No, the Baby Huey robbery suspect will be thrown in jail, after he gets well enough from his wound. After they get a full story from the owner, he will be released. I will bet - no charges. I am sure the store owner was scared at Baby Huey's behavior.

@@ReloadedGlock We didn't see the entire video so we have no idea what happened before the guy started to violently smash the display case. He most likely used some type of lethal weapon. Most people who steal shoe polish don't threaten those around them with weapons.
Maybe you have a situation of a shoe polish thief and can share your story.
It is telling that the guy came back to the store after being shot. One could make an argument that the excessive force used by the store employee (the point you are making) wasn't excessive enough as the thief returned for more.

Here in Michigan, if a suspect is injured while commiting a criminal act, police will get the person to medical treatment, but the person is not arrested. If arrested while injured, any treatment, hospitalization, etc. becomes the expense of the municipality. Arrests are not made until the suspect is released from the hospital.

an argument 'might' be made that the shooting took place when the guy attempted to flee. not sure if he had any loot with him at that point which might make the shooting understandable, but regardless..crazy to arrest the shooter.
