For your information, when you are a Green Card holder, it means you are a Permanent Resident of the United States. It also means, that as a resident of the United States, you have to spend "majority" of your time in the U.S. Are you still considered a resident of the U.S. if you have been spending majority of your time outside the United States? The answer is NO! You "may" be able to get away staying out of the U.S. for 6 months or more a couple of times, but an Immigration Officer will have you on the microscope whenever you spent 6 months or more outside the United States. Once, you made it a "habit" of spending more time outside the U.S. than in the United States, that is when you lost your Permanent Resident Card. I know, because I had confiscated a couple of Green Cards when I was still working as an Immigration Officer!

one could always apply extension of stay (its a two years validity) to be safe. i did it when i continued my masters in the Philippines. during the time when i was still a green card holder. been here for 20 + years now. watching from Denver, Colorado

I'm married to a Filipina and incidentally a professional engineer. I'm not trying to be an immigration pundit here. Although I know for a fact that an individual holding a green card is by law allowed to live or travel outside America anytime as long as it is less than a year. Immigration officers who deny entry to a green holder don't know such a ruling.
more than 30 yrs na ako dito sa Hawaii I never change my citizenship as Filipino but legally permanent resident…I travel back to Philippines the only item I hold is my passport,permanent card and my state ID…..wala nang ibang papers na kailangan…the longest I stay there is 2 mons or 1 .5 mons….

My previous response did not go thru, so I'll try again. The first step, you should have it reported to the closest USCIS office, so they can put a lookout on the card. Meaning, when someone tries to use it at a Point of Entry, the Inspecting Officer will be notified that the presented green card was stolen/lost. 2nd, you need to fill up a Form I-90 to get yout Green Card replaced. All informations on how to replace your Green Card is on USCIS.GOV, including a step-by-step procedures on how to fill up your Form I-90.

My coworker traveled back in forth to Vietnam he left for 6 months, he came back and stayed for 3 months after that he left again and stayed out for 8 months he came back to US and stayed for 2 months then he went back again for a year. After returning bavk to US he was hold by immigration in NY airport as why he left and stayed short in US where he is supposed to be residence in US, he said he's mother sick, then died. He got granted and ask to be honest as he didn't mentioned anything in his documents, a year after he left again and stayed out for more than 8 months when he came back to LA airport he lost his green card as the immigration officer took his green cad and he was denied for entry, he got sent back to Vietnam for good.
@@ednanacar4330 Looks like your co-worker no longer meets the definition of Legal Permanent Resident (LPR). As an LPR you must spend more time in the United States than outside.
If you're dual citizen,usa and phil.citizen is there any problem if you stay in phils.more than 5years? And you did not visit usa for that grace period?

Best thing to do is to become an American Citizen first then you can travel freely and for as often and as long away as you want. 3 year wait for those married to US citizens and 5 for those who landed as immigrants.

@@maritaredwood4823 Let me clarify the travel history: (a) 2021 is for 5 months (Covid period) (b) 2023 is for 1 month and (c) 2024 will be for 7 months. Looking at the travel history, everything looks good with the exception of the 2024 travel, but I don't see it as a problem since it's just "one time" he exceeded the 6 months absence, but get ready to be questioned! WHEN you are making a habit of spending 6 months or more EVERY YEAR outside the U.S., that is when you attract scrutiny from an Immigration Officer. Every Immigration Officers were trained to determine if you are still a "valid" returning Legal Permanent Resident (LPR) when you present yourself at a U.S. Point of Entry. My advice for everyone is to limit their absence from the U.S. to no more than 6 months every time, for a "trouble-free" return to your country of residence!

Your Drivers License is "not" an entry document! All it does is to prove that you can drive legally in the United States. Your Green Card (I-551) is your entry document when entering the U.S. at a Point of Entry. You must present your Green Card, as well as your Philippine Passport so an Immigration Officer can stamp your arrival which acts as your proof of arrival in the country.

Your Social Security benefits has no bearing or effect no matter how long you are staying away from the United States. You can travel anywhere in the world or stay as long as you want. It will not affect your Social Security benefits. I am sure you have it direct deposited to your US bank account. As far as how long you can stay in the Philippines. That is up to the Philippine government. Better if you contact the Philippine Consulate closes to where you reside in the US.

