      I was wondering that too. But I think it's part of the strategy. They like to pitt suspects against each other to get the truth. No honour amongst thieves etc.

      iplayabari 8675 the tax payers have too pay more out of their pockets for inmates. So just giving a vicious murderer life is at the expense of honest, hard working non-murderers vs giving them capitol punishment.

      It actually costs MORE to execute (normally) than to keep a person in prison for life. Death row costs, extra legalities and appeals, etc. end up costing MILLIONS.

      too the people saying it’s about tax payers money: there are more than 2500+ inmates on death row in the US & in the whole of 2017, 23 inmates were executed.
      Therefore, prisoners have a much higher chance of living out their life & dying from other causes whilst being held in prison.
      The amount of money spent on monitoring/staffing/needs for death row prisoners is surely more than if they were in general pop & didn’t need constant 1 on 1 surveillance and lockdown? not even including the legal cost to actually execute them

      Innocent until proven guilty, you cannot assume someone killed someone just to fulfill your desire for closure, cases have to be built and evidence and psychologists need to evaluate people. Some people lose their entire lives being in prison when they've been falsely accused and it's discovered after their death, how is that justice?

    You could see why Mosley was detached, he'd only known the victim for 24 hours. At least he took responsibility for his actions, heinous though they were. Myers was his childhood friend yet expressed no emotion whatsoever throughout. He was obviously the mastermind and had his friend murdered. I've never seen anyone more deserving of the death penalty for what he planned for poor Justin. Horrible way to die for a fine, upstanding young man. Hope Myers gets despatched soon.

      I live very near to where this happened and talked to some deputy sheriffs who worked on the case. They all said that Austin Myers is the devil in the felsh. I am not sure if they showed it in the documentry, but the deputy talked about how Austin watched the color in Justin's face change as he held Justin's head in his hands. He described this is great detail and watched the life drain out of Justin. He talked about his eyes seemed to change and he could see his life leaving him. Austin is an evil, evil man.

      Nick Tracy Jeffrey Dahmer, Edmund Kemper, The Zodiac Killer, Jack the Ripper, Dennis Raider aka. BTK, John Wayne Gacy, etc. Ted Bundy is nowhere near the worst.

    I’m not going to act like I knew who did what, but there was something very off about the first kid. His tone of voice was very low, he had trouble with eye contact and he started scratching himself while he was telling his story.

      The first one has a history of family violence from his father.. Maybe it was just school rumors.. But there was a lot done to him as a child. And the other has always had a speech impediment, he went to classes for it as a kid

      You don’t know that. Tim lied at first then heard Austin through the walls, (no accident I’m sure). Tim decides he’ll give a different story and now claimed it was Austin.Tim makes ‘the deal’ to save his own skin. The murder was planned.

    This happened down the road from a friend of mine. She knew the family. They still live in the home. This is such a heartbreaking situation. Every time I go to visit my friend. I think of Justin. Cringing, thinking the killers took the same road I did. A kid with his whole life ahead of him. To be murdered by a friend, for nothing. God Bless the family. It’s been 8 years now. And the memory of Justin, is still on the hearts of everyone in that town.

    It's so sad that Justin Back had to face his executioners, and thought they were his friends. He must have been so confused as to why they were killing him. Austin Myers will know that his executioner isn't his friend and he will know exactly why he's being killed.

      They were both facing death but with Austin denying his role in the murder he could potentially walk free with Timothy admitting his part in the murder so by offering him a plea deal they can nail Austin.

    Neither of them have any remorse. The Austen kid said at the trial when he took the stand “Please don’t give me the death penalty. You will only hurt another innocent family again.”

    The model with the two prisoners & probability is very accurate. When a lengthy prison sentence is on the horizon, the outcome is easy to predict when you set up the stage properly. The officers knew the thin wall was the perfect stage.

