This is a frustrating story to hear because it really just shows how pay to win our justice system is. If this guy was able to pay for a defense attorney he would have plead not guilty during the arraignment, and his lawyer would have had a phone call with the DA's office afterwards where they threatened in a non threatening way to subpoena two witnesses (manager who handled the transaction and the friend) as well as the security footage of the transaction. The DA's office would have realized there was no case and the charges would have been dropped before the preliminary hearing that the attorney also would have requested. What he got instead is someone who for however much of a good person they are, was only focused on damage control.
His only crime here was being poor.
the way he tells the story his court appointed attorney didn't know all the facts. It sounded like his attorney was pretty good, I have a feeling it he insisted on pleading not guilty and explained what really happened there would have been a different outcome. An overworked paid attorney may have done the exact same thing if the guy didn't tell the story and insist he was innocent.

He's lying by withholding key information, and trying to minimize what he did. He also obviously has racist views. He's had enough time to make up a good story to tell future employers
Isn't this almost like entrapment? A representative of Gamestop OKed the transaction with full knowledge of the situation and another representative of the same organization (district manager) pressed charges. They setup the situation where the incident only proceeded because of Rep A's approval, then try to throw a red card on that very same action.
It feels like it could almost be like entrapment, but unfortunately it wouldn't be considered as such because he was willing to do the action at the end of the day.
Entrapment would have been if he was threatened with punitive action if he didn't, like if he was going to be fired if he didn't go along with it.
Oh yeah, there was definitely a missed opportunity for a case against the company here. If I told my mom about it she would probably be rubbing here hands together grinning, just thinking about the money.
I still don't understand how what he did was illegal. It looks to me all these charges should have been dropped.
he did say that the district manager removed the record of purchase or something along those lines. Still considering that there was the manager and his friend during the purchase, its strange that he couldn't contest it. Maybe his lawyer though it would be easier than going through the whole process.
@@slipper1889 It is 1000% easier to plead than go to trial. 80%+ of all cases plead out. Honestly, his court-appointed lawyer went above and beyond. That person's workload was probably around 20 clients per day.

@@calamaricarter8609 This case was like that. All he had to do was bring up his friend as a witness and say "yes, we bought this together", but the risk of conviction is still so high that it was safer to plead.
It really shouldnt have been but lots of laws are stupid and legally screwing people over is easy when you have any kind of authority (yes, even on the level of a store manager)
Judging by how the cops treated him, I think they knew he was bamboozled and were just trying to hide their sympathy.
The cops didn't *have* to arrest him. They could have asked him what happened and use critical thinking skills to determine no crime was committed. The proof is on the receipt. If they knew he was bamboozled, they didn't care.
As somebody who also works in game retail, I was screaming "OH THANK GOD, YOU UNDERSTAND" when he was talking about traded-in consoles. People, if you want to trade in a console, please at least wipe it down for us ;.;
I worked at a game store and we could tell people that we’re not touching gross shit unless they get it clean first
What's even worse is that these people are so used to being covered in crap and living in filth that it becomes normal to them so they don't even notice the state of the stuff they're trading in. I've heard people doing repairs face a similar problem of being handed filthy devices by people who don't even understand that their filth is what caused the device to stop working

Also ex-gamestop here, all of this is almost identical to my experiences. Also the charges for "fraudulent" transactions are something they do surprisingly frequently. Their asset protection is ruthless.
Man this story makes me want to cry, what he went through is so unfair and I cannot believe this didn't get thrown out by the judge. I understand how it looks "on paper", but I feel that a simple explanation of the situation would clear up any "illegal" wrongdoing! Because there literally is nothing illegal about this, his friend was present and used his own store credit, and a manager signed off on this purchase! It just feels so wrong and to have to go through all this stress because of it doesn't seem right. I'm glad he seems to be doing a lot better and has moved on all things considered, but this never should have escalated to criminal charges.
Yeah, that lawyer should have encouraged a not-guilty plea. Kid didn't have a backbone because his dad wasn't in the picture. A real father would have had a bone to pick with that district manager.

