  • Representatives of two consumer advocacy groups, Public Knowledge and the EFF, recently spoke out against DRM encryption on ATSC 3.0 at Dragon Con 2023. The panelists shared some of my concerns about DRM on over the air TV broadcasts but made a few additional concerns I never thought about, like the impact it has on user privacy.

    It should be illegal to have drm encryption for anything over the air with radio or television. The FCC needs to step in.

    Stations that broadcast over public air waves should not be permitted to encrypt their signals. If the FCC fails to rule and enforce accordingly, they are abandoning their clear responsibilities.

    Yes, I appreciate The two Ladies discussing the issues of over the air TV ASTC 3.0 / encrypting. To me the broadcasters, are more concerned over controlling what you can watch and collect data on you than providing a reasonable free access to TV.

    This is deep. It's like TV vs Streaming. The broadcasters want to know what you're doing with their signals, and when. And they need an internet connection to do this. This is wrong. It defeats the purpose of "Free Air TV" if you're paying for the internet to use it. They're two different kinds of services actually. And I think you're right, Tyler. They may shift some programming to streaming services if they can't get DRM through. Congratulations on your honorable mention. This matter needs more recognition. Thanks for the info.

    The problem the OTA viewing public faces is the various government agencies are benefiting from the retransmission fees. Buried among the various costs are the taxes paid to the government(s).

      Similar to the royalty kickbacks employees of the NIH get from pharmaceutical companies, not to mention the revolving door from the agency to boardroom of the industry companies. Let's hope the FCC does not become completely captured by the industry like most other agencies have, especially the FDA, and the CDC.

      Reatransmission consent should never have been a thing. Instead, all local channels should have solely been carried under fair and equal must-carry rules.

    Charging for over the air broadcasts is what I am afraid of the most. DRM should not be included in any over the air standard. Thank you Antenna Man and all the other entities for bringing this content to light.

      I found that independent journalists (if you want to call me one) tend to be the ones to expose corruption better than most news media outlets that have access to huge resources, likely because many news outlets are corrupt themselves.

    "Public interest, need, and necessity" is specific language in the Communications Act. This is applied to broadcast stations because the frequencies they utilize are owned by the public and not the licensees. CATV and streaming services are not subject to this requirement because unlike broadcasting that everyone can receive, these services have to be "invited" into homes by purchasing it. You are correct that the FCC will have a comment period on ATSC 3.0. In fact they are required by the statute of the Communications Act to have one. It will be in the form of a Notice of Proposed Rulemaking that will be published in the Federal Register. It will provide a date by which comments must be made and another date when reply comments are due. Depending on what the Commission receives a Report & Order finalizing the new rules will be issued or a Further Notice of Proposed Rulemaking (also providing comment and reply comment periods) will be issued to continue the process. You are also correct that this may take several years to come to a conclusion also remembering that decisions by the Commission can be appealed through the court system.

    Nice to know that there are groups out there fighting for us the consumers.. please add in that we don't want atsc 3.0 to work with internet access only... Lots of us have very limited internet ( hotspot of of prepaid phones).

      And we don't really even want low bandwidth internet "check-in" requirements. It would make potential TV tuning from a campground or summer home significantly harder or more expensive.

    Tyler, this is one of the best videos you have produced. The "piracy" ruse the local broadcast TV station owners keep pontificating about is total bunk. I have a sneaking suspicion that the ATSC 3.0 standard is just a stopgap for the local broadcast TV station owners to use ATSC 3.0 for pay to play data and non-local TV content services and eventually doing away with OTA local TV broadcasting and move it to streaming, so that local TV service isn't regulated by the FCC. The owners would require if you want to view their local TV station content, you would have to use an app on a streaming device and pay a monthly fee or inundate the user of the app to a lot of commercials to access the content for free. Sounds similar to Netflix, doesn't it? The local broadcast TV station owners and the NAB has a strong lobbyist group that can influence Congress and as the old saying goes, money talks.

    I like the point raised that while broadcasters are concerned about misuse of program content yet they have no qualms about playing fast and loose with user data.

    I wish these advocacy groups would work deeply together and share information with each other with the FCC and do something to kill this DRM encryption. DRM encryption is not broadcasting, it's a subscription type of system, not a broadcast system. I think ATSC 1.0 is going to be on the air for a very long time, and ATSC 3.0 will be severely delayed and will become standard once this DRM encryption is removed completely in the future.

