    I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. Like most people, I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
    Today I'm taking a break from teaching law students how to kick ass in law school. This one is just for fun.
    In this video I tackle some of the most famous courtroom scenes in Hollywood history including A Few Good Men, 12 Angry Men, The Dark Knight, and Erin Brockovich. Great dramas, but BAD lawyering. They are preposterous, but I still love watching them.

      One correction. It was Henry Fonda in 12 Angry Men. Henry was the father of Jane and Peter Fonda.

    My favorite thing about 12 angry Men is that, no matter whether or not it's legally sound or whatever, it managed to create an incredibly compelling drama that had me glued to the edge of my seat for like an hour and half, with nothing but 12 guys in a room having a debate. Excellent writing and cinematography and acting

      I like the characters to. How even the most stubborn people can eventually be convinced. Like the juror who has the octagonal glasses, I remember winston saying "What can you do against the lunatic who is smarter than yourself, who gives your arguments a fair hearing and persists in his lunacy", all you can do is keep giving them, and hope he listens, which luckily he did.

      If you can’t stand up in the middle of the court room, point your finger straight at the prosecution and yell “OBJECTION!” Then really what’s the point of being a lawyer?

    I wanna say that everyone should see 12 Angry Men, it is a fantastic movie, easily worth spending the time to watch it in it's entirety and maybe even a second watching to see the beautiful irony of each scene.

      No, there wasn't. De Niro wasn't in the 1997 remake. That one was a made for TV version with Jack Lemmon and George C Scott as Jurors 8 and 3, respectively. I think both versions are fantastic, and have their pros and cons.

      The Supreme court has ruled anyone can practice the law and no state can license it yet the BAR association (a lawyers union no different then a middle ages masons guild) has crafted legislation in direct contradiction with both Common law and the Constitution.

      Same. And also I'm from Finland. It's a different legal system as well. But alot of these rules and laws are still followed, since mostly they are just logical. Only sometimes I notice something that is really fundamentally different. Like indeed the duty to help when someone is in danger, and you clearly can help.

      I think he was trying to be sarcastic. I was thinking that he was serious my first briefing too, until I thought how in the world a gu could sneak a gun into court. The fact that this is representation of court in media must have been so obviously fake to him that he thought he didn't have to comment on it, just make a joke, but little did he know that we are so ignorant of actual court that some of us took it seriously. Lol

      Little known fact, he is actually blind so he has no idea about his jawline compared to superheroes.
      However, he seems to navigate somewhat poorly. He keeps falling down stairs and such. Always coming into court with black eyes, bruised knuckles, and various facial lacerations.

    Objection for A Few Good Men... It's military trial, not civilian trail. There are different standards, in some ways. First and foremost, guilty until proven innocent. I know from experience.

    I served as foreman on a criminal jury (here in Canada) and it completely changed my perspective on news reports of criminal trials - we tend to judge as outside of observers based on the likelihood that someone committed a crime, but when you need to positively confirm each required element of a crime it gets a lot more complicated. It was a very impactful and life changing experience.

    I am not a law school student and I don't know how I ended up getting this video recommended to me, but this was incredibly interesting. I definitely want to see more like these. In fact, an episode-by-episode review of Suits would be amazing.

    I was a reporter who covered the court system in Iowa, and I remember one of the admonitions the jurors were given was never visit any of the locations discussed at trial. To my knowledge, nobody ever did, but I keep thinking about the mistrial that would have caused if it were discovered jurors had gone to the scene of the incident.

      @@beno1996ac #1, it's trespassing. They can't be on someone's property without their permission. And #2, there's the potential that it could taint the scene. Also it's as if you're investigating the case yourself, which isn't fair to the defendant.

