    Sorry, I appreciate the primary content but "Ukraine Corner" is a worry. If, as I suspect, this is a US centric view of the politics around Ukraine I worry that whoever wins the US election will impose this view upon the rest of the world.
    Some points to note:
    - peace talks were ongoing since 2014 until Russia invaded in 2022.
    - Ukraine is constitutionally prohibited from holding elections during a war!
    - The current loans against frozen assets are a GOP notion.
    - Although war fatigue is an issue most Ukrainians know this is existential for them.
    - While the 7 month halt in USA support hurt Ukraine a significant effort by Europe and other contributors sustained and begun building more production capabilities replacing US support.
    Anyway, thank you for PEP and the Pepper community.

      Excellent points, I noticed this as well..... It might be just me, but the whole US-centric media reporting (of which not even PEP is immune) on the Ukranian war, from the beginning keeps devolving into this strange sort of butterfly effect mysticism where the US somehow controls the strings from afar, and totally ignores the actual intentions of putin and his delusional aspirations to wind the clock back to imperial russian times.

      Normally I appreciate that the podcast is well researched, but I definitely feel like the Ukraine sections seem to be much less so (and in some cases appear to buy into Russian talking points). Materially, it absolutely is possible to defeat Russia and push back to the 90/91 borders, the US + EU has circa 20x Russians GDP, the US on it's own has thousands of tanks and jets in storage, there are millions of 155mm rounds in SK which could be purchased and sent with US pressure and assistance, and the US could send additional Patriot batteries or allow Ukraine to target Russian AF bases with ATACM strikes outside of Crimes, amongst many other things. Russia has had over 500k casualties so far (with 1k a day on a continuing basis), is getting close to exhausting it's cold war stocks of vehicles. This sort of reporting in the west is at least part of the reason the war is still going on, if we want them to win (and I think we should) we should be sending equipment at least commensurate to what Russia is mobilizing, if not more.

      @@matthewpope5608 To be fair, it was pretty obviously Elle relating observations by a journalist friend of hers that has just returned from Ukraine. I don't think either Chas or Elle represented most of the Ukraine comments to be their own experience or research, more the 'feel of the place' 3rd hand.

    Watching the debate live I was squirming and closing my eyes during the bit where Biden's brain just fully shut down. I recorded it and sent it to all of my friends, some of them can't watch it all the way through because it's too embarrasing. It's actually hectic.

    To say joining the EU isn't a big deal for Putin is a very strange statement. I'll just take from wikipedia.
    "Since 2012, Ukraine and the EU had been negotiating a free trade and association agreement. In 2013, the Verkhovna Rada (Ukrainian parliament) overwhelmingly approved finalizing the agreement with the EU,[185] and Yanukovych urged parliament to adopt laws so that Ukraine would meet the EU's criteria and be able to sign the agreement in November 2013.[186]
    Russia, however, put pressure on Ukraine to reject the EU Association Agreement.[11] In August 2013, Russia began restricting Ukrainian imports, which Ukraine's opposition parties described as "a trade war" to pressure the country not to sign the agreement.[11] On 21 November, a week before the summit, Yanukovych suddenly announced he was pulling out of the agreement, and instead strengthening economic ties with Russia.[187. This sparked protests at Independence Square (Maidan Nezalezhnosti) in the center of Kyiv, which became known as 'Euromaidan'. The protesters, united under the Maidan People's Union, demanded Yanukovych fulfill his pledge to sign the Agreement or else resign."
    I would note 2014 is also the year Putin annexed crimea and invaded donbas, preventing the possibility of nato accession due to the existence of the unresolved border conflict.
    "In March 2014, following Ukraine's Revolution of Dignity, anti-revolution and pro-Russian protests began in Ukraine's Donetsk and Luhansk oblasts, collectively 'the Donbas'. These began as Russia invaded Crimea."
    I think elle's expectations about support, funding, treaty negotiations and the status of the war are a little reductive, but i'll leave it at that, because the EU point is rather important. I'll just say when it comes to loans, much reporting of G7 and EU funding says at least 50 bil does function from ukraine's perspective as grants, but I think Perun gave a good full run down of aid recently.

      From Russia's perspective the EU is run by nato, and in any case Macron wants to strengthen the third pillar (security and foreign policy) with an eu army (as unlikely as that is). It's not a reason to invade, but to putin's regime it's reflective of the eu being an economic arm of 'the collective west'. Nato being a security one. And I tend to think putin would consider his geoeconomics part and parcel of his geopolitics.

      I wouldn't take 'are we winning?' as a 1 -1 proxy of 'should we keep fighting? The territories negotiation polling fair enough. SUpport for biden vs trump in ukraine might be a good proxy indicator. I'm not sure any candidate could be the 'peace' candidate yet, given the unified line of the radna diplomatically had been, support us because peace now means war in europe later. Domestically, for the population that has lost anyone in the war already, it might be seen as taking their sacrifice for granted. Im not a ukr expert though.

