      Sir, you assume a knowledge of the law is a presupposition to being a Police Officer. Judging by various audit videos I have seen, there are plenty of Officers who make up the law as they go along in the hope that the person they are talking to has zero legal knowledge.

      They've always done it to a degree bud but yes it's worse now. Although since the public have been filming and holding them accountable, we've noticed this huge pattern of unintelligent Policy Officers in the force.
      Also "in this day and age" Police superiors don't actually want constables who high a decent IQ. They simply want robots who won't question their orders and blindly go out and enforce ridiculous stautues/legislation.

      The Officer broke the law by detaining and failing to inform the offence under which he is detained, and the reason why he suspects he has or is about to commit that offence (PACE Section 24).
      Therefore, he committed false imprisonment which comes under kidnapping laws. The consequence is that the auditor receives 1,500 compensation, and the Officer receives a PAC mark on his record precluding him from progression within the force.

      Unfortunately they'll just jump to another section , 44 was taken off them, 43 probably will,or should be taken off them, however AB had section 1 of PACE thrown at him fairly recently, and sec 50 is becoming quite abused it seems. That's an insidious section, the theme is --- " you're acting ( supposedly) anti social, you must ID or be arrested."
      Aaaaand, section 5 is used as a threat too," you swore,you raised your voice, you're distressing people" (whilst doing lawful activity). Pitiful.

      He acted unlawfully by detaining without stating the offence or suspicion for the offence (PACE Section 24) which makes the detainment a false detainment, i.e., false imprisonment under kidnapping laws.
      If his superiors watch this video, they should have him arrested and charged for the crime of kidnapping.

    Clearly you need to know why he's stopped you to take him to court after, although to be fair even if he said section 43 is no more lawful than him just saying 'terrorism act'.

      If I may play devils advocate: the Police force does not like to recruit people who are on the upper end of the IQ curve, e.g., there have been cases where people have sued the Police for turning them down based on them being too intelligent. The Police prefer to recruit people with a high enough IQ to turn up every day in an ironed shirt, and spend 25 years handing out fixed penalties whilst believing they are Heroes protecting the public and keeping them safe.
      Therefore, one cannot be surprised when an Officer displays a lack of critical thinking and reasoning skills, as they are recruited because they are on the centre of the IQ curve.

    Collins v Wilcock: unless exercising a power of arrest, a Police Officer has no greater powers than a member of the public does to detain another person, and therefore anything that went above and beyond ordinarily accepted physical contact (eg tapping someone on the shoulder to get their attention) constituted unlawful assault and battery.
    Robert Gough LJ’s Judgment in Collins -v Wilcock concludes as follows (at 11.78D-H) -
    “If a Police Officer restrains a man, for example by gripping his arm or his shoulder, then his action will also be unlawful, unless he is lawfully exercising his power of arrest. A Police Officer has no power to require a man to answer him…accepting the lawful exercise of his power of arrest, the lawfulness of a Police Officer’s conduct is judged by the same criteria as are applied to the conduct of any ordinary citizen of this Country.”
    Most cases of such illegal ‘detention’ by Police Officers involve physical contact such as the case of Wood v DPP [2008] EWHC 1056 (Admin) which once again involved an Officer taking hold of a person by the arm in order to question, but not arrest them (even if the questioning was in order for the Officer to form a view as to whether or not the person should be arrested).

This has to go viral an officer decided to detain and not knowing the law and not only that he went to check it and still got in wrong. Also this was a stop and account which is an operational procedure and it does not give the officer any statutory powers.

    Fantastic work. You could see the point where it started to click for him that he was in the wrong and had no legitimate reason to detain you, but he still persisted even after backing off from "detaining you for a search". The fact that he then walked away shows once again that it was all completely unnecessary in terms of the law, and was just to satisfy his ego. What you do takes a lot of nerve and bravery. Another great audit.

    I'm seventy two years old and even I can remember what's in what pocket. The key is to just keep each item in the same pocket. I'll bet he's one of these people that puts the pots and pans in different places or uses the scissors and leaves them wherever he's used them so that everything has to be a 'search and find' routine every time.

    The interaction at 2:00 was exactly how we'd like the police to interact with law abiding members of the public. A wave. And friendly "How are you?" before proceeding with their business.
    8:30 He was to dim to remember that it's Section 43 that he's supposed to abuse to search you under the pretext of terrorism, when all he wants to do is to enforce his ego, to intimidate you and to identify you in his fishing expedition.
    All in all, that was very well done for asserting your rights to be told what law he was attempting to use to detain you.
    It's just as well that you were filming the interaction, to deter him from doing something really stupid.
    This interaction was one of thousands that's been published on UA-cam that shows that Section 43 should be scrapped.
    10:30 Technically he assaulted you when he moved to put hands on you. It's up to you if you and your legal team take action against him for this. I'd understand if you didn't. And I'd fully support you if you did.
    And good for you for continuing to film there after his intimidation.
    It's creepy, bordering on harassment, how he interacted with you 3 times.

      The law is the law. And this video shows clear evidence of an assault.

    No other responsible employer dealing with the public would have so many uneducated people on their staff. It's like telling the doctor you have searing pains in your heart and have lost the use of the left side of your body, and the doctor gives you a diagnosis of athletes foot. It wouldn't be tolerated. Yet in the police force it seems to be a condition of employment, that you have no knowledge of the law.

    This Audit by TP has really gone all the way to laying bare the ignorance, incompetence and the low, low level of the police service we are paying for. I put forward the view that this PC is a common example of that low standard which needs to be addressed and much, much sooner than later. No more front line duties for this incompetent, retire him to the backroom of the nick to count paper clips and other non essential items that the idiots up above may have to use. Also, consider that this incompetent could approach any member of the public who doesn't have an understanding of basic laws by which we live and that really is the majority of people in the country and they would be quaking with fear that a PC is detaining them under the Terrorism Law.
