Imperial Beach: Attempted Burglary & More 04042024

DETAILS:
A neighbor called the Sheriff’s and reported that a car was sitting outside a vacant home that is being worked on. A woman was in the driver’s seat, and a male got out of the vehicle and jumped the fence onto beach-front property.
Deputies arrived quickly, and the female attempted to drive away, but a Deputy blocked her path in the alley.
The man was then discovered and detained on the property. They were apparently there to try and steal copper wiring from the residence. A large piece of driftwood sticking out in the car’s trunk.
There were also pieces of driftwood in the street in front of the house.
There is a little-known State law that prohibits an individual from being in possession of more than 50 lbs of driftwood.
It’s unknown if they were charged with the driftwood law, but they were charged with attempted burglary and trespassing.

The driftwood law only applies if they are gathering it from a State Park, State Vehicular Recerational Area, or a State Trails System. I highly doubt they will get charged with that unless they admitted to getting it from one of these areas, and even then it would likely get dismissed. They more likely stole it from somebodies property, but who knows. (source California Code Section 4306 - Plants and Driftwood)