    For you guys who think it was stupid for the cops to put them in side-by-side rooms with no soundproof barrier, this is how you exploit the "willing to testify" suspect to hopefully pin them both with conflicting testimonies. LOL

    This honestly is not fair at all. The one who actually killed the victim gets a life sentence and the other one who was basically adding to the trouble gets a death sentencing. I understand that Justin was already dead before getting shot, and that the shooting was unnecessary, but why give him a death sentence?

      Austin Myers and Tim Mosley's case seems to NOT be the ONLY case for which the one who "committed the 'physical killing'" was sentenced to life in prison while the mastermind received the death penalty. Another example case for which the person who did the "physical killing" received life in prison while the person who planned the murder (e.g., the "mastermind") received the death penalty was the one that occurred in California in the 1980s with Maureen McDermott. For the case in California, Maureen McDermott hired her accomplice Jimmy Luna to murder her roommate Stephen Eldridge (also for monetary reasons). Similar to the Austin Myers and Tim Mosley's case, Maureen McDermott seemed to NOT have participated in the actual "physical killing" of Stephen Eldridge while Jimmy Luna, whom was hired by Maureen McDermott, recruited two other men and then stabbed Stephen Eldridge several times and mutilated Stephen Eldridge after the victim (Stephen Eldridge) died. On the other hand, similar to Tim Mosley, Jimmy Luna also pleaded guilty and hence also received life in prison WITHOUT parole while Maureen McDermott, similar to Austin Myers, was convicted and sentenced to DEATH (and has remained on California's Death Row ever since).       On the other hand, I think that ALL four (Jimmy Luna, Maureen McDermott, Tim Mosley, Austin Myers) should have been sentenced to death for what they had done. However, since Jimmy Luna and Tim Mosley pleaded guilty to their crimes and appeared to be the ones who were "sent by the mastermind", life without parole seemed to be a slightly more reasonable sentence for them, compared to both Maureen McDermott and Austin Myers who seemed to be the masterminds of their crimes and also seemed to refuse admitting their guilt until "the very end" (based on the video from the above weblink about Maureen McDermott and this video on Austin Myers).

      Thought that too. I get that it helped motivate the other to talk, but then he had a foundation of material to manipulate and re-tell in his way. Even by the end of the documentary I had a hard time believing his story was 100% truth.

      Sissel Søfteland this isnt a game or a war. Theres no winning or losing you goddamn idiot. Theres letting a killer off to interact with other human beings or stopping him. Im sure that if his partner hadnt have told his friends part in it all hed be getting executed. The kid made a deal, and if they didnt honor the deal then no one would ever make one again. We would lose missing people, we would lose the ability to catch some criminals because why would anyone cause themselves more harm for no reason?     I knew this kid. Who was the Victim. He was good friends with my nieces. You honestly, could not ask for a more kind-hearted, goal-oriented, bright and happy kid. Who was enlisting to be in the Navy and was well on his way. These two have to be real monsters to commit this on Justin of all people.

      Mysterious Enigma no it doesn’t have to be black and white like that, that way of thinking makes no sense. What about killing for self defence, say a guy has a knife against your throat and so you shoot him in the head? That is still murder. You still killed him, but you needed to. See how murder isn’t always wrong? Context is important in deciding whether something is right and wrong, generalising an ideology among all situations is stupid because every situation is different. Both of the killers should have the death penalty, not so much for punishment, but to just get rid of them, and for justice for the family. They are literal scum. If they violate somebody else’s RIGHT to their own life then their right to live should be revoked. ESPECIALLY when it is 100% that they killed the guy. Imagine if your whole family got killed by these two, would you still want them lounging at prison, eating three square meals a day and having a place to sleep and have hygiene, a higher standard of living than some people who have done nothing criminal, for example the homeless. Fuck that. I would not want them alive.

    So this guy gets death row for killing one person? Capital punishment should be reserved solely for extreme cases, particularly people who you can't help or fix. In cases like this, life in prison, in solitary, is enough. I'll never understand how the law works in America, how they deem one case worthy or death row or not.
