      It isn't about doing the test correctly...it's about observing someone doing complicated tasks which gets them distracted from 'acting' sober. You can easily distinguish between a sober person failing the tests and an intoxicated person.

      ​@@Chronic2112it most certainly is about doing the test correctly I mean we can agree to disagree but I'm telling you when I was in LE back in the day when we gave a field sobriety test you get judged or graded on your performance I mean the second part of your post you said you can tell the difference between a drunk doing the exercises and a sober person doing the exercises So it's kind of contradicting yourself what you're trying to say.. The foolproof exercise is the eyes If you've been drinking you're not going to pass that test it's impossible some drunks can balance very good but you're not going to control your eyes.. This is how they do their field sobriety test on a boat which I have no experience in but it's the same outcomes.. When I say you can't control your eyes I'm talking about when you are hammered If you are borderlined then your eyes won't have the jerking or you can pass the eye test if you are like borderline but if you hammered there's no way that's why after the test there's always them blowing to verify what you suspected I have had someone blow under the limit and they go about their merry way it doesn't look good when that happens anyway Like I said we can agree to disagree I'm not acting like I know everything I'm just saying it's about doing the test correctly and like the thread said about having a hard time passing that sober That is a tough one at the end anyway This is voice typed so I hope there's not too many mistakes Take care 🇺🇲🦅🌍⚓ USMC

      Not about being an Attorney it’s flexing my knowledge of my rights. I’ve had a few rookies in my town that didn’t understand ID laws. Safe to say the judge is a good dude I’ve known for years. He’s dropped 2 separate cases. Not to mention I had a cop on video using excessive force and falsifying charges on me. Dude was fired a month after court got the video. Unfortunately he’s probably just fucking with ppl in another precinct.

    You can tell that's a good man. He didn't resist. He cooperated the entire time. Officers did a good job, Captain did a good job. Wife was a little wild, but overall, not bad. Hope he wasn't punished too bad.

    In Florida, generally never admit to drinking and don't ever agree to a field sobriety test. Cops know you are nervous and know you know nothing about boating (increasing your nervousness)... if they ask for a field sobriety, you are getting arrested no matter what 95% of the time.

    This is a total joke. He followed the directions exactly as he was instructed!! Additionally, the idea of placing him in handcuffs BEFORE you put a lifejacket on him is beyond dangerous. I would turn around and sue the police department for negligence. If he is drunk, as you allege, the idea of having him in an unfamiliar boat, standing up, without a lifejacket or the use of his arms is SO treachorous..

    I grew up right there!!
    A) there’s so much boat traffic right there it’s not safe
    B) but more importantly when the tide from Santa Rosa bay goes out to the ocean the current is soooooo strong there it will pull you out into the Gulf of Mexico in the blink of an eye.

      @neikocoleman9856 I agree they need to be strick and a person who accepts responsibility to captain the boat shouldn't drink . However the tests they give you are really not designed to pass sober or not . Example : Touch the tip of you nose with the tip of your finger ..... it's up to the tester if you pass or fail . Touch a little lower than the very tip of your finger fail complicated by the rocking of the boat and the nervousness of being in the position in the first place, it's a EASY FAIL . Don't drink and don't do field tests , take a breathalyzer or blood work. Ask me how I know 🤣

      What is passing? What objective measure is the criteria? It’s not about passing, it’s about how obviously drunk you look flailing around doing it. You might not be able to do it sober, but you wouldn’t look like a drunk trying to do it

      The officer went to some length to explain the difference between the tip of your finger and the pad. He used the flat pad part as opposed to the tip. And the blow tests (.11+) were discussed at the end.

      If you are stone cold sober and performing the sobriety tests the same as a person who is blowing over 0.11, Id recommend seeing a specialist to figure out what sort of cognitive issues you are suffering from unknowingly. Could be a sign of a tumor or some sort of disfunction.
      That, or you are taking certain medications with certain side effects.

    Boat captains, you have to be the responsible adult amongst the rest of your passengers. Never put yourself in a position to get a BUI. I see irresponsible captains on a frequent basis. Bad things can happen quickly on the water and the captain always needs to have his act together.

    3 of the most important boating safety laws that people just assume dont apply to them are, dui, swim zones, and channels. You cant drink and drive a lawnmower, you are supposed to *stay* in the channel as long as you can because outside of it is either a swimzone or a harvest area.
