If I may ask, regarding an executed intent to purchase of subdivision lot: is it possible that the sum of money deposited for at least 2 years’ worth of installment to a purported seller of subdivision lots can be returned to the purported buyer of subdivision lot? The grounds are the following: 1. there is no license to sell from HLURB; 2. no technical description of the subdivided lots by a Geodetic Engineer; 3. and no certificate of reclassification of the land from agricultural to residential land. Thank you very much, Atty.
Yes, the sale can be avoided and the deposits should be returned. The sale is obviously void. No LTS, not technical description and no reclassification. File the action for refund with the HSAC.
Hi Atty! law student here, If a question will be asked in the bar re: WON a legit child is entitled to use the surname of either parent under Article 364 of NCC - Alanis III v. CA po ba ang controlling case? or sundin natin Alfon and Oshita rulings that required valid justification in doing so.
