But the shift of liability from the taxpayer to the union or to the officer is scary.... Without some type of insurance policy where the officer is protected from financial liability (not to mention legal).... Officers would either refuse to deploy or they would hesitate to act aggressively.... This is the balance we are having trouble achieving... Balance of safety and liberty....

      I understand the sentiment of wanting cops to be financially punished for settlements against them, but after thinking for a short time I think that would not be good. Just as we don’t want cops to financially benefit from property and money they seize from citizens. I think it would be a bad incentive program. You don’t want cops being extremely passive and letting criminals get away off of the small chance that you could lose everything if they happen to do something wrong, or if a jury believes he did something wrong. But I see how that could be hard to accept. I absolutely think police need to be held accountable, and too often they have not been held accountable, especially in the past. Also I wonder if it would be too big of an incentive for Police to lie if they had to pay out a lawsuit settlement out of their own pocket. I’m not saying that they don’t lie now and haven’t lied before, because they absolutely have. I just think if they are personally scared about losing everything it gives them even more of an incentive to go even further with their lie. It’s about risk versus reward.

      @@manuelelizalde4595 The officer could have been a little more polite and professional when he engaged in the interaction with the "presumed suspect." What about introducing himself first and create an environment where the person would have felt safe, which would have led him to trust the cops? The officer not being able to provide a photo of the suspect at the moment does not grant a request for ID, especially when you don't even have a name to match with. He only had a vague description of the suspect. There was reasonable suspicion, but that alone could have never amounted to a probable cause that asked for a presumed suspect's ID. You are not required to show your ID to police officers unless you have committed a crime or they have enough evidence of this. All they could have done was to briefly detain him while they investigated, which they did. They failed to provide a probable cause for an arrest though, which was enough to let him go his way.

Am sure if it was you and u had work to go to you would just give up your ID and be on your way you wouldn’t waste anyone time and ruin your chance to go to work it happens to everyone just give your ID and don’t waste there time.       Im in Australia and I just looked up US laws. Use of handcuffs means arrested not detained. Detained mean stopping someone with no use of restraints as in handcuffs.

If the professional assholes do not know the law how can you criticise the general joe public to know the law? Why would anybody of any intelligence to allow themselves to be kidnapped willingly? He asked for a supervisor several times. This is the correct legal procedure. Did you look that up too?     I hope this innocent guy gets the highest settlement the city has ever had to pay for the thuggery of these blue line gang members. And it’s just awful. The “injuries” the cops received are hilarious but no concern for the guy put in handcuffs and violently shoved into the car, loss of freedom , money and reputation. How can the first 2 cops sleep at night knowing what they did is wrong? 😡🤬. Almost forgot the law office that saw everything and flat out told the cops that they saw it all and the only criminal was the cops.

      @Carlos Spiceywhiener Not about antagonizing, you are legally upholding your rights. If he actually did something wrong in the eyes of the law, i get your point, but this is not the case. If he is not arrested, then they try to force him in the car that's kidnapping. At that point they told him he is not arrested and he didnt want to get in that car that should have been it, just swallow their pride and force to let him go. Cops did wrong plan and simple. Some people find it easier to comply.... it's not civilians duty to make their jobs easier if you do not wrong. Cops are suppose to know what to do in this situation, they clearly didn't know what to do, hopefully this man will follow up with a civil suite, only way for them to get educated is to hit their money, which is sadly our tax dollars.

      That’s actually not true. I think what you guys are talking about is that a citizen doesn’t have to identify themselves to a cop just because a cop want to know. But according to Texas law 38.02(B)2, they do have to give their identification if they are lawfully detained.
      Sec. 38.02. FAILURE TO IDENTIFY. (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information.
      (b) A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has:
      (1) lawfully arrested the person;
      (2) lawfully detained the person; or

      @@iMatti00 You do know he was never charged with failure to identify. He was charged with assaulting the officers in which the charges were dropped. Like, many Lawyers who review this all stated he didn't have too, even the police chief stated he didnt have to, but said no of this would've happened if he just cooperated. (which is legally didn't have to). Good job with the copying and paste, but that do not apply to this situation, failure to identify only apply if the officer believe the subject was suspicious to a crime, committed a crime or in the act to about to commit a crime. The first thing the officer told the guy you are not being arrested, but detaining you to complete their investigation. If they cannot complete your investigation, where you are being detained, you have every right not to go to another location, because you are not arrested. Look at the video, the officers tried to get the lady to come to the location, they knew they wasn't legally able to make him go there, or that would have been the first option. They was 100% wrong plan and simple.