      DRM is the poison pill to destroy the (Free AD Supported TV) model with the (DRM Pay Per View + Sales Taxes) model.

    Most Excellent.!! Finally a voice of reason on the topic of DRM encryption as it applies to OTA broadcasts. Thanks Tyler for standing up for a reasonable solution. If the networks are worried about an unlevel playing field against streaming services -- then let them start their own streaming service. EASY FIX.!!
    The FCC has an obligation here. That particular agency is charged with protecting the public's interest. It's time they got off of the fence and did their job.!!!

      I miss the smooth motion of sixty fields per second during Olympic ice dancing. I miss watching through a camera moving down a hallway and having all the framed pictures on the wall pan at the same rate, none stuttering, none frozen, none blocky. I miss the instant feedback during antenna positioning. I miss the natural handling of interference and dropouts that conveyed information about the nature of the interference (sparks, buildings, cars, weather) without halting the content.
      I don't miss the rainbow crosstalk between pinstriped jackets and the color subcarrier. I don't miss the in-and-out noise as the stereo signal was found and lost, nor the dual notch pseudostereo applied by stations who hadn't acquired a stereo feed to pass along. I don't miss that nothing not huge is clear enough to read, though as someone with bad eyes that part always felt natural. I don't miss that most people and even factory default settings set the thing to clip anything close to black down to blank and to have the picture puff up during the brighter scenes, especially when knobs went away and those awful defaults started getting applied after every power failure.

    Thanks for more deep dive about DRM encryption for free television! This is anticonsumer, and people should have the right to watch broadcasting TV without any additional equipment! I should be able to record my TV shows, just like how we use to do easily on VCRs or DVD recorders! Can’t believe the broadcasters were doing this since 2008, like going after people who record their shows digitally!

    DRM doesn’t stop piracy it actually makes it grow because people can’t view something because of DRM that just makes them go find a pirate copy

      I agree 100% with this statement. I also enjoyed immensely, the incredulous look and air quotes when describing Networks using DRM for "security". As if it's common practice for their signal to be hijacked. DRM just makes products less useable, creating the desire to pirate because it's easier and/or works better. It's not really about the money because OTA should be available for free anyways.

    It's not about the security, broadcasters see the doors opening for increasing revenue . It could easily end up just like cable and satellite tv. The airwaves are public. There not for making broadcasters rich.

    That was epic! I've already recently lost some sub-channels recently of a New York City channel. Yes, I have re-scanned the set several times. The main channel IS there but the subs are gone. This is a big deal and if the broadcasters get an "attaboy" to go ahead with this, not only over the air TV and spectrum will be effected, but who to say that over the air radio like AM and FM could find it's way there too. It's about the money, and not to the public's benefit as you just showed. Well done!

      FCC is no longer protecting the USA public. FCC is controlled by DRM ATSC 3.0 big money TV Stations and the big corporations behind them which make more money if DRM OTA ATSC 3.0 destroys the FAST Free AD Supported TV model to replace it with DRM OTA Pay per view TV model.
      Who owns the Valuable Limited USA public airwaves (The people Or DRM 3.0 TV Stations)?

    It's funny how on target these two ladies are with what exactly is going on with DRM encryption vs. any interview I've seen with Madelyn Nolan and her sugar coat story about how ATSC 3.0 will always have a free .1 main channel of each network station with any NextGen authorized tuner. I have one of those authorized tuners and it struggles everyday to decrypt DRM broadcasts. Thanks for posting this info.

    Here in Germany we do have encrypted, subscription based, digital over the air TV channels. Ironically this service is called 'freenet TV'.
    The TV stations can and do limit your ability to record and use those recordings just as you described. Coverage is largely dictated by financial interests (mostly limited to urban areas).
    I don't think this should be prioritized over cellphone companies when it comes to spectrum allocations.
    Your concerns are very valid.

      Thank you for your valuable information about the DRM OTA TV system in Germany.
      I am afraid that the USA is going from 100 percent OTA ATSC 1.0 FAST Free AD Supported TV model to the DRM OTA ATSC 3.0 Pay per view expensive TV model.

