      In his video description he claims he was armed and after he was handcuffed and put in the backseat, while clearing the gun the officer accidently fired a round in the parking lot. He said he was trying to get the body cams.

    Grabbed him because he swore at him again & now claiming it's for trespassing. Soliciting a trespass was what happened illegally. How do cops STILL not know what a public easement is? Huge Egos are what escalate 95% of these encounters.

    I've had my rights violated and severely abused by police in the past. I thank God for this channel and all first amendment auditors for their work. I'm still struggling with the aftermath, what happened to me should never happen to anyone else! Thank you to everyone fighting this fight.

      I feel you bud. About a decade ago I was confronted with a tyrant state policeman from Kentucky, while employed as a truck driver. If I knew then what I know now, the outcome would likely have been different. I would’ve filmed the encounter and not let him search my person or property. The incident did however motivate me to study the law and my rights. Hell, I might’ve been able to file a lawsuit and win. This was all before body cameras were the norm.

      It is illegal for a cop to solicit a trespass. Any trespass must be from the owner or a manger from that business first. For a first trespass notice from the above, that person being trespassed must have a chance to leave the property first. If the person does, then there is still no ID given to a cop.

      @@NotSureJoeBauers easements are not always public use. I have some property that has utility lines going across it. The utility company has access to its power lines and poles through that easement but just because there’s an easement there it doesn’t mean anyone who wants can walk through my property. It’s a utility easement. So, there’s nothing wrong with saying “public easement.”

    Totally agree with you James. Jack’s was just a pawn used by the police to take a couple of innocent auditors down. My guess is that this is not the first time these officers have interacted with auditors and have a general bad attitude about civilians who know their rights and will stand on them. I doubt seriously that any charges trumped up against these auditors will be prosecuted but at least a cop or two got their jollies for a day and will ultimately receive no consequences for their actions and will continue their illegal retaliatory behavior asap.

    Lack of training in law enforcement is stunning. For those who don't know a police officer cannot solicite a trespass from a land owner nor can they assume the position of plaintiff in a trespass. Totally illegal.

    I called the Jack’s and the GM said nobody had, except her, the authority to trespass someone and she didn’t trespass anyone. It’ll be interesting to see if they actually did gain trespass.

      @adam..You’re correct in most cases. Anyone who represent a property can give a trespass notice. In this it could be that it’s Jack’s policy that only the GM can trespass someone. That could be the GM stated that.

      I've never worked fast food, but I've worked countless small retail stores in lots like these. And I guarantee the workers didn't even know who, or what, they were talking about. Or cared for that matter, it could be the end of days, and all they would be focused on is getting through the days shift. Furthermore, if I were in their position, without knowing what I know now, I might assume I could get fired for "refusing to work with police". Or whatever they would turn this into. Cops are petty, vindictive, and have way too much free time. There are innumerous videos online of cops getting people fired for trivial things that had NOTHING to do with their work.

    All you have to do is listen man... NO all you have to do is have a basic comprehension of the laws you swore to uphold.
    These cops don't care, most police officers have the opposite of accountability, they have qualified immunity… No repercussions for unlawful arrests, for assault’s or crimes on citizens, years for investigations and often paid leave, promotions while they are being investigated after they commit their crimes! They have the thin blue line to investigate their crimes, police unions to protect them and pay for their lawyers, corrupt collusion by judges and lawyers. And even if they are found guilty there is usually no punishment and the tax payers pay the fines or settlements!

    The officers probably lied or threatened to the Jacks workers when they came in to solicit the trespass. I'm glad they had the balls to respond to you saying the person illegally arrested might have been on a public easement! "Stop letting the government pit us against each other"- well said. A few of the other youtube channels I watch say something similar in every video. We have so many problems in the world, but I think one of the biggest is the division gov has been sowing to keep us arguing and fighting with one another.

    I’m from Anniston. As soon as I saw he cussed near a cop I was like oh no. They aren’t nearly as smart as knowing that is legal redress. They will just make up laws. And say you broke em and beat you. Look at the history of this city. It’s disgusting especially during the civil rights movement

      1. Law Enforcement Officers cannot solicit a tresspass.
      2. The cameraman was standing on a public easement, not Jack's property. Jack's even admitted in the letter to @jamesfreeman that the cameraman wasn't on their property.
      3. Law Enforcement cannot "legally" tresspass you from public property unless you've committed a crime.
      4. Cameraman has freedom of speech. Disorderly conduct does not apply here. A Law Enforcement Officer cannot be the sole complainant in a DC charge. There has to be a victim and/or non-law Enforcement complainant. Learn the law and stop your bootlicking. Cops are not God's and if you arent breaking the law they have zero authority to tell you to do anything.