    Hey Chas. Not sure what time you're going to record next EP, but what the heck is going on, I think we all thought that Biden would do well like as he did in the State of Union. Nonetheless, I think the Dems might actually be at an interesting opportunity to change candidates. In terms of logistically Kamala Harris obviously has the easiest path, but in terms of beating trump I honestly think Gavin Newsom has the best chance. For context my dad is a bit of a trumper and I can see that there is sadly some opportunity for trump to play to some racist and misogynistic elements in regards to Kamala, but when I consider Gavin I just see policy issue would probably be the main angle of attack which in my opinion is where trump is the weakest. I always think about it as a conversation with my dad, the only real 'cooked' attack i can see for Gavin is that he is the 'woke governor of cali'. Finally, will they even do this, the Dems got all the media at the moment (or in my little bubble) and changing candidate would in my opinion suck up a lot of media for the next ~4 months. What do you think about this, is this all just a cope? Are we just screwed?

    Dear Chas -- Unleashed -- and otherwise,
    Oh Chas, You mentioned on PEP today -- when I started writing this it really was "today", then I took a breather and never got back to what was really on my mind -- that you will be aiming to go into further detail on Supreme Court decisions. Will we not now do everything to stay with you?
    Where I am it is six o'clock, right now on Monday the first of July. But everybody, I implore you pray for your Slavic brothers and sisters . . . and get out there and scour the secondhand bookshops for the Penguin paperback Classics Plato's Laws. PEPers in Law dust off Bentham and get ready to HELP CHAS!
    In Sydney it is now well past 2AM, and I can only hope and pray all the more that you are getting a good night's sleep, every one of you over there down under and as ALL the young people in Ukraine discuss endlessly on their bulletin boards, down there with the maps of your country upside down . . . and really consider doing the work and not leaving it all to Chas; take real advantage of the holiday days that you have immediately before you but be aware that you need to be 'disinterested' in the very way that Goethe recommended and appreciated in himself. And if you don't know how to pronounce Goethe: PLEASE ask a friend.
    Let me explain. I really had been planning this last month to take the spirit equanimity to the extreme of its elasticity in respect of Trump's call for unlimited criminal immunity, and every and any sort of the stuff, and which is to say, to hope Judge Chutkan had not cancelled her overseas holiday for this month, and leave everything until August at the earliest. And in the meantime to look at things wholly from the other side of the boat, meaning to survey just the progress of civil cases -- you know, LEE and BLASSINGAME in the DC District Court; CARROLL I and CARROLL II in review in Federal Appeals Court in NY; and finally, the first level of review in the case Justice Engoron saw through at the trial court level in NY in State Court. And moreover, to just look at it all as if from Mr Donald J. Trump's point of view and believe wholly in it as if our own. Which means of course, to really believe in the principle of Immunity, Carte Blanche, before, during and after. And to believe we would do the same if our neck was on the line and we had the means and the nerve.
    But wait a second, and let me give you the summary on those four cases. There is absolutely nothing to it. No thinking required whatever. Does a cat have whiskers? When Mr Rawek is asleep in the next room and I bring out the sliced ham to make a toasty, is here not here with me before the Schinken hits the cheese? That is how fast you have got to be thinking. That fast. As fast as lightning. As if it really is nothing.
    Everything goes conventionally over there. Very civily, so to speak, just finding its feet, the first steps, essentially, through civil appeal as such. There is just one thing no one has really noticed. Namely that Trump had to pay the opportunity cost of having to PERFECT his appeal before the NY Supreme Court Appellate Division for their September Term. Look at the website. That means there are dealines for three pieces of written work between now and September 4. And be aware, in that Court, a term is one month long, not one year.
    That gives us just one thing the enemy has allowed us - and it's just worthless trash. And yes, team -- let's not beat around the bush. This is serious, and this is exactly how serious. Go back and read the National Times from before Pickering went out to Stud. And find out what it is really like to make a pogrom of everything north of you all the way back to the Red Tingle Forest. Then the Bast---s come in and take Greater Melbourne and three-quarters of your industrial capacity while you weren't looking. That's how serious. We have had it happen over this way at least a couple of times. In the Path of Thinking, equanimity is both a matter of life . . . and DEATH. And the Guardian at the Threshold must be met in all so many ways, and unexpectedly; and in not so well ordered a way as for all those other initiates, old and new. You must be able to think flexibly.
    So . . . apportion the work, do the reading . . . let Chas keep his nerve and the plan. As the call has come out before! Look to the Monument to the Time of Troubles in front of the old Church of the nativity of John the Baptist at Nizhny when the call came out from the church porch at the end of Rozhdestivenskaya Street just below where you can walk up and up and around and enter the Kremlin through a side door:
    Sell everything you have. Sell your wives. Sell CNN and MSNBC. Sell the New York Times and the Washington Post as so much waste paper! Put it all on the pile and with what that brings, buy the time to do the reading!
    And that reading is exactly the 119 pages of the pdf from the home page where enemy forces have gathered.
    Immediately, we need a stout squadron of volunteers to go without the slightest delay to the discussion of Fitzgerald at 12-15 as stated in the Syllabus at 4 para 1.
    And another to overlook the "guidance" the Court -- where the they are threatening to break through -- on "critical threshold issues in this case" as how to differentiate "between a President's official and unofficial actions, and know to do so with respect to the indictment's extensive and detailed allegations covering a broad range of conduct" at 16-32 from the Syllabus at 4 para 3.
    A regiment most urgently to the rear, to support Jackson out on her own at 98.
    With sections allocated to fill in ALL her ranks!
    Then to support Sotomajor and Kagan at 68.
    Only then to shadow the fat man. But better, Barrett at 61.
    The watchword is "presumptive" . . . presumptive immunity.
    Put on Shostakovich's Symphony No. 5 Op. 47 Allegro non troppo. Turn it up to 9.5, then to 10.
    And hold. HOLD!

