- A murder charge that was laid against a Milton, Ont., man accused of killing an armed intruder earlier this year has been dropped.
The Crown withdrew the second-degree murder charge laid against Ali Mian Monday, saying there is no reasonable prospect of a conviction.
“I thank the Crown for using their reasonable discretion and agreeing to withdraw the charges today,” Mian’s lawyer Jag Virk told Global News on Monday in a statement. “My client is very happy and thankful,” Virk said. “He’s been under tremendous stress since being charged knowing that if he was found guilty he’d been spending considerable time in jail and he was only trying to protect himself and his mother.”
Mian, a registered firearm owner, was charged after he reportedly shot and killed an armed intruder who broke into his home on Gibson Crescent in Milton on Feb. 19.

Canada needs to seriously reexamine its self defense laws, I cannot even use pepper spray against a violent attacker without getting charges. Pathetic.

She never got charged, he needed a new liver, and never got his property back. The guy in this news story should have had his mother use the gun. It appears investigators and crown attorneys do have a choice.

I think the 5 gunshots sounds suspect. Similar to police officers being convicted for attempted murder when a suspect was shot like 10 times. ie. the use of lethal force is justified to incapacitate, to neutralize the threat. Beyond that it turns into attempted murder or in these situations beyond self defense.

@@sparklessconnectionselectrical What seems questionable is that the suspect was found allegedly with a loaded gun without any shots fired. This suggests that the suspect didn't have the physical ability to return fire and dropped the gun right away. I don't think it's unreasonable for the shooter to tried and cross examined under oath.
Also a lot of people are dragging the prosecutor, but forget that police officers who conducted an investigation recommended laying charges.

Weird laws and systems here. Criminals get release on bail whereas innocent people pay the price for their defense.
Toronto police advices that you leave your car keys at the front door with cookies and milk as a quick refreshment for the intruder. Next they’re going to require you to leave your home ownership, along with your valuables and keep your door unlocked. As if the police won’t just come in take notes of what happened, tell you they’ll reach out and then your case gets forgotten, then you have to deal with the mess with insurance (for the things that are insured). Canada wants you to be a lick.

That's a result of the way our laws are written at a fundamental level. Self defence is a lawful defence from conviction, not something that makes what would be a crime, not a crime.
So, you shoot and kill someone. Cops confirm that. Shooting and killing someone is illegal. Their job is to press a charge if a crime has even POSSIBLY been committed. They are not the crown, They are not a judge, they don't decide whether it was a lawful break of the law, or if it was illegal. Now you go to court. There, you argue that you had a legal reason to murder someone, that being, they were clearly demonstrating intent of causing serious harm or death to you or someone immediately present. The courts have to determine that it was ACTUALLY self defence and not an outright murder that you're claiming self defence for here.
And if I know anything about self defence in Canada, which I do, as I've been on the receiving end of charges(that were dismissed) for defending myself, including with a weapon, I'd wager that the reason why the crown withdrew here wasn't because they ended up agreeing that he lawfully defended himself, but that they couldn't disprove his claim of self defence. See, the way it works is that you can immediately claim self defence, and that shifts the burden of proof onto the crown to DISPROVE self defence, and there are still other defences you could pull after that if not entirely successful at getting the charges dismissed there. If they can't prove you DIDN'T defend yourself, you don't have to prove so much that you DID, and they can't convict off of that. They need basically undeniable proof that you killed someone with no possible legal justification. Or, they might just be speaking legalese as usual and sometimes that can be interpreted multiple ways. I'm experienced, but not a lawyer, so I'm not entirely fluent anyways.
Hopefully that helps clear some of it up. Our system is written in an old, messed up way from the ground up. The whole thing needs to be reviewed and modernized, written with more clear meaning. What good are rights if people can't understand them even if they know them, eh?

Not always. I caught an attempted murder which was self defense the attacker had a firearm and I ended up stabbing the guy in self defence while I was taking my son to school I still had to plead to a assault causing bodily harm and this was on a legal aid and cash lawyer too

Canada law enforcement has a twisted version of justice with examples like this. He was CHARGED. He had to POST BAIL. HE WAS INNOCENT OF ANY CRIME. When does self-defense against 5 INTRUDERS IN YOUR HOME become a crime? My sympathy goes out to all Canadians. Better take a look at your laws again.
Took long enough. It is INSANE that a guy who fights off FIVE attackers by himself (his wounded mother doesn't count) who were armed, and had the restraint to only kill one and NOT pursue the others in some fit of vengeance, was charged to begin with.

Not exactly, it didn't go to trial because because there was no expectation of a conviction. There is no precedent if it happens again. If it happens to you remember this, when the cops start asking you questions, simply say you felt your life or the life of your family was in immediate danger of of death or grievous bodily harm and I have nothing further to add without speaking to a lawyer. If they say why? You can site this case and say we live in Canada where law enforcement don't respect a person's right to defend themselves. Then you may or may not be charged but you will make it a lot easier for your lawyer to defend you if you don't talk.

The right to self-defense should never be denied to anyone. Someone brakes into your home you have a right to defend it up to and including lethal force. There is no way to know if the intruder might kill you and your family. I follow the golden rule BEST JUDGED BY 12 THEN CARRIED BY 6 FAMILY MEEBERS OR FRINEDS TO THE GRAVE.