    Utterly ridiculous. These broadcasters get licenses worth billions of dollars for free. If they want to use DRM they should pay for space on a cable or satellite service, or a streaming service. This does not belong on the public airwaves.

    The collection of personal data and snooping is one reason I still have an over 12-year-old Panasonic 60 inch plasma non-smart TV, and an over 14-year-old 58 inch Samsung plasma non-smart TV that has been sitting unused in my bedroom since it was a little over two years old, when it needed a major component replaced under the extended warranty, which I don't usually take out but happened to in this case. Because the part would take two weeks to come in, I bought the Panasonic.

    Thanks for posting this, Tyler. I like where they mention one of the broadcasters was upset that someone was recording "American Gladiator"; really? they are worried about recordings of that TV-specific show? is it that much of a moneymaker? I like how Ms. Rose explained it in simple terms (17:50), broadcast license versus internet transmission. Unless the FCC steps in and puts the regulations in ink, including DRM limitations/restrictions, then ATSC 3.0 will be just a dream.

      If TV programming is not FAST (Free AD Supported TV) do not show it on the limited USA public airwaves.
      DRM only will destroy the people's Free USA Public Airwaves.
      1.0 TV does not have DRM so why do we need it on 3.0 TV?
      Vote by not buying DRM 3.0 TVs or 3.0 tuners.

      @@AAa-qd8hb Vote by letting your opinion known, not by boycotting the technology. We should be allowed to get the better protocol without it being ruined by DRM. Public airwaves on the networks main channels should be free and without DRM. If they want special sub channels that have to be paid for, that's one thing. I have the right to choose to buy it, or not to pay for it, but the main channels that have always been available, and still are available on ATSC 1.0, should be available at no charge on ATSC 3.0.

      I won't be at CES this year as I'm not going out of my way to promote the anti-consumer TV standard that is ATSC 3.0/NextGen TV. At this point, I hope the whole thing flops.

    Wish them luck... hope they can get the DRM stopped. We will not be moving off ATSC 1.0 to anything with DRM. When it goes dark we will pull the plug. I have a shortwave radio receiver and a GRMS two-way radio. So, if there is an emergency I can still find out what is going on without the TV.

      You make a good point about having GRMS and shortwave radios ready when local emergencies happen. We live in dangerous times where local information could save lives. Thank you for your post. We need to stop trusting local TV Stations for all emergency News reports.

    10 Reasons why OTA DRM ATSC 3.0 TV will fail.
    Currently no 4K and you only get the main channel and no sub channels.
    Channel Crawling = super slow channel changing.
    No sound because of Dolby AC4 audio codec does not have a legal open source license to decode legally on many devices.
    You may need non OTA home pay internet for updates and to unlock DRM encrypted ATSC 3.0 tv channels.
    Possible DRM restrictions on DRM ATSC 3.0 recordings and no viewing anywhere on any device with no sound.
    Emergency alert messages can not be received if DRM is blocking them.
    OTA DRM ATSC 3.0 TV will fail because the FCC is not going to turn off ATSC 1.0 TV stations for many years if not enough people buy 3.0 TVs and 3.0 boxes.
    No one has solve the problem of no government money for free DRM 3.0 TV tuner boxes because 1.0 TV turners and recorders will not work after that TV Station switches to 3.0 TV broadcasts.
    (Range and signal error correction) OR (more sub channels and near 4k picture) trade off problem.
    FCC is not forcing any 1.0 TV Stations to move over to 3.0 TV. So some TV stations will be on 1.0 and others will be on DRM 3.0.
    The FCC is only allowing OTA Simulcasts of both 1.0 and DRM 3.0 at this time for testing purposes.
    DRM ATSC 3.0 is a not finished product and is a work in progress mix of unproven ideas that has never gotten full FCC approval at this time.
    Software updates for 3.0 tuner boxes may be needed for changes made to the unfinished and future added new official ATSC 3.0 standards modules.
    Patent License problems. LG no longer sells TVs with ATSC 3.0 tuners.
    Some 3.0 TV tuners companies may go out of business or stop updates leaving you with no DRM or software updates.
    OTA ATSC 3.0 is better but is not perfect and still can be affected by weak tv signals: (distance, weather, planes, trees, buildings, trucks, poor antenna, etc).
    FCC rules that 5 percent of old ATSC 1.0 coverage area does not need to be covered anymore = (SHORTER RANGE).
    Viewing zone outside of your 15 minute city or town could be blocked.
    Your TV viewing habits could be tracked by your serial number or IP address.
    ATSC 3.0 is updatable until it is not updatable without new hardware tuners (ATSC 4.0, 5.0, 6.0, 7.0......).
    Some of these 3.0 TV issues may be fixed over time.
    This is only some of the mess with DRM ATSC 3.0 TV.
    This is my opinion why DRM ATSC 3.0 TV will fail.
    IMO. Stay on OTA 1.0 TV until DRM is removed from OTA ATSC 3.0 by law.
    It is the people versus the hostile takeover by private DRM 3.0 TV stations for control over the USA public airwaves.