    I experienced a similar issue. I did not go along with the police. The 24 hr convenience store was black balled by the police. They never again responded to any call for service. They ignored calls for robbery, theft, assault, etc... They knowingly left every young minimum wage employee working alone vulnerable. The absolute thoughtless uncaring corruption is real. FTP ☠

    If I owned a business, I would have my employees trained if an officer steps into my business asking for a person to be trespassed for videoing. If they agreed with the officer, they would be fired without pay, and the employees' last check would go to the citizen who was arrested for videoing.

His power was the only thing that mattered to him.     As a restaurant manager, I have had police approach me with a solicited trespass. It was before I was more knowledgeable of the law. I was asked to give the police permission to trespass a guy who had an argument outside with police and I agreed because I was worried the police would start pulling over anyone they see leaving my restaurant. I don't blame employees who agree to these police requests.

      Solicitation criminalizes the act of requesting someone to engage in illegal conduct. See Black's Law Dictionary (6th ed. 1990). Alaska defines solicitation as acting “with the intent to cause another to engage in conduct constituting a crime, the person solicits [another] to engage in that conduct.” AS 11.31.
      The business manager didn't even know the guy was outside filming until the cop asked if management wanted him removed from the public easement. The signatory affidavit of truth, will be a false complaint, solicited by the cop... this is also a violation of Article 241, and 242, of Title 18 USC.
      He was falsely arrested and kidnapped either for his choice of words or or the ego of the cop, but he wasn't on the property of the food outlet.

    I think you nailed the position that the employee at Jack's took. The cop told them there was somebody trespassing, so they assumed the cop knew better than them and couldn't afford to risk offending the cop who they might need some day in an emergency.       It's against SOME police policies. Actually very few, if any. NO ONE has actually posted a copy of any police department policies, laws, case law NOTHING stating it is against Department policy or against the law to ask Property Owners if they want to have someone trespassed.
      Cops have a duty to ask the property owner what they would like the them to do in a situation. Sometimes that involves trespassing a person from the property. Even in this day and age, Property Owners may not know their options.

    Can we please properly train our peace officers? Also, can we hire peace officers please and stop hiring law enforcement officers? Lastly, can we hold our public servants accountable when they break the law? Maybe that should be first! Thanks James for what you do.     I'm from near Anniston and started my le career near there and yes these officers are truly this stupid. Mainly because their supervisors are more stupid and teach them this way. Corruption is rampant throughout Calhoun county.

    I'd be interested in the bodycam of the officer's conversation with the Jack's employees. These cops are dumb as hell and I hope Handicapped News files a big civil rights lawsuit.

    I could understand the fast food workers not knowing the law, but there's no excuse for police not knowing something as basic as public easements. Police should make sure they know the law before taking someone's freedom away. Sad thing is there will be no accountability for the officer. Qualified immunity needs to be abolished, that way departments will take the time to make sure that laws are being broke before locking up innocent citizens.

    I think your100% right on! If I was an employee at Jack, and didn’t know any better, I would’ve given the permission for the police as well, so we really can’t blame them!
    All of the blame goes on the COPS going to the restaurant to obtain permission to trespass this person and then permission to arrest!
    And, of course, Blatantly violating this man’s rights by arresting, this man ,illegally, because he is on a public easement!
    Just because there isn’t a “physical sidewalk”, Does NOT mean there ISN’T a “public easement” that is REQUIRED for Pedestrians/Cyclers to get into a business which is open to the public!

    As an Alabamamian, myself, I can confidently say that the only way this man will get any justice, whatsoever, will be if he can afford to appeal his case to a much higher court. Alabama courts are even dirtier than their law enforcement agencies.

    Jack's didn't do this, Officer Henry did this. Exactly. Workers at Jack's were making food and serving customers not asking for people on public property to be illegally trespassed. Hopefully they will honor their statement by standing up to this illegal police action they were drawn into.