The question that was never asked was WHY would five men from Toronto want to raid a house in Milton. Ali had some that they wanted. Ali didn’t have to shoot anyone to “defend” his mother. Because the way self defence works in Canada is that it is a legal defence for committing a crime. Kinda like how if you have to rush to a hospital, you can speed a little bit, maybe run a light(safely) or two, and not get in trouble because of the situation? Nobody says you didn't do that stuff, they're saying it wasn't illegal to do it then. Also kind of like how it's illegal to posses firearms in Canada. UNLESS you are properly licensed for that firearm(and the other nitty gritty details we won't bother with here). So, as far as the law is concerned, a murder happened. He's claiming it was a lawful murder(self defence) and in this case, the crown couldn't prove him wrong or otherwise guilty. The reason he(or anyone else) gets charged at the beginning is that the cops have to press a charge when a crime is serious enough. It doesn't matter if they know you're innocent of the illegal side of murder, they're not the once that get to decide innocence, that's where the courts jurisdiction comes into play. They have a body with gunshot wounds, and you holding the gun, that's enough evidence that a crime occurred that they HAVE to charge you. youThen, you prove innocence and the crown proves guilt in court. The reassuring thing here is that the crown withdrew before trial. They don't have to do that, and they usually don't unless you make a deal with them.
So yeah, doesn't make a whole lotta sense, especially at first glance, but the alternative is possibly allowing actual murderers get away, at least for a time, by grooming the scene a little and then claiming self defence to avoid charges or possible a thorough investigation to begin with. Bit of a catch 22, no?

Why was there even a debate about whether or not this was self-defense? A person has the right to protect their own life. The fact that he had to do any time or was inconvenienced anymore than the trauma is disgusting as far as I’m concerned. He did what he had to do to protect his family. Never should of been charged in the first place. This country has a fundamentally broken understanding of justice.

Anyone breaking into someone's home or vehicle should have all his right instantly negated for the duration of the crime and anything that happens to him should not be punishable by law.

Sick that someone would be charged defending their home and family. Any intruder into your home is assumed to be there to cause harm. They break in, they waive their right to life.
I can’t fathom that I can get criminally charged for defending my love one’s lives. Failed society.

I’d rather live in a community where the criminals fear getting shot by those who live there should they try to bring harm to good honest law abiding people. Protect each other. Police only show up to take victim statements after the crime has occurred.

@@appletree9974 so, I'm not sure when you got here, but guns have been a part of Canadian culture longer than we've had independence for. Longer than we've had the name "Canada". Longer than we've had a local established government.
My family came here roughly 400 years ago with the best, most advanced firearms we could afford. We built this nation's economy, fed our families, and defended our nation, homes, and farms with those firearms. Guns absolutely have a place, and it's right next to the heart of any true Canadian. They have always had that place, and they always will. Without guns, we wouldn't have Canada. Simple as that. Beyond that, we are some of the most savage, brutal, and feared warfighters on the planet. You don't achieve that by picking up a rifle for the first time at 24.
So you will not sit here and deny the heritage of millions of Canadians. That's the same line of thought that led to the near extinction of our Native tribes. I will not see that happen again.

Canada needs to have the right to defend yourself when faced in a life or death situation. Those men had no good intentions with his family and he did what he needed to do so they could live to see another day

Criminal Code of Canada, Section 34(A) and (B). Read them before you make another comment like this.
Understand your rights, and how they work. Self defence is a legal defence to what is otherwise a crime. A man shot another man, killing him. That's murder. The fact that it is justified makes it not a crime.
We can do things the other way, but then you run the risk of letting actual murderers claim self defence to try and escape justice even more often than we already do.

From my understanding reading law it is very wake, spelling i know, so it can be interpreted is so many ways....with a good lawyer.
I come from a country with extreme fear and violence where the law is against the victim but for the criminal.
Many people are killed with their own firearm.
People have sometimes split seconds to make decisions, fire or not.
If you understand the law is against you, sometimes people just die.
@@useryggfdcc None taken. I've been a victim of the law myself, it's what's driven me to become as familiar with it as I am. I get it more than I may let on, but that's only because I haven't given up hope in the spirit of justice, at least not yet.
For what it's worth, I'm a firm believer that the law is not always right. And I apologize for responding harshly.

Unless they got the wrong address? or maybe they knew he had legal guns and were after those? Could be anything either way, they invaded his home, beat his mother and did it while armed with illegal handguns and zip ties. What led up to that should be irrelevant.
I'd watch the news if I were u. It's less common than you'd think. There have been many violent home intrusions linked to auto theft in the Toronto area. Anyone with a nice car that doesn't leave the keys in it could fall victim to this

Yeah me too BC otherwise the guys was within reasonable force sinces it's firearm vs firearm so it doesn't make sense for the laws to go trough all that trouble when he obviously used reasonable force.

They do however do that when they’re looking for a safe, drugs or settle a personal vendetta. The son was definitely up to something. Unfortunately, it’s Halton region and they don’t investigate properly.