I think he's leaving out details or just didn't talk to the lawyer at all. Story doesn't add up.
I would say one thing to tell everyone: LAWYER UP. IT IS YOUR LEGAL RIGHT. Trust me, maybe the judge doesn't, but the system WANTS you to be convicted.
Problem is many people can't afford to get their own lawyer and are stuck with whatever lawyer the state gives them, who happens to also be working on a ton of other cases simultaneously too so doesn't have the time to properly work on each case so people end up stuck with lawyers that can only give the case a quick look through
@@HarleyHerbert that's true, but 99% of people are still less versed in the right moves to make in assisting your situation, meaning court appointed is still usually vastly better than representing yourself.

his final words to everyone are actually really important. as someone who didn't leave the house for 2 years and showered 8 times in those 2 years; those tiny first steps are so important. it's been 10 years since then, and I'm in a MUCH better place. But I vividly remember in the beginning of my recovery crying and saying, "all I could manage today was to brush my teeth and take a shower."
at the time, i felt like a failure, but I was assured that the progress i was making would make a difference and to keep at it.
to keep trying and moving forward was the hardest thing in my life, but 10 years later, i'm so happy and proud that i did. some days it still feels very hard to do those basic things like shower and brush my teeth. and some times i can't manage them. but 99% of the time, I can.
all anyone can do is take it day by day, and do what you can. if you keep at it, eventually you'll see a difference and see just how far you've come.

I did this for years too, some how got out of it and have a wife and a child, but occasionally I'll still grt back into a slump for a month or so at a time. Depression is a bitch
I also hate upselling. I had a boss working at The UPS Store who once said, "Don't assume the customer isn't rich" - which amazed me considering how many people in this country are paycheck-to-paycheck. If some grandma tries to ship something that would cost $20 bucks, then first offer the $60 option and pretend like there aren't other ones unless they ask.
I refused to upsell and always had poor sales numbers, because I always thought that loyal customers will come back if they know they can trust you.
Needless to say, they cut my hours and I quit, and left a review online for the business warning people about their practices.
A coworker later told me that the owner called me "a socialist" lol.

For those who were wondering like me why the friend or other manager didnt stick up for him, he explained in another reply in this section that the friend didnt want to get involved and that the manager was not clear or that he was afraid.
See this makes it make even less sense. I can’t imagine any lawyer, court appointed or no, would let this guy plead no contest in face of such insurmountable evidence. Who cares about the will of the manager or the friend? They can both be subpoenaed and made to testify in front of the court, absolving him of any wrongdoing. This guy either made up the entire story or has fabricated specific parts to make himself sound better

I'm... Fairly certain GameStop shouldn't have been able to legally charge you. Because it wasn't their money that was "stolen", therefore it's the owner of said money who would have to press charges.
If you're being charged criminally, which theft is, it's up to police and prosecutor discretion to press charges, not the person who the crime was commnited against.

Gamestop doesn't charge you, the system does. Gamestop called the police, it was out of gamestop's hands after that.

I wonder if he can get his record removed because he was a target of a money launderer who is now in jail. I'm sure there is something possible because of those revalations. I'm glad he's in jail because if that happened to me, being in jail wouldn't have been his only problem.

The US is out of control, highest incarceration rate, 25% of world incarceration is in the US, twice the mortality rate compared to europe from pandemic, a non livable wage, expensive pharmeceuticals, hospital bills that can make you lose your house. I thought you were refering to the US when you mentioned late stage capitalism. You need to reevaluate your perspective

It's the fact that by taking baby steps we can live more in the present than mourning the far future of imagining all of this tower of work we have to do. Just live in the moment and do the little you can. In time it'll amount to more.
literally went through a similar situation to this at Kohl's. I was always working hard even at $8/hr to make sure the store was getting good numbers. a lady came in with goft cards (that i now know are fraudulent) but the manager approved them but it went through my associate number at the register. and a month+ prior I had reported a manager to HR for harassment against several employees so she was always after my case. then one day they called me and tried to pin 6k in stolen goods on me but had 0 evidence so nothing actually stuck. they were only able to fire me and put a theft flag on my kohl's account and they tried to get me to pay 6k but I just ignored them.