@lilys5095 having an expired permanent resident card (green card) does not make you illegal in the United States. As a lawful permanent resident (LPR), your residency status does not expire, only the card itself does.
Do not. I repeat again! Do not travel out of the country (US) without a valid Permanent Resident Card. If you do, you are going to have some issues at the Point of Entry (land, sea or air) when you come back to the U.S. The Point of Entry has procedures to follow when returning with an expired Green Card. So most likely, you will be delayed with your entry, so if you are on a connecting flight, there is a possibility of missing that also.

I am a retired US Immigration Officer and I may be able to answer your question. Your son's temporary Green Card is as good as the actual Green Card. When your son immigrated to the U.S. and arrived at a Point of Entry (that could be land, sea or air) with his Immigrant Visa, he was processed by a U.S. Customs and Border Protection officer. After making sure that his documents are in order, he was then fingerprinted for the application of the actual Green Card. The officer then stamped his Immigrant Visa and that acts as his Temporary Green Card which is good for 1 year. That temp Green Card allows him to travel out of the country and return home to the U.S. without problem. Just make sure that the temp Green Card is valid and make sure to return to the U.S. before the expiration. If he try to return to the U.S with his expired temp Green Card, then he will have some issues!

As a U.S. Legal Permanent Resident (LPR), your Green Card allows you to travel in and out of the U.S. Your Conditional Status does "not restrict" you from traveling out of the U.S. and return home to the U.S. without any issues. Reason why you are on Conditional Status is because during the issuance of your Green Card, you were married to your husband for less than 3 years. Just make sure that your Green Card is valid whenever you travel out of the country and also return home to the U.S. before the expiration. Also remember, you will remain on the Conditional Status for the duration of your 1st Green Card. For the renewal of your Green Card, your husband must have the approval and certify that you two are still married at the time of renewal. I also recommend that you restrict your travel out of the U.S. to "no more than" 6 months every time. By the way, I am a retired U.S. Immigration Officer. We are the 1st one to inspect you upon arrival at airports, seaports or any Point of Entry!

LOL. The Point of Entry(POE) was where you had been inspected and admitted as a Legal Permanent Resident (LPR). That's all it is. You are not restricted to take your roots at the POE. When you are a Legal Permanent Residence (LPR) of the United States, that means "ANYWHERE" in the Continental United States, Alaska, Hawaii and its territories!

Your question is very confusing. I don't know what "permit" you are referring to. Your Permanent Resident Card allows you to travel out of the U.S. and return home to the U.S. without any problem. Being a Green Card holder means you are still a Philippine citizen and you must be in possession of a valid Philippine Passport to enter the Philippines. When arriving in the U.S., your Philippine Passport "cannot" help you enter the U.S. Your unexpired Green Card is what you need to enter the country, but you need to present your Philippine Passport so an Immigration Officer can put an entry stamp on it. Limit your absence from the U.S. to "no more than" 6 months to avoid scrutiny from U.S. Immigration officers.

Although I know for a fact that an individual holding a green card is by law allowed to live or travel outside America anytime as long as it is less than a year. Immigration officers who deny entry to a green holder don't know such a ruling.

My previous response did not go thru, so I'll try again. The first step, you should have it reported to the closest USCIS office, so they can put a lookout on the card. Meaning, when someone tries to use it at a Point of Entry, the Inspecting Officer will be notified that the presented green card was stolen/lost. 2nd, you need to fill up a Form I-90 to get yout Green Card replaced. My coworker traveled back in forth to Vietnam he left for 6 months, he came back and stayed for 3 months after that he left again and stayed out for 8 months he came back to US and stayed for 2 months then he went back again for a year. After returning bavk to US he was hold by immigration in NY airport as why he left and stayed short in US where he is supposed to be residence in US, he said he's mother sick, then died. He got granted and ask to be honest as he didn't mentioned anything in his documents, a year after he left again and stayed out for more than 8 months when he came back to LA airport he lost his green card as the immigration officer took his green cad and he was denied for entry, he got sent back to Vietnam for good.

