Woman Arrested for Disorderly Conduct in Hoboken ShopRite Parking Lot

- Around 12:38 AM on May 19, 2024, officers with the Hoboken Police Department were dispatched to a report of a disturbance in the parking lot of the ShopRite on 900 Madison Street. They arrived on scene and observed a man and a woman arguing. One of the officers made contact with a 36-year-old female, who was identified as Delilah. She repeatedly ignored the officer’s instructions and attempted to leave the scene, so she was placed under arrest.
Delilah was handcuffed, searched, and escorted to the patrol car. The officers transported her to the Hoboken Police Department for further processing. At police HQ, she was searched in more detail by Officer Cynthia Rivera. She was charged with Obstructing Administration of Law under 2C:29-1 and Disorderly Conduct under 2C:33-2.

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. The next time I need to see a doctor and I have to wait months for an appointment I think I’ll just go out and get myself arrested. They officer medical assistance to EVERYONE. This woman was not hit, she wasn’t in a car accident, she didn’t fall and they didn’t have to tackle her and they still offered her medical assistance.

I'm pretty sure they were asking if she had any injuries from her boyfriend as they had been called because of a couple fighting. It's usual to ask if they need medical assistance when there is the possibility of domestic violence.

I guess it was too hard to tell the officers, in a voice set at a normal volume, that someone was harassing her. 🤷🏽 I guess you going to jail instead, still brings about the same outcome. You're no longer being harassed by the person.

I know this will be an unpopular comment, but the woman is smart and knows her rights, better then the cops do. You can't charge someone with disorderly for trying to walk away. The charge for that would be obstruction, which he ultimately charged her with. But I don't think any of the charges will stand up. The disorderly charge was just retaliatory for her lack of cooperation. The obstruction charge is weak too. I don't know how you can charge someone with obstruction who was just standing there with her hands behind her back demanding to be arrested. This was very bad police work. They just arrested the victim of harassment. She might have been setting them up for a lawsuit.

That was an unnecessary arrest. She was just telling a guy to leave her alone (and being loud). He wasn't arrested though, even though people saw him chasing after her. Waste of officers' time

Exactly, no jury or judge is going to convict a woman of Disorderly Conduct for yelling at a man who was harassing her and following her. That charge was just retaliation for her trying to walk away from the cop. The obstruction charge is weak too. The cops should have just let her walk away and detained the man for a few more minutes until she was out of sight. Then let him go too. The whole situation would have been resolved. They just wasted a lot of their time, and a lot of court time too.
