    Hi Greg - besides any local DC laws (and they are not a particularly easy group to deal with), I thought that ALL of DC and the surrounding area is under a petty much forever no-fly Zone.

    I recently entered the UAS / P107 world and began researching what the regulations are at the city, county, state level. (Not just FAA)
    Primarily to avoid legal concerns and the drama that would follow.
    As many are now learning from this channel, it's a very real concern for ALL UAS operators.

    Just watched the flycart testing videos and they were a blast, never knew it existed.
    A few translation notes you’ve missed is that one of the drones parachutes were manually turned off, and they used a third drone to lift the other two out of the fields.

    How many different satellites, websites, are currently orbiting with the ability equal to or better than recreational drones to real-time image some ones backyard and or anything at anytime for that matter?

    Ref the KY legislation, this is a tough one. I see a fly over much different then if someone hovers over private property. As an owner of a home with a pool and fenced “privacy panels” this happened to us last summer. Someone hovered a drone about 60ft directly over our pool while my wife and I I were chilling. They hovered without moving about 10 mins, you could see the camera pointed straight down at us, it was creepy. Now I ask any parent how they would feel if this happened to their 13yr old child. I do know the law and I have to say after a couple minutes it was hard to resist blowing it out of the sky.

    The KY bill have the EXACT same language at Florida Revised Statute 934.50. And it's unlikely they can get they can get this bill passed unless they can get remove the expectation of privacy laws. There are too many SCOTUS rulings that are opposite that.

      If I owned one of the houses in the (stock) video shown, I virtually could not fly in my own back yard, to any altitude above fence lines. As soon as I rise above that 6-8 feet, I can be considered 'surveilling' my neighbors? Crazy

    Good morning PilotInstitute, I have a question I thought, mostly Noone, except the FAA can regulate airspace. Isnt KY trying to regulate this airspace? Since they mentioned UAS, an aircraft system that's expected to be in airspace while doing "surveillance ". Thank you

As drone fliers, we all need to keep a direct and open line of communication with legislators who frame and pass laws in our particular jurisdictions. Much too come for sure!     If the FAA continues to allow all the local municipalities and states to enforce their own policies on the airspace it's going to become an impossible miss-mash of laws for anyone to navigate.

    Serious question: Have you found a drone privacy law that you believe does a good job of balancing the privacy of non-involved parties vs. the rights of recreational flyers/drone business operators? I like Texas Government Code Chapter 423, I just want to hear your opinion.

    Kentucky drone law is a tough one. If they don't enact it, drones could be used to shut down all the moonshine operations in the state. :)

      When I was flying hovercraft in KY, once in awhile we’d come up on a moonshiner. They always invited us to give their brew a try, and maybe sell us some if we liked it. Dangerous was running up on a weed growing operation. Not so much now, but back when the pot growers were well armed and dangerous.

    I think they really need to be careful when they define "reasonable expectation of privacy" because it may end up becoming a defense against prosecution for a couple who decides to have sex in their back yard. Also, does that mean everyone who has 2-story homes have to board up their windows? After all, they can see into their neighbor's back yards too.

    for KY HB 45 there's an exemption "to capture images necessary for the safe operation or navigation of an unmanned aircraft system that is being used for a purpose allowed under federal or Kentucky law" so being able to see through your FPV freestyle drone so you can actually operate it does not qualify as surveillance.

    Federal law does not trump state law. See the ninth and tenth Amendment, US Constitution. There has been no constitutional amendment establishing the FAA. The FAA operates outside of the Bill of Rights, and therefore has no constitutional authority over a US Citizen. Even though Kentucky passed their law, the law is still unconstitutional. Nobody has an expatiation of privacy while in public view. Anyone can take a photo of anything while in a public space, and, if you happen to be in that air space, too bad. Any air space “over” private property is fair game. It’s when one flies “through” private air space that a trespass can occur.

      Please take note of U.S. Constitution, art. vi, sec. 2, commonly called the supremacy clause. With that background, note that the Congress first established the Civil Aeronautics Board, and subsequently replaced it with the Federal Aviation Administration.

      @@Kiprhyn Sir, you err not understanding the law. Art 6, sec 2 is not controlling here. Pursuant to the 9th and 10th Amendments, US Constitution, the federal government cannot assume powers not specifically granted to it by the Constitution. There has never been a constitutional amendment establishing the FAA in the US, until that happens, the FAA has no constitutional authority over the actions of any private citizen. Congress cannot grant the FAA power, that Congress itself does not have under the US Constitution.

