and saw litter (alcohol containers) in the water around/behind the boat. So at that point, the FWC officer had every right to check all compartments/coolers.
.... and that goes to show you if he were driving on the road, they'd be throwing those cans out and littering on the street. Shame on them.