      @@amwfan88 Honestly, it's not really fair to either side, is it? Investigating for yourself circumvents the process of entering evidence and all the regulations put on evidence to try to keep the trial fair. the jury is only supposed to be a finder of facts (not finder of evidence)

      Harrison Ressler You can watch the H3H3 videos about their lawsuit to see how that goes when the content is being used properly under fair use. I would recommend the video where the first mention they’re being sued, I think it’s called “We’re being sued!” and then the video where they talk about winning their case, I forgot what that one was called but it was probably something like “We won!” In fact, in some, I’ve noticed it on at least one, of the videos on this channel you can see in the description box it’ll say that he’s using the copyrighted content under fair use and then he cites some rulings, including the H3H3 ruling. But I don’t know how familiar he is with copyright law specifically but it certainly would be interesting if he did ever have to go to court for a copyright case over a false claim of infringement. Though since he uses movie and tv clips in videos like these, I would imagine he would be up against some very expensive lawyers representing the companies who own the rights to the movies and shows.

      @@CrippledMerc none of them sue youtubers, they simply make a claim and automatically all revenue from that video belongs to them. Even if the youtuber wins the appeal (for which the "owners" of the copyright have 30 days to reply) the potential of the video is gone, since by that time it had most of the views. Then there are copyright strikes where if you get 3 of them they basically just delete your whole channel and you're gone...
      The real sad and shitty thing about this is that youtube doesn't even check if the claim is true in any way, there are many youtubers who got their videos demonetized simply by some random "studio" claiming they used 4-5 seconds of their music, even tho they don't hold any rights to it. In other words, youtube has a really shitty policy where they'll throw any content creator under the bus just so they won't have even a chance of having problems with the big boys...

    @4:01 in civilian court yes you can’t be responsible over another’s actions, but the chain of command in the military means non-commissioned subordinates under a commissions officer are solely responsible, which is why Jack Nicholson’s character is getting grilled so hard; he IS responsible for the actions and whereabouts of his men.

    My father and I were watching the OJ simpson trial live back in the day. He had 35 years as a prosecutor and criminal defense attorney experience at that point, simply said "Good attorneys (like OJs attorneys) go to court and get their client off. Great attorneys, make sure their client never goes to court on the first place".

      I'd assume you're permitted reasonable force. Just like self-defence anywhere else. If they punch you, and they're in the box, you'd be expected to just step back out of range, since they can't pursue you, and allow the Balif's and the like to deal with restraining them if necessary. If they somehow pulled a gun, you'd be permitted to punch them to get the gun off them.

    I'll admit, I was worried when I saw 'real lawyer reacts to fictional stuff', because tbh, the idea that fiction doesn't portray real life, especially legal systems, all that accurately isn't news. So part of me was just expecting somebody sitting there going 'no, no, no, no' for half an hour, but your Phoenix Wright video turned me around. You explain so many interesting things about legal... stuff, things I was ignorant of, that it's just fascinating to hear you hold forth on why something is inaccurate, and what would be a more accurate version, etc. Really great stuff, good clear presentation even for a layperson like me to take in.

      The one that hooked me was the Liar Liar reaction. I guess I found the concept of a lawyer reacting to a guy magically forced to tell the truth to be a funny juxtaposition. Told myself before it started I was only there for that specific segment, since I figured a lawyer was probably boring, but I stayed for the whole video, then I started watching his other reacts and subscribed.

In the movie's case it seems as though he wasn't supposed to own one, so I would bet it was illegal in that state rather than it just being barred from the court.

    I truly enjoy each and every video you do. The difference with this particular case is that it’s a military tribunal vs a regular trial. While there was much dramatization in this case it is important to recognize the differences. 12 Angry Men is my favorite movie of all time. The version you cover is much better that the 1990s version but it’s good too.

