      Simple solution, don't buy property in an HOA. If enough people refuse to buy into HOA communities, the property values in those communities will drop from a lack of sales. This creates the issue HOA's claim to be there to avoid. It won't take long for the residents to start disbanding them.

      If you want the house more than the desire to avoid the HOA, then you don't have any reason to complain. You've made the choice to accept the HOA's terms and rules, and I respect that choice if it's right for you.
      When I bought my house I refused to even look at any listings with HOA's. Took a bit more time to find my home, but it is MY home. Still got a nice Cul-de-sac, still got nice neighbors. Nobody tells me what color I'm allowed to paint. Nobody tells me what I'm allowed to do in my own yard. Nobody stops me from washing or servicing my own car in my own driveway.
      Basically it's your choice. I won't give someone else jurisdiction over my property.
      In my humble opinion if I was willing to deal with an HOA I might as well just rent. You're just trading one landlord for another.

    Our HOA was dissolved after the half dozen lawyers who live in our community found it was costing far more for insurance alone than the HOA was worth, it’s been 15 years and no regrets.

      Also, the HOA keeps general areas pretty. Then soon your yard doesn’t suit a board member-for instance, you didn’t edge the curb side lawn. You get a letter telling you to remedy this. If you don’t, then you are fined. Now the HOA can place a lien on your home. You can’t sell til it’s paid. Legal Robbery

      @@LynRuiz I live in a 36 foot Travel Trailer in Florida. Nice park, large lots $305.00 yearly rate. My electric was $55.24 this month. This is what fits my budget.

      If you live in an area and can not afford to not live in a HoA move. I recommend the Midwest. HoA’s are thin on the ground here and prices for everything are lower.

      @@mariearmstrong1258 Nice...I did that except mobile for a year or so. Brand new 26ft toy hauler. Payment was only 158.00 a month. Had a Honda generator that used about 3.5 gallons every 3 days or so. Water and draining was 15.00 every 2 weeks or so. Did that near Redondo Beach area, well north of there. Fun times.

    Everything here is the HOA's fault. They did not get everyone to join but provided gate services to them anyway. Now, the new board is crying that its not fair. Then they tried to foreclose on a house they had no legal attachment to? How do these goons get into places of power?

    My parents lived in a retirement community with 950 homes on least land. There was also 31 homes that were not on leased land. When a out of state company bought the property, they began to double and triple the monthly rates. When my parents started to fight it, the company told them they would be banned from all the amenities in the community if they did not pay. My father research all the original documents and realized that the only entrance to the neighborhood was owned/controlled by the 31 home owners. They went back to the company and said if they did not back down, they would either close the entrance or begin charging every homeowner entering the property a fee to come in. The company quickly backed down.

      Its not the idea behind the HOA that is the problem, its the people in charge, it never fails that when you give little people a little power it goes to their heads and corrupts them.
      Therefore, no matter how good intentioned, the HOA system can never work.

    if you live in a community where there is no HOA before or after you move in and then one is set up. you are NOT part of that HOA and don't have to pay those HOA dues. If they start demanding that you pay, tell them outright. there wasn't an HOA when I moved in so you cant demand I make payments for something I didn't agree to. if they keep demanding, then take them to court. if they have your signature on any kind of paper saying you agree to the new HOA, that is forgery and a felony.

      you should. most communities like the 55+ ones are owned by a developer who bought the property from the original owner and decided to make it a community. its up to that developer then and there if they want to set up and HOA before anyone moves in to one of the properties. if not then its up to the homeowners to decide if they want to have an HOA or not. just setting one up and demanding people pay for something they didn't know about or want is illegal and can get the HOA sued if even one homeowner wants to pursue a court case.
      if it comes to filing a lawsuit against the HOA. DO NOT file it as a class action suit. a class action means that everyone involved with the case will get a piece of settlement. sounds good right? here is where it goes bad. I watched a video on here recently of a high school being raided by the police. the police illegally searched every student in the school. the police lost the case and were ordered to pay $3,000,000 to the 900 students of the school. still sounds good? well here is the math. $3 million divided by 900 equals $3,333.33 each. there is a good chance that, that money wont even be able to pay for their first car.
      and if it does come to filing a lawsuit and the HOA loses. make sure to keep track of the rent or HOA dues before and after the case because most HOAs will raise

