They've been to court, but it's incredibly unlikely he would ever get primary custody bc if the mom is a capable parent, she practically always gets 50-100% of custody. However, at his age, he should definitely have some say in it, so maybe he is down w 50/50🤷♀️ if he really wanted to get away from her, he could. Also, he kinda has to stay w 1 parent a little more than the other if he's in public school bc he has to be there for 5 days a week and it's just easier to have 1 school routine.