      I completely disagree that the cops did anything wrong here. They were respectful to him. Cops have to find people that are violent criminals in that choke their girlfriends unconscious.
      And according to the cop’s description @1:11:30 this guy that was working out jumped the fence of his apartment complex, and his apartment complex was just on the other side of the victim’s apartment complex. And also, I know this is obvious but, remember that people that are hiding from the police often won’t give their identification/name or lie to the police. It seems the real suspect did just that thing when the cop showed up to the victim’s apartment to take a report. Another cop describes that @1:19:39.
      I think too often cops commit small abuses of power and get away with it. Depending on the contact I think they should be disciplined and they have to correct the ways or be terminated at the least. Hopefully with body cameras and people watching them, a lot of cops I thinking twice about their actions. And as far as these cops, I think they handled it just fine. I understand people don’t like to be questioned by the police but we need them to get violent and destructive people off the streets and hold them accountable.
      We can’t start criticizing cops that do a good job because not only is it not right and unfair but also it’s kind of like “the boy who cried wolf“. Criticizing cops that do things the right way is going to make other people desensitized to outrage and not care about police abuse because they’re so used to people screaming and shouting over cops that even do things the right way and acted reasonably.

      @@iMatti00 He was well within his rights not to provide I.D. That is the problem with you people. You want to selectively apply The U.S. Constitution and it doesn’t work like that. He was under no legal obligation to provide identification. So everything the cops did was a violation of his rights. And another thing. Even when the victim clearly stated that is not the guy. They persist on trying to make him the guy and that is the crust of the problem. To the injustice system all Black people are guilty whether they committed a crime or not. But sadly even when it’s on video you like so many ignore it and it’s right there on video.White people need to check ourselves!

      I completely disagree that the cops did anything wrong here. They were respectful to him. Cops have to find people that are violent criminals in that choke their girlfriends unconscious.
      And according to the cop’s description @1:11:30 this guy that was working out jumped the fence of his apartment complex, and his apartment complex was just on the other side of the victim’s apartment complex. And also, I know this is obvious but, remember that people that are hiding from the police often won’t give their identification/name or lie to the police. It seems the real suspect did just that thing when the cop showed up to the victim’s apartment to take a report. Another cop describes that @1:19:39.
      I think too often cops commit small abuses of power and get away with it. Depending on the contact I think they should be disciplined and they have to correct the ways or be terminated at the least. Hopefully with body cameras and people watching them, a lot of cops I thinking twice about their actions. And as far as these cops, I think they handled it just fine. I understand people don’t like to be questioned by the police but we need them to get violent and destructive people off the streets and hold them accountable.
      We can’t start criticizing cops that do a good job because not only is it not right and unfair but also it’s kind of like “the boy who cried wolf“. Criticizing cops that do things the right way is going to make other people desensitized to outrage and not care about police abuse because they’re so used to people screaming and shouting over cops that even do things the right way and acted reasonably.c

      Now think about it., this is cops in broad daylight with cameras everywhere and people all around them and they are comfortable behaving this way. Can you imagine how many black people or people of color IS serving time as we speak as a result of this kind of BULLS#*T…. I don’t wish ill will on anyone, but this is why cops find themselves in a Us vs Them situation. Just think what the difference would have been had cops done their job according to law. Once the cop tried to bend law to justify their behavior one of the cops should arrested that cop for planting or manipulating evidence. If no one is above the law that should mean everyone including cops given cops aren’t law, they are the enforcers OF THE LAW. Point is, that ole saying “what you gonna do when the rabbit shoots back” is now being answered. If cops want to fix what they have created then they must lawfully intervene across the board when the law is being broken even if it is another cop breaking the law.

