It honestly depends some artist I commissioned charged 30$ for some amazing artwork some only 5 for the same quality of work some nothing at all not saying he was right about only paying 5$ if you talk to an artist and agree on a price you pay that price

Honey, as someone who is an artist and studying to be a lawyer, I'm gonna bet that if the lawyer is going to make a small research, find out how he didn't pay for months a small bill, can't be trusted so make him pay in advance, or else gonna shut the door and totally ignore this influencer claims

it what happened to a freind of mine. she works by a 'pay a small downpayment (i think 15% of the full cost) for the art and she'll do up to the sketches before asking for the full payment. if they say no sorry, she hasnt lost alot as she does sketches real quickly and up to a good enough standard so its not like she's lost out on anything.

I am blessed enough to have an artist that trust me enough to do work for me when I can't currently pay them. I would say the big difference is while they takes a long time for them to get paid they've never not gotten paid and we've known each other since before they were doing art for commissions. I was the first person to ever commission art from them, and I probably commissioned about a hundred different pieces now. I always try and prepay if I can though.
As a photographer, we artists get treated like this. People look at what we do as a cute little hobby and not OUR LIVING.

I am really tired of these "poor" influencers. He used this excuse with his cat situation. Yeah, you have thousands of dollars to spend on makeup, clothes and your apartment but can't pay the artists. Like... seriously? Why would you hire them if you won't be able to pay them in the first place?
This. They spend so much money on things they can barely afford, trying to show a life that they certainly struggle to maintain and yet they keep doing this. This is why you have to learn how to mange your money and be careful on what you spend it on

I’m not really educated on this stuff so I could be superrrr wrong with this, but I think it’s free if someone else takes you to court and it’s not your choice to go. But if you’re the one taking people to court, you’re gonna have to pay to get it going. Maybe he’d still get a free attorney or whatever but he’d still need to pay fees to get the whole thing set up

@Vitali Malendevich (vm1298) basically paying someone to use their stuff. So for the merch the artist would get a percent of each sale, for example if the merch cost $10, the artist may get $1 (probably not that much irl though). Song writers can also be paid for their songs, so every time their song is played on the radio, they get some money. I don't know the specifics, I just took business studies in high school.

I agree, he talks very passive-aggressively of her. Him being terrible with money is NOT her problem. I pity that she had to deal with this. he said things like, 'You knew I was in a terrible situation.' (Which is probably why she was so patient in the first place.)

This is a mess but to any artist out there, any form of art. Don't under cut yourself, don't settle, don't cheapen your value, don't put off payment for the future, know your worth in terms of pay and I can go on. This is not the first time I've seen artists having to publicly come out about stuff similar to this, or people stealing their art pieces. Watermarks can be helpful also, a huge one over your work so no one can use it on the internet but have an unmarked one if the piece is sold.

As an artist who does commissions this pisses me off. It sounds like she’s underselling herself. ALWAYS TAKE FULL PAYMENT OR AT THE VERY LEAST A DEPOSIT.

You HAVE to stand your ground. If you’re doing commissions make them pay upfront. I’m an artist too and if I ever did any commissions I wouldn’t want to work with anyone unwilling to pay for my time and art.

it’s sad how much this happens in the art community. I’ve made shirts and logos for a project and i revived no money or credit for the work. i ended up actually making and printing one of the items from scratch and for free, and the person took them and started selling them and claimed they made it and payed for printing them. I’ve tried to come forward but fans of the project attack my account.

Do NOT work for free, unless doing the project itself brings you happiness.
People will only take you seriously as an artist (be it writing, art, photography, dancing, etc) if you take yourself seriously. And will happily steal your money when you don't.
Also, NEVER sign a contract you haven't had a lawyer or business manager look over.
Caveats can be slipped in that look innocuous, but have the power to take all of your work and leave you empty handed.
You deserve better than being treated like that.

If I were Colourpop, I’d kindly ask Thomas to keep my brand out of his mess. His commission is coming from the kindness of his subs hearts more than him actually doing substantial work for them.
I’ve had an ex that did this to me. (The whole not paying me back thing) I would buy him Uber’s and meals and he would say he would pay me back and he still owes me over $100. It’s so frustrating having someone say over and over that they’ll pay you back and never doing that.

