    Sir tanong ko lang po. Work ko po ngayon is Delivery Sales rep. sa isang LPG company, pero kahit marketing field po kami wala kaming incentives. Tanong ko po, allowed po ba ang management na wala kaming sweldo pag si namin ma reach ang target quota? salamat po sa pag sagot God Bless more power

    Good day po tanong ko lang po sana as private school teacher kung meron po ba ako laban sa employer ng school kasi po nung time po na hinire nila ako wala po silang binigay na any criteria standard /evaluation checklist na kung saan don po nila ibabase kung na attain ko po ba ang standard nila para maging regular. May nabasa po kc ako na kapag wala daw pong any written doc criteria na ibinigay nung day na hinire nila ang isang employee consdered na daw po na regular employee siya tama po ba at applicable din po ba un sa aming mga private school teacher. Wala din po ako contract sir sa kanila salamat po

    atty....ask k lang po....anong pwde ereklamo sa employer kung pinag procees kn ng completong requirement ng hindi k naman na hire nila? salamat po.....

      wala sa labor code yan eh. kung naperwisyo ka at gumastos pwede ka magsampa ng kaso sa korte for damages need mo kumuha ng lawyer sa lugar mo para matulungan ka

    Sir tanong ko lang po. Paano po kapag inutusan ka past working hours pero walang pay yung service na ibibigay mo, kahit mag demand ka po ng OT pay. Will this be tagged as insubordination or willfull disobedience kapag nag decline ka or may karapatan po mag decline ung employee kasi wala naman pong OT pay. Thanks in advance sir and God bless po

    Sa mga Seaman po sana isama sa prov ng illegal recruitment ang paggamit sa kanila for construction works ng houses ng owner ng manning agencies. Iba ginagamit taga hatid sundo ng anak ng manning agency owners. May ilan pinagbabalot ng pulvoron na business ng may ari. wala sula sahod or allowance. Ang iba ay ginagawang utility sa mga opisina nila.....ALL FOR THR PROMISE TO BE DEPLOYED ONBOARD VESSELS.
    May ilan di ko po mailaban ng illegal recruitment kasi wala po ba talaga sa batas ang individual complaint? Kailangan po ba laging 2 or more persons?
    If individual lang ang violation or crime sana po ay makapagsampa sila ng illegal recruitment

      kahit iasang complainant lang illegal recruitment na yan. nasa batas yan labor code at RA 8042 RA 10022. Pag tatlo o mahigit pa economic sabotage na tawag dun

    Sir paki topic naman ng under ten employe tama po na hindi cla susunod sa batas yan kac ginagawa ng mga corp hinahati hati para hindi umubot ng ten para exempted cla

      kahit na ten employees lang dapat ang employer ay may exemption certificate galing sa DOLE para hindi sya obligado na magbigay ng mga labor standards benefits. idulog mo sa DOLE regional office yan

    I was a former president of a Labor Organization. I lobbied their problems both sa Senate and House of Rep even sa executive branch. May mga concerns lang po sna akong nais ilapit snyo lalo po, i was a member of the TWG ng isang magna carta sa Senado regarding labor. Maaari po kayo makausap ng personal at mapuntahan?

      @@CDDukaLaw paunang concern po sana. Respectfully rrquesting na mabalikan nyo po sana ang Compulsory Insurance Coverage ng mga Seafarers. Ang usapin po in case of death abroad, isa lang po ang mag aaply na insurance which is under the P&I Club or insurance. Ang Comp Ins Cov po ay hindi na makukuha ng Seafarer under the POEA contract. Kasi po whichever is higher lang daw pero not indicated in the contract or law ang mga katagang whichever is highet. Inilalaban ko po that the OFW should have both dahil yun ang nakasaad sa batas. If ayaw nila ibigay ang isa, they should bring the matter to remedial legislation para baguhin ang batas. May inquiry na po ako sa POEA and the response was they were delegated legislative powers.
      Ang tanong ko lang po dito, is there such a delegation of legislative power sa exec branch? I believe wala sila dapat to legislate. Gusto ko po sanang malaman kung tama ang direksyon na pinaniniwalaan ko which was brought into my attention ng isang labor lawyer.
      Halos 15 % of the death onboard ay dahil sa suicide. Wala po nakukuha na benepisyo ang mga namamatay dahil self inflicted death. Pag asa na lang nila itong CIC. Sna po ay mabalikan nyo po at matingnan.
      Maaari po ba makuha fb account ninyo? Maraming salamat po. I was one of the member ng TWG sa magna carta ng Seafarers. Sobrang halaga po ang maitutulong ninyo sa akin upang maisama sa batas ang mga issues na hindi napapansin ng mga mambabatas at gobyerno po natin. I have gathered almost 200 problems issues ng mga Marino for the past 6 years of consultations and talking to them.
      Hulog po kayo ng langit at napakaliwanag nyo pong magturo. Maraming maraming salamat po. Pagpalain pa kayo ng mahabang buhay.

      as provided ang overtime and other payments must be based on basic wage yun lang ang Art. 90 of the Labor Code

    Dean, in an establishment is it a requirement that there must be an employer-employee relation before a sexual harrashment prosper, because in our company there was a student trainee, whose no. of hours is a requirement for graduation, was sexually harrashed by the supervisor who supervise her work.

      no need. kasi considered na trainee sya so sexual harassment case can be filed. Pwede rin sa RA 11313 or safe spaces act