      You are exactly right. This past year I had a huge poster of this movie in my office, because the Brigadier General JAG Lawyer (he's been in the White House with several presidents and argued some of the most famous US military court cases) who was the technical legal advisor on this film had two of these posters, one in my office and one in his next to my office. As he shared with me he was on the set several months coaching all of the actors in how to conduct themselves and portray these scenes accurately.

    ok so military trial is not the same as civilian trial, unless you have done both, I would suggest attending one to see the differences. Again, this is a military court preceding with the Uniformed Code of Military Justice being the governing document. Asking if someone followed your orders, or in this case believed they followed the orders, is a common question in a Courts Martial. It shows whether or not Jack Nickleson is capable of command and also what sort of command climate he supports. Huge issues because as Tom is trying to pen him in to one of two scenarios; 1 - he is incompetent as a commander and his troops are acting on their own accord which no commander wants to admit and firmly places blame on next in command Kiefer Sutherland ; or 2 - you are the best commander, your orders are always followed, and he gave the order for the "code red" because no one would take orders into their own hands.

      During my time in the Navy at one command, I worked with JAG and was present in the courtroom numerous times. I also helped a several sailors out when they had to go to courts martial and gave them info that most of the JAG lawyers don't give to their clients. Most JAG treat the job like a fast food restaurant worker would. I have also been on the stand a few times as a witness.

    He brings up a good point in the "12 Angry Men", probably not meaning to do so. When the switchblade was introduced. "A good defense lawyer..." When 75% (US Court figures) of the population is reliant on a defense attorney overloaded beyond belief. How many times, would their lawyer saunter down to a local pawn shop to look for evidence?

      Switchblades were only recently illegal, and most extant blades would have been made legally in factories. An average defense lawyer would have pointed this out, and put the burden of proof on the prosecution to show that there were not thousands more in NYC.

I am a vet and I know that the two systems are different and that both operate differently through different laws and procedures. Could you do a video in the future of the difference and the similarities between theses two legal systems.

      This is an excellent point.
      I was going to comment on Mr (for lack of actual title) Stone's assessment regarding whether Colonel Jessup knew what was in Lieutenant Kendrick's mind when given the order. The thing about the military is that orders are expected to be obeyed without question (ESPECIALLY with the Marine Corps). It is ingrained in our training. To question an order is tantamount to saying "F you" to a judge, and to disobey an order is to say "I F'd your daughter" to a judge.
      So, when Jessup says Kendrick was clear ("crystal") on the order, that was the expectation. There is no room for questioning and disobeying.

      I was just about to bring this point up myself. Obeying an order is 100% expected of anyone in military service, and *not* obeying an order is a literal criminal offense as stated in the Uniform Code of Military Justice. What was happening in that scene wasn't to get the witness to speculate, but to establish that the Colonel had no reason to believe that his orders would be disobeyed.

    The whole thing with the epic scene between Cruise and Nicholson was that Colonel Jessop was, for all intents and purposes, gravely insulted by literally everything that Lieutenant Kaffee did, said, and represented. Sure, it's an overused trope in TV and movies where the "bad guy" loses it and admits his crime on the stand, but I think the writers and director did such a good job of actually setting up a plausible scenario for exactly that kind of rare event. Kaffee staked his life and career on being able to anger Jessop so much that he'd lose it like this. I could go on to unravel Jessop's seething hate of Kaffee (and lawyers, and the Navy, and anyone less macho than he is), but... well, the movie does that already. It's a central theme of the movie. Jessop did what he did because he hated Private Santiago for being so weak to begin with.
    Did Kaffee badger the witness? You bet your ass he did, and the court should have smacked him down for it. Would Jessop's seething hatred come to the surface like that anyway? Why not? He openly shows contempt for Kaffee at every single turn. All Kaffee really needed to do was test his patience enough and, well, exist as a prissy Navy lawyer who's never so much as won an argument, let alone any kind of real fight.
    And of course, it's a movie. Everything in it exists for drama's sake. They bend a few rules for that.

      As much as I love the Ace Attorney games, doing Phoenix Wright is a terrible idea. I read a lawyer that covered the first game after I finished it, and she mentioned repeatedly that the Japanese court system is very different and sometimes incomprehensible to a Western audience, so it's bad context.

