It’s a start. California needs to repeal Prop 47,57, and AB 109. It won’t ever happen. But that’s what needs to be done to hold people accountable again.
Agreed. I strongly support it but we need something like prop 20. We need to treat trafficking of hard drugs a serous felony under three strikes, we need to increase the penalties for robbery and burglary (you can get life without parole for certain burglaries in Florida, South Carolina, Washington state and Virginia), they need to crack down on probation, parole and pre-trial release violations, and work to make the state friendly to places that still do hands on loss prevention in California (mainly Winco, Macy's and Nordstrum) so all police have to do when taking a shoplifter in custody is exchange cuffs with the LP and take the their to jail.

The argument from then Gov Brown, Gov Newsom and friends for cruel and unusual punishment started back in 2010 with prison overcrowding and the “lack of medical/mental health care.” This created AB109 and the beginning of the chaos we have today.

First of all ,these people get to steal about 2,000 dollars worth of stuff with nothing happening to them & its only when they get caught the 3rd time[if they get caught] that a felony comes into play! Gavin Newsome did NOT reduce the severity of crimes - the voters did by passing Prop 47. I’m going to vote for this proposition even though it costs $100K a year to keep someone in prison, and a felony conviction pretty much guarantees that a person will never get a real job afterwards.

The Supreme Court NEVER ruled that California incarcerated too many people and that it was cruel and unusual punishment (ie an 8th Amendment violation) but that California’s OVERCROWDED PRISONS were a violation. This was largely due to Governor Schwarzenegger (and his predecesors) refusal to expand prison beds in spite of California’s continually rapidly growing population. Instead Schwarzenegger focused on rehabilitation with tax dollars and tried to solve overcrowding by paying for space out of state which is an expensive short term solution. A federal judge ordered the release of thousands of inmates during Schwarzenegger’s terms. When Jerry Brown took over he continued this again with no prison expansion sure the Supreme Court would not find fault with the State’s system. Two years later the Supreme Court mandated a standard of overcrowding and ordered the release of inmates that exceeded that number. Newsome has since exploited this ruling, by releasing prisoners well in excess of the Supreme Court requirement and CLOSING PRISONS which thereafter limits space even more requiring even more releases. Though more recently he has touted this as a hige benefit because of the massive budget deficit the state now faces. So, prop 36 is a step in the right direction, but it will likely have little effect as the state cannot hold the prisoners which SHOULD be in prison. It will out Newsom in a bind as he will have to explain his actions.
It's the corrupt 9th circuit that is doing these rulings. Remember Boise v Martin being overturned? Your state needs an AG who will appeal until the supreme court overturns the corrupt 9th circuit.