    My God, I pray that I somehow come to enough money or some kind of employment that I can play with these drones before I pass away I might have like 40 years left, but I mean for crying out loud. These are amazing I just wanna be part of the person that test them and test the parachute? How do I do that? How do I get into the drone industry? How do I get my foot in there? Is there specific Education? Yes I’m part one seven certified, but that only gets you so far that doesn’t really open doors for you besides collecting an income and the knowledge of course of knowing, when and where, and how you can fly.

    That DC person is a nut.... first that is not even remotely economical. Sure let's see how long they do that for... they will burn thru a bunch of drones and batteries. Second I would not want a drone flying overhead every day like that with no purpose other than to monitor the neighborhood. Just seems like a bad idea and I don't expect it to go very far

    The motivation behind the law is understandable. People have been concerned about police being able to use air assets to "observe" a neighborhood for some time. This extends it into the private sphere. The intent is not really that nefarious. The reality is that you can't do this without basically making drone flight illegal above 15 feet. So its a bad bill. If they did not attempt to redefine surveillance and privacy and simply state that "with the intent to gain knowledge of" etc rather than "casual, infrequent activity where observations can inadvertently be made" then it would be fine. Simply criminalizing direct, intentional surveillance of a person or property not owned by the drone operator or done with their written consent (such as a security application on ranch land or something) would not pose an issue of broad restrictions. Note that this also restricts aerial photography or videography, like podcasters and such, filming for their business, such as "a tour of downtown".

    I’m a private investigator and I don’t use my drone for any type of surveillance. I have used it for photographing an accident scene for a law suite. While I’d love to use it for infidelity cases, surveillance use just feels like it could get very litigious very quickly.

    Re KY drone bill: Since when does a state Trump the FAA? Hundred year old peeping-tom laws are all that is needed. Beyond that, how in the world would they enforce such a drone law? Part 107 covers it all. After a few years they will have to rescind their new drone law as unworkable.

      The Kentucky proposed law does not address intent to end use. Guidelines should be considered simular to the separation of use under Part 107 comercial or CFR 49 44809 recreational.

    "Kentucky is an open carry state. The Kentucky open carry law allows anyone 18 years of age or older to carry a firearm, meaning you can openly carry a gun in most places.... The Kentucky concealed carry law permits anyone over the age of 21 years to lawfully carry a concealed firearm. There is no requirement to obtain a Kentucky concealed carry permit." - Lexington KY area law firm
    So - you can carry a concealed gun for which you need no permit anywhere ... but, recreational drone pilots or visiting drone pilots cannot fly. Yep - sounds like Kentucky.

    RE: KY Bill. So if I'm on an airplane as a passenger, and coming in for a landing or taking off near a residential neighborhood (and we all know that they build close to airport arrival/departure corridors), and I video the approach and landing that identifies someone's property..... Never going to happen. The next step would be to allow people in public to say they don't want to be videoed! Let Google Earth handle this one because they do it all the time and they have the most funds to fight this.

    Regarding the DC biz, I think this would be a good idea only if a communities HOA backed the initiative. Otherwise, I think the operator is setting himself up for failure unless of course he scores a big win.

    Does the bill specifically target only drones? What about helicopters? They can hover and take photos as well.
    While I get what the author THINKS they are doing, this does not stop anything and is a slippery slope.

    The guy wanting to do surveillance is wanting to try it out in St. Louis (near me). I don't see how they can follow all of the drone laws while doing this, furthermore, the loiter time for most drones are not that much so it would have limited use in my opinion. It sounds like somebody is trying to make a news splash to advertise their company. I believe the guy is a music producer or something along those lines which further invalidates his credentials for this type of work.

    The KY proposed law is problematic. There is no Constitutional "Right to Privacy," so it may be deemed unconstitutional. And will certainly be subject to litigation. Also, there is an inherent conflict between the FAA's responsibility to regulate the use of our airspace, and KY's attempt to usurp that regulatory responsibility. Who is fighting the good fight here? Electronic Frontier Foundation, maybe? Someone else?

      I hate to sound all conspiracy crazy, but it is almost saying they need to stop 'pre-crimes'. Because someone 'can' do something illegal, they need to prevent people from ever getting into that position. This is very worrying. It almost feels like a state representative had a bad experience and wants to capitalize on their power.

