    Good day, Atty Duka. If pumayag po ang empleyado sa deduction dahil po wala po silang choice baka mawalan ng trabaho, tapos after 2 years of deduction ay mag file ng reklamo ang empleyado, mahahabol po ba nya all deducted if wala po mailabas ang employer na dokumento that the employee agreed sa deduction in writting?
    I asked, kasi po ang 30 Seafarers were compelled to agree of deduction to pay tax abroad. May addendum pinapapirma ang agency dito sa pinas bago umalis ng written agreement na payag sila na bawasan for the payment of taxes. 2 years na po binabawas ang $370 kada buwan sa bawat Marino to pay taxes every month. Alam ko po wala po dapat taxes ang mga Marino working overseas.
    Pwede pa po ba nila mahabol deductions if wala mapresent principal in writting that they agreed sa deductions na yun?

    Atty. More than 10 years na po ako sa trabaho ko until now hindi pa din ako regular. . 6 years na po ako sa management position if it matters. . Need your advise. . Entitled po ba ako to be a regular employee? Thank you po. .

    Dean,under agency kami..pero natulog isa kasamahan sa kumpanya na pinapasukan namin at inatake namatay..may makuha ba sa agency at kumpanya na pera.thank dean

    Why not just amend the social legislative laws to give benefits regardless of employment duration ?
    I do not agree to your proposed revision of Art.296, businesses needs to have the capability to determine its employee deployment to meet its obligations and profit margin.
    Fixed term employment allows the opportunity for other qualified workers to replace tenured and already received compensation, and become also earners.
    The 2 choices you mention : "either accept the 4months job or no job at all " is false, because the opportunity to search jobs on other employers , our industry offers various job oppotunity.
    Please dont confuse the bar takers on this issue. Fixed term employment contract is constitutional since there was no explicit prohition provided.
    By allowing other workers to be employed when a fixed term contract expires for a hired employee, the protection of labor is equally secured.
    Security of tenure does not necessarily mean a forever employment but simply the right not to be terminated with cause even for a fixed term employment.
    No rocket science is required. Thanks for the opportunity to explain.

      the absence of a law that does not explicitly prohibit it does not make it constitutional. You should not also confuse people that simply you believe in it it is legal and constitutional. you are entitled to your belief but that does not mean that your belief is true. Address your concerns to congress. Amending Article 296 would not operate to prejudice management prerogative, it will just result in management exercising prudence in dismissing probationary employees. You should not confuse fixed term employment with contractual employees. I think you have never experienced working that is why you cannot appreciate the situation of the fixed term and contractual employees.
