Jbki proviso may likha h ki if (illegal act) offence krna ka agreement Kia to agreement krna he sufficient h to prove criminal conspiracy.. act krna zaruri nhi h.. As per section 43 of the IPC the term illegal includes 1) Offence 2) Act prohibited by law 3) Civil action 4) where a Person is bound but he omits. As per section 120 A only for point no. 2, 3 & 4 agreement+act is mandatory to prove criminal conspiracy but for point 1 agreement is sufficient to prove.

Sir..what if a particular person who already knew about such conspiracy anyhow but did not involve in the agreement..whether such person will be liable for any crime ?
Under crpc section 39 it is mandatory for a person to inform about commission or intention to commit certain offences.. so in such cases if he does not inform he wd have to bear the burden of proving the excuse as to why he did not inform the police or magistrate
