      I've asked in a number of channel comment sections and yet to have this question answered. As former LEO maybe you can? Why do police officers handcuff you when they detain you? What gives them that right? I've never heard anyone ever mention any case law giving cops that right. In both PvM and TvO to remove one from a car and frisk them the cop must be in fear of a VIOLENT crime that happened, is happening or is going to happen, yet, like this case, because of the cops ego he admits he isn't fearful or worried about the suspect fleeing. So what gives him the right to handcuff this guy if he believes he's not dangerous or a flight risk?

This officer has a superiority complex and is a poor officer, he talks to people condescendingly and is just a prick. Listen to his language, he doesn't even know what cantankerous means because he is just the opposite. Ego problems are the biggest issue with police officers, they got beat up in high school and now want to push everyone around to show off their "power". We used to take care of guys like this very quickly because they cause riots.

      You should have been taught as a child to NEVER trust government, which of course includes the police. I am 65 years old, and understand the rampant propaganda relating to Law and Order, BUT have known since I was a young boy that the POLICy Enforcers don't exist to protect you and I. Since 1959 when I was born, there are hundreds of thousands, if not millions, of provable examples that exist that show what I just said is TRUE. It is The System, not just a "few bad apples."

      Police cannot detain or arrest you on your property without a warrant. As always, there are exceptions. Hot pursuit and exigency are exceptions. The officer can arrest the man driving the vehicle if he followed him onto the property and conducted a traffic stop. The officer cannot force ID or dictate movements of other people on the property who are not involved in the traffic stop. That is how I understand it.

      Good point. There has been discussion concerning the police lying to the public over misdemeanor or less charges destroying the trust between the public and the police.
      I personally believe only a detective investigating a felony should have the right to lie to the public. As it is any cop can make up a law and start demanding compliance, which results in a charge of interference, obstruction, failure to obey a lawful order, resisting... We all know the "go to charges" cops use to bully us.
      I like the idea of not being able to intrude on the property unless they are pursuing a felony. I think vehicle searches should also only be under a probable cause of a felony. Add that only detectives can lie in the investigation of a felony and we the people will be able to respect and trust law enforcement again.

      In his mind he is keeping the community and roads safe by enforcing the codes and policies of the State. Problem is that is all he is thinking and he cannot see through the guise to the motivation of generating revenue.     i can only speak from my knowledge and procedures from my department- a vehicle can not be towed from private property or from a legal parking space on public property unless it is evidence in a crime. This officer was simply being vindictive.

      The cops are impounding his car and they put it up for sale for 15K when it's worth 30K. After impound, we find this out.
      The driver has his corrective court paperwork 25 feet away.
      There was no cause to cuff the guy.
      He is at home.
      The cop car running it's lights while the cop checks the info and parked behind is plenty detainment already.
      You don't have to demonstrate arrest and say it's not arrest.
      There's something very wrong on that county.
      Besides, same state clin tons come from.
      That good citizen may have to sue and keep sueing and keep sueing from what this shows.
      What kind of investigation refuses to look at his court papers?
      No cop I ever saw would do this.
      Instead, they give you a court date and a ticket, for the moment.
      It's because the state computer is their God.
      So you show it to a judge.
      Hopefully the same judge.
      Every time you go somewhere, you look up your driver status of driving priveledge if there was a previous suspension.
      (For awhile you precheck)
      They have people who may get things out of sync and confusion results.
      Find out the number for DOL and talk to their specialists on the phone is the simple way in my state.
      That's Arkansas in the video.
      In my state, I had to go have a hearing by telephone, doing it from a lawyers office with a lawyer who specializes is a smart move.
      It's not cheap but it's way cheaper than this.
      The guy could go get the ticket thrown out by his same court. First. Then wait for computer to update, then go from there I would expect.
      The impound problem is part of this and may have a separate hearing request required. It would be wise to get that hearing date right away and correct the DWLS type ticket first.

    She is making sure the cop does not criminally plant incriminating evidence on her property. Never trust law enforcement. Any credible, professional law enforcement officer would just verbally tell him to take care of it and then drive away.

    This cop should be arrested for false imprisonment, deprivation of rights, and grand theft at a minimum. No other profession could get away with this sort of conduct or have such devastating effects on the people they interact with and get away with it.

      He handcuffed him because he's a coward who needs to assert power and authority over his prey - it's much more convenient to oppress the defenseless. It's also demonstrates he's terrified of his victim.
      Imagine the terror he would experience if he were doxxed and he had to deal with regular protests and demonstrations outside his house. Were he to pull his tough guy act he'd be subject to being sued personally - no qualified immunity.

    I caught this on lackluster already, but this cop was OUTRAGEOUS! That cop is literally insane and was doing everything he could to get to him and his wife for NO REASON. He put up a gofundme to get his car back that I had to donate to, cause this dude is SO chill the entire time.

      Remember a decade or so ago (maybe more) there was an ex military man who joined the police force, witnessed police brutality, reported it and got fired.
      The police then conducted a prolonged campaign of harassment and intimidation on him and his family.
      Now I don't condone his next actions, but he did what he was trained to do. He deleted terrorists, only this time they were domestic.
      His surname was Dorner I think. And obviously he was deleted by the police. About 200 of them at the same time, turning his cabin into Swiss cheese and setting fire to it with him inside.
      Tell me that's not terrorist acts conducted by an organised gang.

      Not the world, only USA. Here in Quebec (Canada). Police officers have to have a 3 years college degree where they gonna learn the laws they have to apply, plus 4 months on police school. You don't see Québec's officers on thoses channel.

      And the sad thing is they could easily look it up if they cared but they don't cuz they don't really care if the charges fit or not or will even if they are dismissed cuz they've already dished out the punishment they wanted to submit by arresting you and/or impounding your vehicle cuz even if the charges are dismissed or you are found not fully you are still out financially with the cost for bond and/or the impound and storage fees for your vehicle which go up $50+ per day and can't cause you to lose your vehicle. So you'll over them whether it's lawful or not or they will teach you a lesson and nothing will happen to them.

      When I was a teen I had a similar thing happen, but I just took the papers into court a week later and the judge was disgusted. Dropped everything and ordered the cops to get the car released without charge. Apparently I lived in a somewhat civil and legal town.

    OMG the cop walks around the property and begins a search of property including running plates. A fourth violation. Then he admits he is towing the vehicle to LOOK IN IT. Clearly another violation. IT just went up too 40 million in award with me on jury. and I would add 10 times the full value of the vehicle to the recovery for the theft.

    As a nurse at a correctional facility, I leave detention up to detention. When I have a medical event, however, they always want to be involved up to interfering with my medical judgment. They seem to be so quick to get butt hurt when people suggest they don't know their job, but they also like to get in the way when I'm evaluating and treating a patient. I had an instance with a stabbing victim and they wanted to move him for picutes, stand him up, pose him etc. The whole time I'm telling them not to move him because we don't see what's going on inside his body. When EMS showed up and ordered a helicopter, their tune changed to surprise. You see a punctured lung can happen spontaneously with a stab wound and then you're in deep doodoo.

    I called the green Briar police department. And they inform me that this officer is no longer with the department. She couldn't confirm that it was because of this event, but it sounded like it was thanks to everyone who put this out there. Go through this guy some money to get his truck.       That was making me angry, if paperwork doesn’t matter why do they ask for registration and proof of insurance, if all that is in their system already?
