Who Owns Leftover Shingles After A Roofing Job?

  • If there are shingles left over after the roofing job is complete, who owns those shingles? Does the homeowner own them and therefore they should be left at the house? Does the roofer own them and therefore he should take them at the end of the job?

    Glad to see this discussion. I'm a siding contractor in the Seattle area and I now only work for very upper end customers but in years past the question did come up as to a credit on the left over materials. What I've learned to tell those customers is this -"I bid the job so whether on not the materials were calculated correctly in my favor or yours a bid is a bid". If they persist I usually say 'had I run short of materials would you allow me to turn in receipts for additional material I brought out outside of the original package?"

    In my request for proposal I specify two extra bundles for any small repairs. That way there is no misunderstanding and it helps minimize matching problems if the shingle is discontinued.
    My last roof had Horizon non-organic shingles and I was so glad I kept extras.

      SUre, if you put out an RFP for "Roof replacement, plus 2 extra bundles of shingles" then yeah, a company giving you a bid on that, and taking the job, should leave you 2 extra bundles, because that was part of the job. Otherwise, no, if you get bids for a roof, and that's what the roofer provides you with, that's it, he provided you with the shingles to cover the roof, end of story.

    Great insight, but it's even simpler than that. The homeowner owns any leftover material (be it shingles or anything else) that they PAID for and was part of the contract. Any extra material that was purchased with the contractor's own money as a "just in case", will be taken back by the contractor. But if it was paid for, the homeowner legally owns it whether it gets installed on the roof or is leftover after the job. Any contractors that are taking away that material is literally stealing.

    I had a new roof lately. I am shocked that any roofer thinks they own leftover shingles PAID for by the homeowners. We had leftover shingles and were told we do not get a refund for them, BUT the roofer is keeping to use on other homes.
    We did an upgraded roof and paid out of pocket for more expensive shingles.
    Yet THEY own our shingles left over??
    I do not think legally that is acceptable. Going to look at contract to see if it was written that way.
    I've had roofs replaced before and was told they had leftovers, did we want them, since we paid for them?

      I agree that extra shingles should be purchased. The company we went with had a 17% extra waste amount. No problem, I'm glad there were enough shingles, but the extra should be the homeowners. There were 4 SQ left over plus 2 bundles of the cap. The roofing company said it was theirs because they bought 10% more waste on top of the 17% they charged us, therefore, any extra product on site was theirs. His logic for ordering that much extra roofing material was that the measurement of the roof might be off. I guess the satellite system they used to measure the roof could be off, or maybe they should use a tape measure? Ordering over a quarter of extra material seems like a scam to me.

      you're correct.if the your estimate stated so much material and you paid for the total amount of material whatever is left over is yours to keep.If he understimated the amount of material and needed to get another bundle or two then the onus is on him to pay for it.If you are in this trade or any other trade that uses estimating square feet for a final quote and you don't know how to do it ,then you shouldn't be in the trade.

    I am seeing many comments on both sides of the fence on this one. It really is even more simple than most are making it out to be. Most homeowners get bids from multiple companies. Once the homeowner agrees to the bid, they go into a "fixed price" contract" Simply put, the owner agrees to pay x dollars and the contractor agrees to put the roof on for that x amount.
    What the homeowner is buying is THE ROOF ON THE HOUSE. Unless the contract states that they are buying a certain amount of bundles, they are paying for whatever it takes to do the roof. Another example would be an electrician bids to wire a few outlets in your house at x amount of money. They typically show up with a van or truck full of rolls of wire, outlets and all sorts of other items. You don't expect them to give you all the rolls of wire in their truck! It is good practice for the contractor to leave a bundle or two with the owner. If you want a few extra left< tell the contractor that ahead of time. Communication is key. But don't expect a credit because he has leftover materials. It isn't yours and you did not pay for it. You paid for the shingles that are ON THE HOUSE. You can always do a per square price contract, but you will typically end up paying more.

  • @runningman3658
    @runningman3658 2 роки тому +6

    A guy below in the comments had a good point A lot of times when you order shingles you should order a rounded up estimate amount. A lot of times you can get the shingles and they'll be damaged Etc that you can't use them so if you don't order more it will cost time and money to have to go back and get more. You don't know what's in the shingle wrappers all the time. Sometimes they are defective or crushed by forklift or whatever. Sometimes a roofing company would use shingles that they have in the shop for starters and up the edges around the house so if you count that in then that's a lot of times that's why there's two square left or whatever. The leftover shingles doesn't always mean anything but if there's 10 square law for something I mean I can see the customer like "what's going on?" Lol we also leave the customers one or two bundles because of storm damage in the future and the shingle factory a lot of times will change the color slightly or discontinue it all together so it's best to leave a bundle or two there with the customer.

      As a homeowner, a good rule of thumb is to always keep extra leftover building materials. Whether carpet, tile, or roofing shingles. Because there will most likely come a day when you have to replace something due to damage. And colors, manufacturers, etc have been discontinued over time, and are no longer available. You will be glad you have extras!

      Let me ask you a question...
      I assume that since you're a painter that you also replace fascia wood as a service for your clients.
      Let's say you bid a job for a client that includes replacing all the fascia, 350Lf, for example. So you've built 35 10' boards into your bid, which your client is paying for.
      Now let's say that you buy 37 boards so you have some extra for "just-in-case" purposes. Maybe a board gets cut wrong or something else.
      Do you want your crew to have to drive back to Home Depot to buy another board? What a waste of time.
      So if the job finishes and the crew DID NOT use those 2 extra boards you bought, and which the client DID NOT pay for, are you going to return those to HD, or "gift" them to the homeowner because that's what you think is the "ethical" thing to do?
      Let me know.