    Tyler, did you read that LG is not going to put an ATSC 3.0 tuner in their 2024 tv's from the lawsuit they had? I had planned on getting a 2024 tv from them specifically for an ATSC 3.0 tuner, this is really disappointing. Thank you for all the information you give to the public and fighting for our freedom from these corporations.

    I refuse to pay the outrageous cost of cable television. I rely on many free sources including OTA tv from an antenna. I couldn’t wait for 1.0 ATSC. It has been awesome. Now something new and better comes along and the broadcasters are getting greedy. The FCC could speed everything along but it is a government agency so forget about that. Thanks for the update though.

    NYC finally got TWO ATSC 3.0 stations due to cooperation between different broadcasters to share their ATSC 1.0 facilities and the new ATSC 3.0 facilities. So far, DRM is not being used (yet) but I am sure once they stabilize the transmission systems (not yet running full HD) they will start with it. One problem at the moment is some of the relocated ATSC 1.0 subchannels are now using MPEG-4 which is not widely supported on ATSC 1.0.

      DRM actually is on ATSC 3.0 in NYC. It's on NBC, CBS, and Telemundo.

      Not sure why I would buy a tuner with all drm issues ...so they ate really broadcasting to no one...maybe that is what they want.

      @@robm7076 Broadcasting to a select few was actually quite common during the early years ATSC 1.0. It wouldn't spread too wide until 2009, when people were getting ready for analogue broadcast to conclude.

    I doubt encryption can sustain in the long run -- because these are theoretically public frequencies. Getting the matter to litigation could be lengthy and costly. In theory, even the ACLU could be involved. This big mess could get interesting.

      If TV programming is not FAST (Free AD Supported TV) do not show it on the limited USA public airwaves.
      DRM only will destroy the people's Free USA Public Airwaves.
      1.0 TV does not have DRM so why do we need it on 3.0 TV?

      We probably agree more than disagree, but the broadcasters and other players are forcing this into litigation. Why not just play nice? OTA is heading towards a wasteland just like corporate FM -- you can see that in the lack of quality programming.

    Glad things gaining a small amount of traction. All I want to do is place my antenna in the best possible spot and then send that signal to my home devices or DVR to watch later. Antenna location is important in nyc where we navigates lots of buildings, interference, etc.

    I live in a Senior complex and Locast was perfect. Now I pay for You Tube TV to get local channels. I record certain shows, but when watching them, it shuts off several times and goes back to the beginning and I must forward to the the place I was watching. How do I get local channels without paying YT TV or Hulu live? I already pay for Netflix and Hulu.

    Commercial broadcasters are exactly that . The business model was based on commercials and how many people bought their product . When it was advertised . The more their product was advertised the more money got from the broadcaster too. Now the broadcaster wants more .
    The greed just keeps getting worse .

    we need to skip to ATSC 4.0, which should act like ATSC 1.0 with only 'one way' communication, uses open source video and audio codecs (vp9/opus/flac), and patent free (or patent expired) means of transmission so LG can join back in...

      I’m generally of the opinion that interoperable standards should be royalty-free. If you want wide compatibility, charging your end users is not in your best interest. Especially for software implementations. Now, note that I said royalty-free and not patent-free. Patent-free would make the legal issues even worse (such as someone else patenting the spec and claiming it)

      Many people can not get internet at their location.
      OTA DRM ATSC 3.0 will fail because of the USA public airwaves charter to serve the public and not privately owned greedy DRM TV Stations.