    Technical request Chas - Is it perhaps possible to have a split screen when you have a zoom PEP - I really like and think it is helpful seeing both your faces as you interact with each other.

    Thanks for using the camera full screen (I've seen the auto-switching software in my corporate video chat and the timing feels very natural). The other idea is to do a 2-up camera but more zoomed in - it's all of a minute's work on Final Cut Pro (happy to make a short video tutorial if you like)

      I'd probably go the other way on this.. I don't like a massive face shoved right up in mine, it's a really bad youtube trend. I end up just minimizing the window and listening to the audio.

      @@backstreetsbackalright5754 I'll agree with that. I'd really prefer not see big black areas though. If the video is 16:9 then make it 16:9.
      I shouldn't underestimate the time Chas spends on editing these though! For me it'd be all of 2 minutes' work to fix the "normal" format into what I suggest. You'd use Compound Clips.

    Hey Chas. I just wanted to share my opinion on the possibility of Biden being forced out as the Democratic nominee. I strongly argue against replacing Biden, here’s why. In this scenario, you would create an open seat with the White House party. In the last 120 years, the party holding the White House has won only three presidential elections with an open seat. 1908, Taft vs Bryan, 1928, Hoover vs Smith, and 1988, HW Bush vs Dukkakis. Every other open seat presidential election, the challenging party won the presidency. LBJ as the incumbent president in 1968 dropped out of the race, created an open seat and the Democrats went on to lose the White House to Richard Nixon in a close election. Although right now it definitely doesn’t feel like it, Joe Biden, for all of his faults as a candidate, as the incumbent president, is the best choice going forward for the Democrats.       Point taken, but I just don't think historical trends really count for much anymore. Every week something happens that's unprecedented and previously unthinkable. Lessons from 2008 are no longer a good guide, so examples from 1968 or 1928 are nearly useless......even if they were near-identical parallels

      @@wagtag_ I just think if the Democrats were to replace Biden it would make them look weak and disorganised by not backing their incumbent president. If Biden drops out, there will be chaos in the competition for the nomination which will damage the replacement candidate, no matter who it is. Incumbency is a significant advantage in presidential elections, so is a party being united behind a candidate. 90 minutes should not determine the fate of a presidential candidate in a general election. Yes he had a very bad debate performance, but I think people online, in the media, and even Chas and Elle are overreacting. An open seat would be a political gift to the Republicans.

      @@Backpfeifengesicht789 It’s just too risky for the Dems to replace Biden, it wouldn’t matter who the replacement is whether it’s Newsom, Harris, or someone else. They can’t run an effective campaign 4 months from election day while scrambling at the convention showing the voters just how divided the party is. Mark my words, if they replace Biden, it’s almost a guaranteed loss, if they keep him, they still have a chance to win because incumbency shows stability and that is very important in a political party.

I can understand Dems feeling "if gonna lose anyway, let's make a change". Left learning have seemed to be more anti-Trump than pro-Biden (in polls), perhaps a change would help.

    One thing I have been wanting to say since it was first raised on PEP, regarding the Jamaal Bowman fire alarm incident, is that my interpretation of the footage is that he tried to open the door (he spent a few seconds pushing the door release mechanism down, his left leg is raised as he was body-weight leaning against the door anticipating it would open) and the sign that he took was merely leaning on the door release mechanism, as proved when he touches the left side mechanism and dislodges the other sign. Yes, after pulling the fire alarm he didn't try to open the door again, maybe thinking it was an auto release mechanism or realised when hearing the alarm what it was.. don't know about that part.