      Debatable. I just watched the original and yes, the boy is -technically- a murderer.
      He was found guilty for juvenile murder at the age of 15 and served his time. But given that "the boy" is a young man of 19, his juvy records should be sealed an inadmissible...
      So I guess he is a non-murderer who murdered someone?

      but if there is a moment in the history of the couple where one party smacked the other on film or camera to theoretically kill an insect or as a joke. If that party is trying to downplay the incident as not indicative of abuse and that party tries to be honest they couldn't say that. or if it happened once in the previous week and never before that.

      @@lawtonaaj "beating" has a very particular connotation that is apparent to everyone. No one would interpret a playful smack on the arm or an accident caused in the course of killing a bug to be a "beating."

    Funny thing: here in Colombia, once the Prosecutor yelled to the witness and the judge, and... noting happened! Even though the judge has the power to arrest him. I think the judge, as an authority, doesn't make respect itself, is a national phenomenon :/

      he wasn't the prosecutor but the defense attorney. he was a public defender who was assigned the case through corruption. the whole trial was a shame trial to get the judge, his client, off a 1st degree rape charge.

      You're pretty much halfway there already, the most important thing is to yell "Objection!" at every opportunity even when your own witness answers truthfully or when the judge orders you to put your clothes back on and get down off his bench.

      Those experts are then almost completely ignored by the Director because reality gets in the way of their cinematic vision.

      I was at a lecture on evolution by a guest speaker at university that was open to all students and in the Q&A at the end a theology student did the whole "Darwin's Theory of Evolution is still only a theory though; noone's proved it in 150 years". The speaker casually walked over to the 4th floor window, opened it and said "Newton's Gravitational Theory is even older. Care to jump?"

      There are many great episodes in the series but lets start with season 1 episode 1. It would be nice if you could explain and analyse the character of Mike Ross and Harvey Specter and to what extent do they depict real life lawyers.

      It might be because the light from the setting causes his eyes to dry out more often, or he has a dry eye or tear ducts problem so he needs to blink more often to keep them wet

    I was wondering if you could do this for the tv series Bones. It’s primarily a crime procedural but there are two really good episodes with a heavy courtroom focus: 01x08 “The Girl in the Fridge” and 03x13 “The Verdict in the Story”.
    I don’t know how legally accurate they were but they were devoid of most of the theatrical flair Hollywood usually lends to courtroom drama scenes.
    The episodes are mostly self contained so you wouldn’t have to watch anything extra.

      thedexterbros Admittedly I’m not a lawyer but as far as I can see the Bones court scenes usually are greatly concerned with the validity of evidence, the presentation of that evidence and how each side interpretes the same evidence to support different arguments which as far as I’m aware is more or less the essence of what a court of law is meant to do. I don’t know if their presentation is in any way accurate but even if as you say it is wildly outlandish isn’t that kind of the point of this channel? A real lawyer reacting to how goofy tv law practises are? Bones being inaccurate as you say should be a mark for why he should do a video on it not why he should leave it alone.

      @@quinnsinclair7028 I'd love to see it too! Would drive him nuts. Can think of one unrealistic bones scenario off the top of my head-- there's a courtroom scene where the defense lawyer is cross-examining Angela and plays Angela a recording of Angela's own voice confessing to a murder to prove how easy it is to digitally alter someone's voice. It took the whole prosecution, Angela, and the FBI off guard. A: In reality that recording would have had to been presented in discovery as evidence SPECIFICALLY SO THAT IT DOESN'T TAKE ANYONE OFF GUARD DURING TRIAL and B: that type of evidence, if it can even be considered evidence, usually wouldn't be allowed to be introduced during a cross-examination. It's just one of many examples. There are several episodes wherer the whole case might be dismissed because Booth didn't read Miranda rights to the suspect he arrests. I'm actually a big fan of Bones but they do have a very low concern for procedural reality.

      thedexterbros I do remember that, it’s from the gravedigger trial right?
      Admittedly no tv show can do completely accurate court drama or it would be extremely boring but at least in the two I brought up I think they were reasonably accurate if only because those trials had a major focus on jury perception and and the interpretation of specific evidence rather than the usual flourishes that Hollywood uses to spice up courtroom scenes.