@@maritaredwood4823 Let me clarify the travel history: (a) 2021 is for 5 months (Covid period) (b) 2023 is for 1 month and (c) 2024 will be for 7 months. Looking at the travel history, everything looks good with the exception of the 2024 travel, but I don't see it as a problem since it's just "one time" he exceeded the 6 months absence, but get ready to be questioned! WHEN you are making a habit of spending 6 months or more EVERY YEAR outside the U.S., that is when you attract scrutiny from an Immigration Officer. Every Immigration Officers were trained to determine if you are still a "valid" returning Legal Permanent Resident (LPR) when you present yourself at a U.S. Point of Entry. My advice for everyone is to limit their absence from the U.S. to no more than 6 months every time, for a "trouble-free" return to your country of residence!

Your Drivers License is "not" an entry document! All it does is to prove that you can drive legally in the United States. Your Green Card (I-551) is your entry document when entering the U.S. at a Point of Entry. You must present your Green Card, as well as your Philippine Passport so an Immigration Officer can stamp your arrival which acts as your proof of arrival in the country.

Your Social Security benefits has no bearing or effect no matter how long you are staying away from the United States. You can travel anywhere in the world or stay as long as you want. It will not affect your Social Security benefits. I am sure you have it direct deposited to your US bank account. As far as how long you can stay in the Philippines. That is up to the Philippine government. Better if you contact the Philippine Consulate closes to where you reside in the US.

@lilys5095 having an expired permanent resident card (green card) does not make you illegal in the United States. As a lawful permanent resident (LPR), your residency status does not expire, only the card itself does.
Do not. I repeat again! Do not travel out of the country (US) without a valid Permanent Resident Card. If you do, you are going to have some issues at the Point of Entry (land, sea or air) when you come back to the U.S. The Point of Entry has procedures to follow when returning with an expired Green Card. So most likely, you will be delayed with your entry, so if you are on a connecting flight, there is a possibility of missing that also.

I am a retired US Immigration Officer and I may be able to answer your question. Your son's temporary Green Card is as good as the actual Green Card. When your son immigrated to the U.S. and arrived at a Point of Entry (that could be land, sea or air) with his Immigrant Visa, he was processed by a U.S. Customs and Border Protection officer. After making sure that his documents are in order, he was then fingerprinted for the application of the actual Green Card. The officer then stamped his Immigrant Visa and that acts as his Temporary Green Card which is good for 1 year. That temp Green Card allows him to travel out of the country and return home to the U.S. without problem. Just make sure that the temp Green Card is valid and make sure to return to the U.S. before the expiration. If he try to return to the U.S with his expired temp Green Card, then he will have some issues!

Reason why you are on Conditional Status is because during the issuance of your Green Card, you were married to your husband for less than 3 years. Just make sure that your Green Card is valid whenever you travel out of the country and also return home to the U.S. before the expiration. Also remember, you will remain on the Conditional Status for the duration of your 1st Green Card. For the renewal of your Green Card, your husband must have the approval and certify that you two are still married at the time of renewal. I also recommend that you restrict your travel out of the U.S. to "no more than" 6 months every time. By the way, I am a retired U.S. Immigration Officer. We are the 1st one to inspect you upon arrival at airports, seaports or any Point of Entry!

LOL. The Point of Entry(POE) was where you had been inspected and admitted as a Legal Permanent Resident (LPR). That's all it is. You are not restricted to take your roots at the POE. When you are a Legal Permanent Residence (LPR) of the United States, that means "ANYWHERE" in the Continental United States, Alaska, Hawaii and its territories!

Your question is very confusing. I don't know what "permit" you are referring to. Your Permanent Resident Card allows you to travel out of the U.S. and return home to the U.S. without any problem. Being a Green Card holder means you are still a Philippine citizen and you must be in possession of a valid Philippine Passport to enter the Philippines. When arriving in the U.S., your Philippine Passport "cannot" help you enter the U.S. Your unexpired Green Card is what you need to enter the country, but you need to present your Philippine Passport so an Immigration Officer can put an entry stamp on it. Limit your absence from the U.S. to "no more than" 6 months to avoid scrutiny from U.S. Immigration officers.

I'd like to know how long will I stay in the philippines if I will go with my husband who has SRRV already I have a green card permanent resident here in USA for 18 years and I am already disabled I am already getting pension here for 2 years my husband is also disabled but we still want to come back here for a vacation if we will retire in Philippines or living for good, How long can I stay in the Philippines?

You cannot travel on an expired visa.