    Speaking of over-55s and AI: I noticed this 20 years ago when Olympics TV put lane numbers on the swimming pool etc. Some people never realised these weren't in real life, and it's an age thing. It must be wild to be them and watch TV commercials full of CGI.

      Hang on! I'm over 60 and AI is no stranger to me ... or my wife and many of our friends. Hell, I'm developing an Edge AI app right now (automation of camera data for a security system). I suspect there are just as many ignorant 20-somethings and 30-somethings as 50-somethings.

    There needs to be a Democrat debate with maximum 4 candidates then a national democrat 2nd primary date. Needs to be fully completed by end of July. Then endorsed in convention. Doing it this way eliminates the 2 months of campagining and in fighting. You cant campaign in every state for the same day of voting.

      I dunno, I feel like not embracing a truly open democratic process within the party has done nothing but hurt them so far. Can't help but feel like if they'd had proper primary debates Biden's performance might have triggered this crisis with a better opportunity to pivot.

    Chas, while my money is unfortunately slightly against Biden stepping down, for what it's worth I think the 2020 Democratic primaries are a much more likely analogy than 2016 for what an upcoming competition might look like. 2016 had just two very well defined and contrasted candidates (Clinton and Sanders), and few pundits or Dem voters were truly scared of Trump (the odds of him winning or the risk he would pose).
    In 2020 there were many relatively poorly defined/contrasted candidates (they loosely fell into categories of progressive and moderate, but these were blurry and flexible)......and there was agreement amongst all that Trump was the real threat, so they would strongly support their candidate-whomever it was.
    (I also struggle to picture the voter that would stan any potential Biden replacement (Newsome, Harris, Whitmer, Shapiro, etc) so fiercely that they'd refuse to support any of the others.)
    There's a risk that the lack of widespread awareness of how a contested convention works could undermine the perceived legitimacy of the winner, but I think party unity would survive come September.
    If it happened, hopefully the consensus building is as transparent and decentralised as possible, as the explicit party elders process Elle envisaged would reek of deep state conspiracy.
    Again for what it's worth, Sarah Longwell swears her focus groups say Black and women voters won't hate if Harris doesn't stick around. But while I quite like her personally, given how well she's been defined by the right (and, by osmosis, undecided voters) if she couldn't rapidly define herself I would hope she would also put country over ego, declare it should be a clean ticket, and back Whitmer, Warnock, etc.
    Edit: Politico is now reporting Jill Biden is encouraging him to stay in the race

    My attempt here is to provide what might appear at first glance a wholly contrarian view. Or more particularly, something that might be true, but can never apply. So why? When I have naturally and completely avoided such things every day of my life. It is like that style of Theological thinking so charcteristic and important in the latter part of that Age so close to our own. You block out of your mind absolutely everything of what you hold most dear. Well . . . it is not exactly that at all. It is something so quite completely different that I have no name for it at all.     And so to start. And with that we approach the necessity for at the very least Roberts and Kavanaugh to recuse themselves from anything associated with the legal advice sought individually by a President in Office.
    The Rule of Thumb here is to have been either providing opinions for the Office of the Legal Counsel to the President, or within the Office of Legal Counsel of the Department of Justice. But not by necessity to include Legal Counsel from other Departments, or within "the Lawyers", the interagency lawyers group.
    And therefore, Gorsuch comes also into clear view, and requires justified consideration. And needless to say, Kagan, also.
    Those who can recall even a little as part of their own living history will very likely say I am light years behind the game. But please, girls of the whippet, just ask your Mum: Whatever, just by way of example, does even the greatest PhD student on the Holomorphic Principle have as any idea at all that they have got their boundary conditions back to front? The answer is, no. And we should not absolutely need to read all 144,000 Gorsuch pages DOJ sent to Congress.
    And we are not dealing in structural nonsense. So . . . is Kagan? No maybe not.
    Therefore . . . Chas and Dave, do you understand the key "variable"? It is 'W', and his White House Counsel and the military context.
    The noteworthy exemplar is the NY Appellate Justice who recently recused because she had worked in the District Attorney's Office.
    And here is a question for Dave and Chas: Are the protocols from the Church Committee now optional?
    And for everyone: Are these Cum Laude Harvard and Yale children in long enough to know anything? Magna summa cum nothing go.

    Winner of that debate was RFK. A lot of progressives will be feeling out his views on other topics (apart from vaccines) and trying to get their head around him and vote for him. Maybe even some neutral conservatives too, if RFK runs a good tight economic ship and back to "core family values".
