She kept going "take me in", "arrest me" and even turned to her daughter and said "we're going to get arrested" to try and scare her enough to beg the officer not to go to jail. Being a single mom is tough, but patience is a virtue most of the time.

Update on the case, from what I could find, all charges against Michael Franchek were dismissed in 2022 and a lawsuit against the police department is still pending.
I believe she was overworked. She said she was a single mother, and it would be hard to work and take care of a kid alone. She was probably already exhausted and all she wanted to do was go home. And if she had been arrested her kid would not have her mom, which would have been even more traumatizing than what had already happened.

In this case they were informed that the man had a gun prier to him reaching for something (presumable a gun) inside his house. This was an obvious risk of police safety, as although it may be hard for someone like you to believe, there are many instances where cops have been shot and killed because the shooter reached for a gun quickly. It's better to arrest an innocent suspect then to risk having yourself and your partners be shot and killed because you didn't take immediate action. The kid was simply just in shock of the situation and didn't know any better.

The man was asked to step of the porch which is his property so the officer could just arrest him but instead I went back in and the officer stepped onto his property without permission when the officer had not said he was detaining him or at least that’s what I could gather from the limited footage of that moment alone and also I’m not really well versed in American laws especially since there are sometimes differences from states.
@@sobasically718 the thing is when someone calls 911 on you and the police actually decide to pursue that makes you a suspect, suspects get detained, whenever you’re in a situation where you’re talking to cops and something unlawful had occurred then you should just assume you’re detained at that point but you can always ask the officers as well, if they say you’re detained then you’re not free to leave, if you’re not detained then at that point you can leave. Usually though if an officer is giving you lawful commands that’s also a telltale sign you’re detained. Either way before running into his house the guy should’ve made sure he wasn’t detained because by fleeing into the house he turned a simple civil case into a potential barricaded suspect situation which are a lot worse.

This was an obvious risk of police safety, as although it may be hard for someone like you to believe, there are many instances where cops have been shot and killed because the shooter reached for a gun quickly. It's better to arrest an innocent suspect then to risk having yourself and your partners be shot and killed because you didn't take immediate action. The kid was simply just in shock of the situation and didn't know any better.

The kid at 8:47 isn’t really correct here, yeah you need a search warrant but not if the current suspect decides to try to run from detainment and take cover in their home… that’s immediate rights to go into said house and search for the fleeing suspect.
The man was asked to step of the porch which is his property so the officer could just arrest him but instead I went back in and the officer stepped onto his property without permission when the officer had not said he was detaining him or at least that’s what I could gather from the limited footage of that moment alone and also I’m not really well versed in American laws especially since there are sometimes differences from states.
@@sobasically718 the thing is when someone calls 911 on you and the police actually decide to pursue that makes you a suspect, suspects get detained, whenever you’re in a situation where you’re talking to cops and something unlawful had occurred then you should just assume you’re detained at that point but you can always ask the officers as well, if they say you’re detained then you’re not free to leave, if you’re not detained then at that point you can leave. Usually though if an officer is giving you lawful commands that’s also a telltale sign you’re detained. Either way before running into his house the guy should’ve made sure he wasn’t detained because by fleeing into the house he turned a simple civil case into a potential barricaded suspect situation which are a lot worse.