The way some managers would set you up for failure, truly was sinister and getting fired almost seemed inevitable.
I was an assistant manager for two high volume stores and it was an absolute nightmare, where I also met some of my best friends.
Why exactly couldn't he call his friend as a witness? Receipt? Surely the store credit would have been under his friend's name.
I came here to ask this. Where was his friend during all this? The guy who used store credit.
Either this guy was deaf and mute and had zero ability to communicate - or he's not telling us the whole story.

To be fair, gamestops online store is pretty good now these days. Plus the recent change of management seems to have really pushed the company into a better direction than when this story was set in. I've bought some stuff and had it to my door the next day.
I know it's their job to upsell me and that they get reviewed on how many people they sell memberships to, but come on man, we both know I'm not buying a membership so don't give me the full sales pitch when I'm the only customer in the store. Just mention it so I can say no and leave.

I worked at a mega replay (midwest GameStop type store) and when my general manager quit he would go in when he no longer worked there to find ways to get me fired. He succeeded and my regional fired me for “buying a game with my discount without it being on the floor for 7 days.” I didn’t know I even got my discount on the game until I was being fired for it. Turns out my old gm went behind the counter, logged in, printed out my receipt, and told my regional all because he wanted to buy it and sell it himself second hand for 6x the amount

He had two witnesses : his friend who he bought the PlayStation for and his manager who allowed the purchase, I don't understand why he got charged ?
The friend was very selfish and didn't want to get involved so he didn't speak up for me. And I can't say for sure why my store manager didn't but I assume he was afraid the district manager would go after him too.

I had no idea what I was doing and even though my court appointed lawyer did go out of his way to help me I wasn't his only client he probably had a ton of other clients he needed to help besides me and I didn't want to fight the charge. Court fees are very expensive and a 19 year old kid with no money or knowledge on how court proceedings work probably would have been a a total disaster. I requested to plead no contest and the lawyer didn't push the matter.
Man, I relate to working at Gamestop (also in Virginia and I was 19 too). I thought it'd be a really cool job - I was pretty excited.
During training they tell you to try to approach customers with open-ended questions, like "what do you normally play" etc to see if you can assist with choosing a game.
A guy came in, probably in his 50's, and went to the PS section. So, not knowing any better, I approached and asked what he normally plays.
Without hesitation he said "Nope, I'm sick and tired of this sh*t" and stormed out of the store. As he left, my co-worker said "he was just doing his job" and then the guy made some comment about getting harassed on his way out.
I quit probably a few months later, because I hate up-selling unnecessary things (I also agree with you that it's bad for business when customers realize they can't trust you), the pay and hours were low, and promotions aren't desirable.

I’m so glad that the DM who did this to him is gone from the company. I’ve been with GameStop for two years, and I personally haven’t really experienced what he was retelling. I’ve had a generally good experience with a kind crew and higher ups and stuff. Hearing his experiences with that DM and having horrid schedules and things like that is just crazy. I hope for better things in the future for him.
Also please for the love of God people keep your games, consoles, and more importantly yourself clean. The world doesn’t need to smell like a convention center.
Call it a coincidence if you want, but corporations that gamify accomplishments all have bad reputation for disregarding their employees. It’s dehumanizing. What managers need is to actually do their job and catch the unique characteristics and needs of their staffs.

Wow it really struck me how this story and how he was treated seemed so absurd to me - and then his skin colour is revealed, and depressingly it made a lot more sense how things escalated for him. I served 10 days in jail and 13 months of probation for battery... I was blessed to be receiving financial aid to pay off court and probation fees during that time.

The American legal system is insane. It sucks how if you are charged you pretty much have to take a plea deal even if you are innocent. I have a friend who has a brother who thought the system was fair and went to trial because a bunch of girls from his high school said he assaulted them (he didn't) and he had to go to juvy for years like he was well into his 20s when he got out. He can't even live with his mom because he is a "sex offender" and he can't be around the kids the parents babysit sometimes. So he is all alone in this world after having his youth robbed from him just because some assholes wanted to abuse the legal system.