      do you have an address for the clubhouse in that community? trying to google maps it to find it.
      you should probably look into getting a lawyer. was the tree there before she moved in? how big was it? is the branch in danger of falling? you don't have to answer these. these are just questions I am guessing a lawyer would ask you if you were to get one. does it say that it is for the tree? you might want to also look at some other videos on here of people fighting with their HOAs for stupid reasons.
      my name is my job but I have to know all sorts of laws because I am going onto private or public property to get what the person put as collateral for the loan they defaulted on.

    My HOA wants me to spend $6500 to paint the outside of my home . It doesn’t even need it but they said it doesn’t matter . There is a rule homes should be painted every five years . I have put my house on the market . I am moving 😡😡😡

    I lived in Nevada and had issues with the HOA. I got on the Board, two years ran for President then shut down the HOA. Took 28 notarized signatures but I got it done.

    Why someone would buy a house in a HOA is beyond me. I could not live in a place where I pay the mortgage, I pay the property taxes and a bunch of nosy jack lopes tell me what I can or cannot do in my property. NEVER I wold live in a cave before I would buy a shack in an HOA.

      @Fuktard Fagtroll That's not entirely accurate, frequently defunct or non-funded HOA houses are treated as not in an HOA when it's sold. This will show up for HOAs that are attached to single roads. in reality, the street owners don't care too much to enforce anything.

      @@welestgw The HOA covenants and restrictions are matters of public record in the Office of the Recorder of Deeds for every piece of property no matter what it is or where it is. They will appear in a title search or as an exception to title insurance. In Clark County, Nevada, the records are also searchable online. If you don't bother to do a title search or get title insurance or at least search the records yourself, you're beyond help.

    Why would anyone pay a mortgage, taxes and $200-400 plus a month to an HOA? I understand that in a gated community you might be paying for private security but beyond that HOAs have a bad track record over overreach.

      Depends what it covers. My HOA fees cover water, garbage, insurance on the building, landscaping, replacement of my roof, and more. Those services aren't free to provide.

    I used to be a gate guard there and my post orders were to man the guard house there I feel for the residents there the hoa there is a joke when I worked there residents complained that a back gate was not secured a basic fire dept entry gate which is supposed to be locked with a padlock was off its hinges I reported it on my paper work and nothing was ever done about it that was back in 2002

      That's not really how it works, HOAs are attached to the property. So it's independent of any owners or sales. Honestly you could buy a house, be lied to about it, and still be attached to the HOA afterwards.

    I would never live in a community that had an HOA, my ex brother in law did once, and he said they had someone drive around every night to make sure the outside light was lit/not burnt out, if it was burnt out, next day got a nasty letter saying to replace it immediately or face a fine. SMH

    What I like about this guy is that it's not about the money. He looks like he's got plenty of that. It's about being lied-to and cheated. I love that he took on the HOA and won. I wish everyone who has been mistreated and abused by an HOA had the resources needed to do the same. Sadly, lawyers aren't cheap.

      In Florida the HOA dues are commonly $300-500 a month. Or more. Our dues here in Las Vegas are $93 and that just pays for the landscaping, watering the plants, fixing the gates and managing everything. Paying $200 a month for all this AND with a security guard is actually a total bargain IF you want all that. And some do.

    my homeowners association is headed up by neighbor I had a run in with. he tries to park in front of my house all the time I pushed him off. now he's trying to get me to take my roof off I just put on he don't like it sad

    I am purposely avoiding buying property that has an HOA. It's a nice concept if you get a nice park, trails, tennis courts, pretty flowers or other amenities with it, but they have too much power and there's not enough regulations to protect homeowners. No HOAs for this girl

    Never ever ever ever would I buy a house that's part of an HOA, why would I spend all that money to have a group of random people tell me what I can and can't do with my property? If I buy a house and the land around it and want to paint my house lime green and put a hot pink fence around it I should be able to!     HoA’s are stupid, I was in one once. Never again. If I have my entire shop over for a party, then they can come. I don’t need busy bodies, or security, telling me I have too many vehicles in my driveway, and too many people in my house. The neighbors are complaining, yet one was in Afghanistan the other was at work over night in a hospital...