      There will be. DRM is always cracked. As I've said numerous times, DRM encryption on ATSC 3.0 will not stop piracy. It will only inconvenience manufacturers and consumers.

      The way the public can kill OTA DRM is to not buy OTA DRM ATSC 3.0 TVs and tuners. It will be many years before enough people have DRM 3.0 tuners before ATSC 1.0 TV Stations are allowed to be turned off.
      FCC is not forcing any ATSC 1.0 TV Stations to go to OTA DRM ATSC 3.0 TV.
      Some TV stations will be on 1.0 FAST Free AD Supported TV model and others will be on OTA DRM 3.0 pay per view expensive TV model.

      Likely because the Zapperbox isn't a network tuner. It directly connects to the TV by HDMI

    Do you think that there will come a time when the only FREE OTA broadcasts will be Public Service stations and that the traditional network broadcast TV will be absorbed or replaced ENTIRELY by streaming services. I find that OTA broadcast without free DVR capability would be useless to me -- I rarely watch anything in real time except sporting events. Thankfully I'm a senior now so perhaps the major networks will continue to broadcast in ATSC 1.0 until I pass onto the next life.

      Yes, I have a feeling that some stations will slowly move valuable content from free OTA TV to either a paywall on ATSC 3.0 (which DRM will enable) or to a streaming service. As people cut the cord from cable and satellite, the networks are not going to accept the loss of revenue. They will make it up in some way.

      @@AntennaMan I think perhaps cord-cutting general public feel that are OWED free OTA quality content but that could prove to be a mistake in our reasoning. The network broadcasters aren't in the business to provide free programming, the are offering quality programming so that they can get more viewers and charge more for advertising (based on viewership). But if there aren't that many viewers of OTA TV, then broadcasters can't make much ad revenue and thus it doesn't make sense for them to stay in business. I'm not sure that everyone/anyone thought this though.

      @@timb6985 We are owed that because the broadcasters have been receiving Federal money the last 50+ years. We pay those taxes, so we should have a say in it. They also get money through commercials and by charging cable companies rebroadcasting fees. Some of these channels would get more OTA viewers, if they would just broadcast a more robust signal, that reaches more people. More viewership, should equal more ad dollars. But, rather than have a consumer friendly, forward thinking mindset, they'd rather cut corners and give all the money to the presidents and CEOs of the companies, instead of using the money more efficiently and sustainably.

    We need a smooth transition to ATSC 3.0. I live in nyc and channel 11 just turned on 3.0. It looks brighter and cleaner than their 1.0 channel, which is currently simulcasting.

      Big business owns our government. It's been getting rapidly worse since the early 2000's. Citizens United was the final nail in the coffin. We the people lost almost all control of the way our country is run. It's sad.

    What I see is this is another nail that will seal the coffin for OTA television viewing. Occasionally I watch OTA but almost all broadcasting is little interest to me. If my OTA were to die, I'd not be missing much. So if broadcasting is encrypted then why go through the trouble or cost to watch programming that I have little interest. I can see many others not bother with OTA.
    I also perceive broadcast and media companies are different species of humans than the viewers. So all those at Dragon-Con can say or present whatever but that is a foreign language to the broadcasters. They will shoot themselves in the foot by making it more difficult to watch OTA TV.
    Old guy here, I remember there was a time if major event (flood, tornado) is happening the EBS will kick in to alert viewers. Though EBS is now called something else (I forgot) but I don't see TV providing much service like that. And yet broadcasters (they think different than us commoners) will encrypt emergency broadcast messages.

    I remember reading about the rollout of the original digital television in home Hi-Fi and home theater magazines all those years ago. There was no UA-cam or Internet discussion then so the magazines were your only source. I don't know all the particulars but I do know that they came up with agreements for all of this home recording bull then. I don't see why this would be any different. I suppose like most things follow the money. If they sniff money in the air you know they're going to do what they can to try to make that cash grab. Somehow they're going to try to turn this into a paywall I just know it.

    TV like radio should be a fundamental right. Back then we had TV's with Antennas and we watched TV for free (just the initial price for the TV itself). The ads we watched on TV paid for the TV channels and the governments would provide funding for local channels or allow them to raise funds.
    The big telecoms and channels got greedy full stop they should be charged and we should revert back to the old days in this respect.