As an artist, I had the misfortune of asking for payment after I finished a complete picture before. The dude backtracked and said “Oh I don’t want this anymore, looks great though”. And pretty much stole it. I was young at the time, and didn’t know how to get the money from him, so I just called it a loss. Now I 100% ask payment upfront, otherwise I will not put anything on paper until I know they want what they want. And it’s also true that artists really do undersell their work. You wouldn’t ask a “normal job working” person to do their job for free or for pennies with how many hours they put into it. Please artists, try to AT LEAST get minimum wage for your artwork. But I always shoot for $15-20 an hour. Try and talk with other artists to get an idea what they did to figure out their prices, and best of luck!
Patches Hyena if you’re an independent artist, at least ask for 25$ p/h or more. You also have to pay taxes and insurances, and be able to live and invest in your software and supply.
As a fellow artist this is why I chalked it up to a loss trying to find a career in art. I would love to but I know its unrealistic for me no matter how much people say they love my art, they only love it when its free.

They both should have done more research about business agreement before jumping into the wagon.
From my observation, she should have gone for *flat rate royalty* . What I mean is that for however long the line is still up on sale, she should get a fixed $ royalty out of it per month basis. The key she should look for is *consistency* .

Bukan Saya yes. sadly, we don't live in a perfect world and you cannot trust everyone. it is your responsibility to make due diligence to ensure you get paid for your work rather than discussing it afterwards. I think she is too naive, but I hope she gets paid eventually. and let this serve as a lesson from now on.
I think 6$ is a waaaaaay too small amount... but at the same time they agreed on 10% royalties, so if he were to make 1000$, he'd have to pay her 100$. And if he makes 100$, that's 10$ for her... it's just how it is. That's the risk, you get what you agreed on.

What I really don’t get is if he owed her $5 instead of the $150 then why didn’t he just say that to her in the first place? Instead he said to add money to that original amount and then he would pay her 10% of it. If she made a mistake adding stuff up then TELL HER instead of figuring out an amount together and then complaining when she asks you to pay her!!! And then complain again and say it’s the wrong amount!!! Ugh I’m sorry. I didn’t hear a lot of people bring this up so I just needed to rant.
I feel you. Plus he sells the sweaters for 41.99 on his store. Him claiming he only owes her 5$ would mean he only sold one (1) sweater, which honestly? I highly doubt that.

One of the benefits of this is avoiding ambiguity in business transactions. People who don’t understand that are children and not adults. Doesn’t matter your age. You’re still a child.

Shame on him for screwing over a friend and shame on Luka for being naïve enough to NOT make him sign a contract FOR royalties and/or pay a flat rate up front. Should've gone for the flat rate. She is not going to see royalties on every one of those shirts/hoodies sold (the $120 or so was for only ONE month which people are overlooking, he owes her much more than that now).
Don't know why anyone gives him time out of their day, let alone why brands will endorse and sponsor him.
Let this be a lesson to any aspiring artist out there. Do EVERYTHING by the books. Make sure they're paying up front or signing a royalty contract. It doesn't stop you giving a low rate to a friend, it just protects you from people like this. Know that your art and time has value, so you should not go below minimum wage per hour spent on the piece. You should only be dropping your rates that low for a friend if you want, or to build up your portfolio (so you get your name out there for bigger commissions).
This is why when I make pictures for someone they don't get a copy without my watermark until after I'm paid

@@joejohn524 i specialize more in logos and flyers for businesses though so that's why i do it my way. They get a "proof" with watermark, i get payment then they get without watermark. Kinda like how companies that do school pictures do it

It is also important to keep records of conversations with potential commissioners (emails & texts) get everything in writing. Especially the part about the right to use the artwork, always make a stipulation that either the copyright of the artwork will remain owned by you UNTIL payment is received or that the copyright of the artwork will remain owned by you indefinitely but they will have permission to use the artwork once payment for the work has been made.
If doing a commission where your payment will be royalties then my advice would be that you make sure you stipulate that the ownership of the artwork remains yours as well as stating a clear upfront percentage you will gain from the sales, also make it clear the frequency of when you will be paid, you may choose to get the royalties monthly, quarterly or yearly since it not really something you can predict upfront, however, you may be able to stipulate within the contract that you receive a deposit/advance prior to the use of the artwork, this deposit should be a fair and reasonable amount based on what the commissioner's projected sales will be. If you get a deposit/advance then you receive no further payments from royalties until the amount of sales has generated enough that your deposit/advance amount has been reached (example: you choose to get paid quarterly and get a deposit/advance of $100 and the first 3 months of sales amount to $150 of royalties, you then receive $50 from that quarterly and ALL royalties thereafter). Deposits/advances should also have a cut-off time as well, so if you get $100 advance but the sales don't produce enough royalties to reach the $100 then you should pay the remainder back, I.e if the royalties only would have given you $78 by the end of month 12 then you should have to pay back the extra $22, but despite paying the $22 back after the 12th month and the image is still being used then you should continue to receive the stated royalties.
