Even when they won, if the person doesn't/can't pay it's very difficult to get the money. If they own property you can put a lien on their house, but that doesn't usually get you anything until the house gets sold (potentially many years later).
They're talking about a civil (counter-)lawsuit, which you can do at the same time as a trial or after. Nicole Brown Simpson's family sued OJ after the trial in civil court and won millions in dollars in damages. It ended up bankrupting OJ, which led to him selling stuff, and the rest is history. That's after a criminal lawsuit, in which the jury found the opposite. Point here being, it doesn't matter if claimant can pay the whole thing or not. Basically, if the guy who filed the claim is found to have wasted the court's time (note: BS lawsuits like this are why there's a two-year wait in the first place, judges do not take them happily), Ethan and Hila could reasonably sue him back for the expenses they incurred while they defend themselves. I'm pretty sure they'd have this option afterwards too, but language will probably be included in the final judgment regarding how viable any civil litigation would be. (So, the judge would say yea or nay on them being able to sue back. I assume; this is different depending on which state you're in, what court you're in, etc.)
The counterpoint is, if they lose the lawsuit, the countersuit could be used against them and they could be responsible for all the claimer's legal fees and expenses. That's probably why they're not, AFAIK.
Actually, this whole thing is AFAIK. I do hate being wrong though. Haha. Studied pre-law in college ten years ago. Go check out Leonard French if you want an actual lawyer breaking it down for ya.
Edit: Forgot to say, if Ethan and Hila filed the counterclaim, then the lawyers (and collection agencies) would call Bold Guy for the bills, not them. That would be the point of the countersuit, even if he couldn't pay it. It's "credit," but a little more legally binding (and harder to collect; like, if Bold Guy won, Hila would have all those paintings of Ethan evaluated as assets. Bleh.) Also, bigger companies/higher rollers usually let this go when suing a small UA-cam channel, because they know the other person doesn't have money, to buy themselves goodwill in court. "Look, we could stomp you into the ground, but we're so confident in our case that we're not going to. Aren't we nice? Now TAKE DOWN THIS VIDEOS AND SAY NICE THINGS ABOUT US! Haha.

I was falsely arrested and faced 55 years in prison for serious offenses by a corrupt local police force that dismissed two officers just a week or two ago (Mayfield, KY). I sat in jail for over two months even. The plea offer was 10 years, which means I could have paroled out in two years, but I'll burn this whole mf down before I tuck and cluck. I was scared and alone. It took right at two years to have my case dismissed. I was a month or so away from jury trial. During a hearing two cops lied on the stand. The judge (a good man imo), interrupted one cops testimony, and called him out on it. It was recorded, and you should see this shit. I got on the stand and politely called the cops liars and fascists in so many words, and these jerks wouldn't look me in the eye. It was severely traumatic for me - all of it. I have nothing left. I once owned a house and was surrounded by family and friends. Now, approaching 39 years of age, I live with my parents. I don't even have a car. I work way too hard for not enough pay, and sometimes I feel like nobody cares. While your case is a civil matter, your lives are at stake too. You are facing the realization that nothing you own or create is actually yours. It makes you question every spiritual and philosophical notion you've ever held as truth. This is a molestation of your essence. I feel like that, and you guys do too. I just want to say, I honestly know what those tears feel like, and the saltiness of their taste. Don't you dare compromise yourself by way of self censorship, apology, settlement, or other means. I know I'm not a coward. I know I will give my life before I compromise my humanity. You might end up at your mom's house too, and the internet nazis may rip your bread and butter away forever. The case is only going to fester, swell, and come back to sodomize you in the calm of night, but NEVER LET ANYONE DESTROY YOUR CHARACTER. Take the donations, but don't depend on anyone but yourself. People you love will walk away when you need them the most. Be prepared for that. Hell, be better than that. Big hugs to the both of you. You are not alone.

Dane Autismo I'm not positive, but I think in other countries, if someone sues the defendant and loses, they pay all of the other persons lawyer fees. That's why so many people get sued in the United States. You only have to pay for your own lawyer and it's a good way to waste the defendants money. You have to be pretty committed to spend 2 years in a legal battle and spend up to $100,000 over a UA-cam video.

I heard that in the US you can get a deal with a lawyer where they only get paid (by the adversary) if they win. So it's possible he didn't pay anything. Then on the other hand that didn't seem to be the case for them so maybe it only works of you are filing the lawsuit and not defendant or I'm just misinformed. Any americans around who can explain?

Upload a video so people can watch it. That was it. Now people get pissed over 2 seconds of video and sue for thousands of dollars. I miss the old days...

As much as this is wrong, I'm glad it's happening because this is a situation where we can finally have Fair Use be defended by a UA-camr. They also have tons of evidence and supporters so as long as the court isn't filled with idiots or bribed Judges UA-camrs might be able to live without the glooming cloud of copyright being abused over their heads.

All I can think of now is how both of these videos will have to be shown in a court room, most likely in their entirety, to a jury full of people who couldn't come up with a good enough excuse to get out of jury duty. They will have to sit there and watch the cringe master Bold Guy parkour after a girl in one of the rapiest videos on UA-cam. Then they will have to watch as Ethan explains over and over about his carrot in the ass and mayo in the mouth fetish. The jury will have to sit there and watch these videos and try to take them seriously enough to know that someone's livelihood hangs in the balance of their verdict. It would be fucking hilarious if it weren't so sad.