      Its already happening with traffic cameras everywhere in cities and here and there out on the roads outside town. And In PA traffic camera video is kept for an undetermined amount of time that is not disclosed to the public. A state trooper told me its to assist with investigation when trying to track someone down who fled with a vehicle. They are now using AI to see if that license plate travels by. He told me its mostly on interstates and major state roads but is spreading out to the entire PennDott traffic network of cameras. Every vehicle that passes by the system camera logs the time and records the plate so in real time they can get an alert if a vehicle they are looking for has passed by. Welcome to 1984 Big Brother. I asked him if they need a warrant to access the data and he said no because you have no right to privacy in public. SO then a cop could use it to be a stalker basically...

      @@airshotsaviation6134 You have no implied privacy rights the moment you step out of your home. If you are in your home and the windows are open you have no implied privacy right their either. The only place you are remotely in private is in a bathroom or dressing room. But then we have seen instances where you are being watched their also.

    Google Maps aerial view comes to mind as well as Google Earth! Those satellites that are used have extremely fine resolution and could probably watch a woman sunbathing in their backyard! Are we going to ban Google products?

    Next camera police going after pictures and video from zoom cameras. There are some big zoom cameras that make drones look silly. In other words the drone laws are getting ridiculous.

    What makes this so ludicrous is I can take my plane and fly over this Kentucky bill sponsor’s house at the legal altitude with my camera telephoto lens take pictures of him and his guests. So to be fair, the FAA will have to outlaw this practice in airplanes too. Time to take them to court.

    I our state one has a reasonable expectation of privacy in their back yards. Unfortunately, kentucky will now have to have google blurr out the state if that law were to pass. Ultimately drone footage is free speech. Lets hope it fails.

    Right of privacy TRUMPS all! I can expect privacy if I put up a fence! If you put up a ladder to see over the fence into my yard to take photos you violate my rights. Same would be for drones. Aviation has to be 500ft above ground and they fly NORMALLY airport to airport, not house to house.

    The laws on using drones in Washington and Kentucky are likely unconstitutional. It is my understanding that the FAA has sole authority that was granted by Congress to regulate drones as unmanned aerial vehicles. Any state or local law would be superseded by the FAA regulations which have force of law in the United States and its overseas possessions like Guam. This is partly why I am so opposed to Remote ID as state local governments will and they may have already started to use it to track down drone pilots for harassment and prosecution. I think broadly speaking we are unlikely to see judges strike down these laws as unconstitutional at the local and state level. It will likely go all the way to the Supreme Court and that will take years as the consumer drone industry I seriously doubt has the lobbying clout to persuade Congress to step in to address this issue with an act of Congress and I don't see it as being a high priority case for SCOTUS to take up. If you are adding module for Remote ID I suggest you use a low power one to make it harder for your drone to be detected then if you have to deal with enforcement of police because its extremely unlikely you will ever run into a FAA official outside of a airport incident when flying a drone and even that is highly unlikely. I have never heard of FAA police force. When you then run into police you can show them you are properly registered and if required have FAA certification if flying for profit. You can also then show them the device is active on your droneby having a cell phone that can pick up the beacon it transmits. I think certain cell phones have the technical ability to do cell if they can receive that WiFi band, it may just need a app to be written. Now of course the police will accuse you of having it shut off during flight just as they likely will for people with Remote ID intergrated from the factory. I have talked to several Pennsylvania state troopers and they have virtually no clue that the FAA regulates drones to say nothing of the requirements. When informed if this and you try to show them many get hostile and make various claims about how they know the law. This is not targeted at PA troopers its just genral police mentailty in many cases sadly. The only way that local and state governments can reasonably restrict drones in a legal way is with land use zoning laws that control where and when drones can take off and land in their jurisdiction. A housing development may also be able to do this but not with a law but just by passig it as a "law" to live there. The solutions to this is to take off and land outside the jurisdiction but then you run into issues of credibly having line of sight/range. Range may be less of an issue if a small town passes such laws but in a larger city this could be a real problem outside the outer perimiter of its boundaries. BVOS operations and larger drones will help here but most people will be priced out of doing it in cities. Lets not forget who is really pushing these anti drone laws at the state and local level. he "Karens" of the world and big companies that want to use drones for deliveries. They don't want to share the sky with hobby drones even though its highly unlikely drone collisions if done properly would occur. Big Sky theory. Delivery drones should fly at a higher altitude when in cruise than hobby drones and lower than aircraft and with solid 360 degree collision avoidance but how good that would be at detecting and evading another drone is questionable at this point but the technology will just keep getting better. I see Remote ID being evolved to let drones detect each other GPS location and travel path to partner with AI guidance system to avoid each other. You don't need advancded AI just say adjust altitude by 30 feet to give plenty of spacing.