    Just modified my pre-job checklist questions because of this video -
    Left over variable materials remain with customer, for any future repair issues. Or does Contractor refund home owner and they keep them (extra bought for “just in case” issues)? What if job took less shingles than needed per the estimated? Whole not opened bundles, part/opened bundles?
    Then you have to ask yourself, how do I know they didn't use all the shingles they told my roof needed, andI paid for: and they "pocket" some "extra" bundles I paid for thinking they are on my roof?
    Do I have to inventory/count all the materials when the contractor show up to do the job?
    Then there's -what if just buy the materials myself, and only pay roofing company for labor? If they need more, I go get more. Or, i bought more "just in case" materials to prevent workstoppage issues, and I can return unused material to the supplier for my own refund from the supplier! This way, I cut out the roofing contractor from being the "middle man" n the supply chain, and paying any of his jacked up 20% prices, eh!
    Lowes has the Owens Corning Green colour Duration shingle I want, and I get a 10% military discount (retired US Army "Green Beret" A-Team Medic, and a Warrant Officer Helicopter Pilot), so for me this part is easy - just order what the contractor says is needed plus "extra" in case materials, after jobis done I can take them back (within 90-days of purchase), and LOWES will deliver the materials to my house.
    Why not Home Depot? Because, they have a $400 per year maximum military discount limit (for purchasing up to $4,000 of stuff), and the new ZERO-TURN lawn mower I purchased back in May 2022 wiped that out...only reason until 2023 for me to take the Lowes "BIG BOX" Store option! I'll have to check of LOWES has a military discount limit too? If not, maybe a good reason to spend over $4,000 with them for roofing materials, and get the full benefit of 10% off, eh! Go too two wars, get shot at, get discounts - my Recruiter never told me 'bout that one!

If you audited every single material or labor line item you will find things such as steel valley metal, synthetic felt, roofing nails, landfill ton weight, etcetera that could have been shorted. Therefore they need the extra shingles left over to cover other material and labor items that could have been shorted as what's the point to credit the homeowner for the extra shingles and then charge for 15 more feet of steel valley metal with ice and water barrier plus a 1/3 of a ton extra of landfill debris?

      Exactly!
      So if I've paid for extra shingles to have on hand in case the crew needs them, then after the job, I'm taking them. Thank you for supporting the point I was making in this video.

    Ehhh... the homeowner pays for all those shingles. The roofer is going to allow enough "waste" so that he isn't caught short and eats the cost of more shingles. If he was short, he would likely charge the homeowner. After all, he only gave an "estimate," not a hard BID. He will ALWAYS estimate plenty extra so that won't happen. The homeowner pays for all shingles to cover the deck AND the waste AND the "insurance" extra. When the roofer has extra (he will) and they go back to the supplier, he pockets the refund. That's what happens. That's not what SHOULD happen. If the roofer gave a BID (meaning he's obligated to finish the job for the specified amount regardless) then sure, he keeps the extra. When he's working off an "ESTIMATE", the homeowner must get a refund, or he's been cheated. Does Homestead Roofing BID jobs or ESTIMATE jobs?

    • @homesteadroofing
      @homesteadroofing  3 місяці тому

      I can't figure out why this is challenging.
      If a roofer bids a job at 20 squares (60 bundles) and charges the homeowner for that, but he brings 62 bundles with him to the job for just-in-case purposes, and he's left with 2 bundles at the end of the job, then the roofer owns those shingles. It really isn't that difficult.

    • @slydog7131
      @slydog7131 3 місяці тому

      @@homesteadroofing You are right, if it was a BID rather than an ESTIMATE. If the job was bid, then the contractor is obligated to complete the job to spec for the price that was bid. If the job was an estimate, then the final price can vary depending on the time and materials that were actually required. In the bid job the contractor owns all excess materials. In the estimate job the homeowner is paying for all materials, and in that case excess materials are returned to the supplier for a refund and the final price is adjusted or left with the homeowner. It really comes down to the difference between a BID job and an ESTIMATE job. Contractors working with developers on new builds often do bid work, but on re-roofs they do estimate work. An estimate job should not be treated like a bid job, though that's what typically happens.

    How should the extra bundles of shingles be stored long term? Our contractor retained two bundles in event roof would sustain damage from surround trees on property. Can these be stored in the attic or should they be placed in cool dry location such as basement/craw space to prevent activation of adhesive strip?

    • @homesteadroofing
      @homesteadroofing  2 роки тому +4

      Great question!
      Yes, a cool, dry place would be best. If it's somewhere that would build up heat, like a shed or garage, the seal strips will seal together and they won't install correctly.

      this guy does nothing but baby talk,his answers are always"it depends",or "just in case"blah blah.the owner paid for what was on the quote he should keep the extra material ,if it a ridiculous amount like ten bundles then the estimator needs to find a new job and refund the extra to the owner.

    Poor video. It's not complicated. If you charged the customer for a certain amount of shingles material
    to do the job then what whatever is left over belongs to the customer.

    • @homesteadroofing
      @homesteadroofing  2 роки тому

      Wrong. If you charge a homeowner for the amount of shingles that go on the roof, and you over-order to prevent yourself from having to run for materials during the job, then anything left over is the property of the contractor. Most contractors will have that specified in their contracts.

      There's too many factors that go into play when it comes to shingles being left over. It depends, some businesses are like this that is my price and leave it at that others will use their own shingles first then you used the ones newly bought so it's too many factors in there to say the customer should get the shingles to say they should get money back. But I understand the customer's view.