    Is his home legally part of the HOA? It's a simple yes or no question, no grey area or room for interpretation. If it's not then the HOA has no authority and is in no position to make any claim that he is in the wrong.

      BanthemOnCraftcadia love how the HOA board member (who happens to be the developer btw, that should not be legal due to the clear conflict of interest) says he plans to fight this. How may I ask does an HOA board pay for their legal fees? oh yeah, they don't, the residence pay for it with their dues and fines, so on top of the settlements p, this genius wants to sink more of other people's money into this. There needs to be a new law in place where residence are allowed to vote on whether or not an HOA board can proceed in a legal case where they stand to spend and lose HOA funds.

      Here's the latest that I found:
      "last month the case went to trial. As of June 29, 2017, a jury has reached a verdict in the case of Jonathan Friedrich vs. Rancho Bel Air POA Unit 2, Inc. and Performance CAM LLC.
      The jury decided that Rancho Bel Air made a “negligent misrepresentation” to Friedrich, by claiming that his home was included as a property in a homeowners association for Unit 2, when, in fact, Friedrich’s house is situated in Unit 1, where there is no HOA.
      The jury also awarded Friedrich 70% of assessments paid to Rancho Bel Air POA in the past, plus interest, court costs, and an additional $20,000 in punitive damages for its negligent misrepresentation...Hansen will be filing a motion for recovery of attorney fees on behalf of Friedrich. A post-trial hearing is likely."

    When I first got married .I took over my Brother in law s condo . Found out the deed was NOT transferrable cuz he still owed money on it. So what s the pay out ?. 18.000. O. K. I was living with them before I married his sister. And paying their tax. And Half the payment. When the HOA found out. The said they are NOT allowed to rent a room out to any one. Not even have family or future family live there. With out paying a fee. All these fees. Anyway I called my bank and said wire transfer the $18.000 to his bank. And it's paid off. And 2 years of HOA . After all we just married. No kids. Yet. HOA had a Fit ! They said we can't do that whith out a written agreement. Wow!. The HOA wanted all back fees paid first. My Brother in law said it's current. He had proof. Then they threaten. To take us all including his bank to Court . His bank. Said BRING it on. ! HOA Lost. Had to pay our lawyer fees ,Court. Fees. All that for over $18.000+ 4.000 for 2 yrs of HOA fees. So stupid ! Then ended up raising their fee to $400 to each Condo owner. To pay for their Mistake. Soon. There were 10 Condos up for sale. Cheap too! One sold for $10.000.my brother got it. Fixed up inside. And flipped it. For 40.000

    Specially this Homeowner mistakenly joined HOA. Never accept Any Solicitation from HOA. And always sue against them for cunning claims. Let them know their boundaries.

    As a former CA Escrow Officer, there are areas that can be "annexed" into the community association. One being Lake Mission Viejo. Once a property is annexed into the association, it is then forever a part of that particular association.

    So HOAs are terrible and should be outlawed. They also should NOT be asking people for money if they aren't part of it. Yeah, they live in a gated community but there is no security so the fence is just something to give the residents false security. People are just paying for a gardener to keep the flowers in the pots outfit alive which is not with $200 a month per home. BUT if there was a security force hired to watch the neighborhood, everyone should have to pay dues for that. It's not fair for half of them to pay and the other hand to get free security guards.

    I say that every good person should move out and let the bad people move in so that the Rancho Bel Air Homeowners Association realize their mistakes and do everything in their power to make things right. Either that or Rancho Bel Air should be shut down for good.

    The Rancho Bel Air HOA doesn't deserve to remain open and receive tenants. In fact, that HOA MUST let old tenants leave and turn any new tenants from going there. They must also be shut down for violating their own laws.

    I got the HOA's arguement that they are being guarded for free with no fines. But you don't just demand payment and lie to them. There has to be a compromise a smaller fee but no you lied and demanded money. You weren't even doing a good job guarding the homes!

      The developer knew that when they added the locked gate and guards so he should’ve put the gate between the 2 developments not around both of them when only 1 is a part of his HOA development