I'm black and that "color of my skin" part was a plot twist to me... lol... but the guy is a pretty good story teller... I'm just heller frustrated by the fact that all of that court stuff would've likely been solved by him making sure his side of the story got across...
But then again, some lady where I used to work took me to HR because I said she was pretty... then HR basically gave me a lecture about not trying to "screw the crew" and no questions were asked about my side of the story.

I’ve gotten arrested and spent a few days in jail before. Like he said I really don’t know how people cope with being in there for 10-20 yrs or even a lifetime. The punitive system will beat you down permanently if you let it, even after you get out because your record will haunt you for the rest of your professional life. If there’s one thing I can tell my younger self it’s to not get arrested for anything

This is an infuriating story since this seems like something as a retail employess I would do and not even think twice about it, and threw some BS loophole a manager could ruin my life because of it.
You would be fine in 99% of cases because you have so much evidence that the product was paid for and not stolen. This guy got screwed over by anyone who could've instantly rectified it, including himself and his attorney.

There's a lot of factors that go into if you as an employee should accept that kind of treatment or not,, but in this current climate 90% of employers will not think twice about replacing you or even giving you a heads-up that they are going out of business
When I was in jail, I was in a cell block full of hispanic and middle eastern people, my cellmate and I were the only 'white' people in the whole block, but everyone was super nice and welcoming because we were all there together for whatever reason, taking in the same shitty scenario. I think they tend to segregate prisoners just to avoid racial conflict but that's the only thing I could think of

Dude I've been arrested for something and had video evidence proving my innocence, and blood tests that I was sober and still got charged with a DUI, because I got pulled over and had rolling papers. It's not because you're black or white, it's because you're broke and they know you can't afford to defend yourself so they basically rob you for everything your worth even if it's a couple thousand dollars.
I think I have PTSD about the selling of extended warranties. When he talked about selling that warranty to the older woman, even if it could have been a valid situation for it, I still feel that drop in my chest about it. I'm so sick of these companies pushing these warranties onto people and salespersons.
Also, this story was heartbreaking and so angering. My heart goes out to this kid because I feel that fear of your family being disappointed in you. AND how the justice system is so horribly flawed.

It's bad enough that the district manager probably knew what was going on but used the opportunity to get this guy arrested. What makes it worse is that he could have possibly gotten off the hook from this if his friend or/and the manager would have vouched for him and told them what really happened but his friend flaked out on him and the manager was afraid of the district manager.
25:33 The judge only had a charge of shoplifting a PS4 and your lawyer, while well meaning, didn't effectively argue the facts. Getting *one day* in jail compared to a year+ of house arrest, community service, or a license revoked has nothing to do with skin color. This kid absolutely didn't have to go through any of this. Calmly explaining the situation to a judge or lawyer or even the person above the district manager would have stopped this.

He could explain it easily, what happened and the misunderstanding, he could’ve had his friend come up and explain, in-store cameras, instilling reasonable doubt could’ve been sooo easy, he had a lawyer to work it! Aahhh I wish he at least tried to fight the charged 😭

In high school, I've heard some of the stories when people would work in GS, in short, also hearing what he went through.. I am glad GS never hired me.

Very familiar with the "Good Luck!" business ethic. Theyd give you a schedule five minutes before your shift but would turn down vacay and day off requests three months in advance. Somehow everyone else got vacay and days off routinely. Makes you think.

God going to jail is the weirdest experience ever. I remember some INTERESTING characters. At the end of the day it felt like I was in a room full of stupid mistakes lol. It felt like a camp full of idiots and everyone was bored as fuck.

Now I'm in Canada so take this what I'm about to say with a grain of salt. GameStop CAN be really fun and you can have a good team. I love my job and have been there for almost 4 years now. However unlike my district i hear alot of other district with shitty management that pull this crap, I CANNOT state this enough if you see employees being treated like shit call them out, take no BS and find a district that treats it's employees like people, or if you can't find that DO NOT SUPPORT THEM! These scumbags get away with this because no one speaks up.
