This is a great development towards losening the strict requirement of what constitute PI. Further, it saves the parties from the cost of having psychologist determine PI which result could be fabricated as long as you can pay.

Very well said denied po annulment due to lack of facts legally daw po.too sad 4yrs of fighting for my freedom and 7yrs being cheated and abuse by my ex husband attorney. But still didnt met the judge requirements for psychological incapacitated.. Appealing now for motion. Very correct that we can gain back our self respect due to maybe the judge value marriage which doesn't apply to all abused wife and traumatized wife like me.thanks for this video. True! I know a lot of psychologists have built a profitable career in these annulment cases due to psychological incapacity. Now, they are no longer needed. Lawyers and judges na daw ang magdedecide kung may psychological incapacity. Haha

Kung may VAWC case na pong nangyari (Physical, Psychological, Economic, Sexual abuse) at naipanalo ng Petitioner ang case, pwede po ba itong maging depensa for Declaration for Nullity of Marriage? Kung sakaling nakakulong na din po Respondent/Abuser, pwede ba syang magfile ng Declaration for Nullity of Marriage at maging depensa naman ng VAWC victim yung naipanalong case? Sana po mabasa nyo itong katanungan ko. Maraming salamat and God Bless po.

Hi Jonalyn. Yes, death terminates the marriage. So, pwede na magpakasal ulit. Pag nag-apply ng marriage license, ipapakita lang ang death certificate ng yumaong dating asawa.

This only means that the expert witness testimony of a psychologist / psychiatrist may no longer have significance in defining and understanding the issue of psychological incapacity since it is now considered as a legal concept rather than a psychological one. I agree, it may result to bias understanding on the part of the judges.
Exactly! It will be hard to decide Art. 36 cases if it's a "legal" concept. As the saying goes, there are as many interpretations of the law as there are lawyers, judges included. Hehe

Hi sir. Question lang po. With the release of the new bar bulletin po, it stated that principles of law after the cut off period will be included. So meaning even Tan-Andal case is included. What should we follow po? This jurisprudence since it is the recent jurisprudence on psychological incapacity? Or ung mga dati na po since the bar exam incouded canonical jurisprudence daw po? Good morning po atty. Kasama po Ba Jan yung asawang lalaki na ayaw magwork kasi feeling nya pag magwork sya mamatay sya. May history po sya ng trauma nung binata Pa at Hindi KO po yun alam. Nung mag asawa na po kami saka Lang nakwento sa Akin ng pamilya nya na may trauma attack nga ang asawa ko kaya ganyan ayaw magwork. Mag 5 years na po kaming kasal at pagod na po ako physically, emotionally at mentally na intindihin ang kalagayam nya. May possibility po Ba na sakop sya neto? Salamat po sa sagot atty. At bago Lang po ako sa yt nyo po😊. 🙏
Yes, it can be considered psychological incapacity to perform marital obligations. The marital obligation that the husband failed to perform is "to support and help the other". If the reason for such refusal or failure to perform is rooted to a mental, personality or psychological disorder, then, I submit it is psychological incapacity.