      I completely disagree. There were plenty of cops out there that could looking for the guy, only two cops were detaining him. If he would’ve gave his name it would have been over.
      And according to the cop’s description @1:11:30 this guy that was working out jumped the fence of his apartment complex, and his apartment complex was just on the other side of the victim’s apartment complex. And also, I know this is obvious but, remember that people that are hiding from the police often won’t give their identification/name or lie to the police. It seems the real suspect did just that thing when the cop showed up to the victim’s apartment to take a report. Another cop describes that @1:19:39.
      I think too often cops commit small abuses of power and get away with it. Depending on the contact I think they should be disciplined and they have to correct the ways or be terminated at the least. Hopefully with body cameras and people watching them, a lot of cops I thinking twice about their actions. And as far as these cops, I think they handled it just fine. I understand people don’t like to be questioned by the police but we need them to get violent and destructive people off the streets and hold them accountable.
      We can’t start criticizing cops that do a good job because not only is it not right and unfair but also it’s kind of like “the boy who cried wolf“. Criticizing cops that do things the right way is going to make other people desensitized to outrage and not care about police abuse because they’re so used to people screaming and shouting over cops that even do things the right way and acted reasonably.

Gary eventually found his composure with constant support of his actions. "His nostrils look the same as his mugshot."? The description was awesome, too; "...I guess he had a beard, not a long beard." That cost about ten million dollars; but at least those dollars support the Right folks. That's money earned. They had a description of a guy wearing black shorts, green shirt, short hair, and a small chin beard. He was detained under a description he didn't match, had no need to identify himself while he was just going for a fucking run, and they were going to force him to drive to the witness and not have her come to them.
      If I was stopped during a workout, told to get in the car and go see someone to see if I match the description of someone I obviously don't. I'd say no.

    Disgusting. As soon as the victim told the officer over the phone that his beard was short, he should have been released. With today's tech (everyone has a cell phone) there was no necessity for either the lady to come to the scene or for them to go to the victim. The ID could have been done with a cell phone picture with the victim directly or when the 2nd officer was at her apt. I can not believe that a person does not have the right to resist being falsely detained/imprisoned (KIDNAPPED!!!). Regardless of whether or not these officers got touched when they assaulted the gentleman, as soon as they discovered he was not their suspect, they should have just licked their wounds, uncuffed him, apologized for detaining him, and released him.

    The cop who's recording with the body cam, seems awfully nervous. He keeps dry heaving, coughing and nervously clicking on something.
    The fact that he couldn't be ruled out sooner is preposterous. They had a mugshot of the suspect and they could've just taken a picture and sent it to the victim to verify, in seconds. They should've let him go as soon as they got verification from the victim that it wasn't him. These cops should be ashamed of themselves. Putting felony charges on this guy when he was innocent!

The officer lied in an attempt to justify what he did. Texas is not a stop an ID state. You can’t grab innocent people off the street and throw them in the back of a cop car .

    They charged this black male with a crime after assaulting him. WTF!
    1) "All he had to do was ID"? No he didn't! He wasn't under arrest but detained. He had a constitutional right to not give any ID.
    2) The cops violently try to force him into the cruiser, to illegally take him somewhere he didn't want to go.
    3) The cops try to cosplain how they're victims (how the real victim assaulted them) after he defended himself (refused to be taken to another location).
    4) The cops falsified charges to CYA justify their brutality, after learning the guy wasn't the culprit!

      Why not let the guy in white shorts and wearing a full beard leave? Considering they were looking for black shorts a different shades of green shirt and not a full beard. It's because they don't catch criminals they just convince jury's to conviction of innocent people. It's how our "justice" system works in the land of the free. You're free until they can figure a way to cage you up. And this goes for mexican, black, white, and asians. This system makes money from the incarcerated. Act accordingly.       The description was also black shorts, not white shorts with a black stripe on the side 🤦🏾‍♂️ “all he had to do was ID himself” actually no, the law is pretty clear that you don’t if you’ve done nothing wrong. It’s up to the police to gather that proof if they really believe you’re guilty enough to for an arrest. the stupidity in the video could really make your head hurt.

      @@kenshinscott youre an idiot! Officers do NOT have every right to detain anyone they want, ever hear of a tiny little document called the Declaration of Independence and the U.S. Constitution? Bill of Rights? Any of these sound vaguely familiar to you? This is not Nazi Germany! You can't just force someone to give you ID and you sure as hell can't force someone into your car without probable cause that they committed a crime! The law CLEARLY states that in order to be charged with a crime for not giving ID they MUST be able to clearly articulate a specific reason they believe that they person either: committed a crime, was about to commit a crime, or was currently committing a crime, PERIOD. Without out that then they do not meet the clearly defined guideline to charge with failure to ID. "You fit the description" does NOT meet the requirement for probable cause to detain or arrest! The Supreme Court ruled that a person's refusal to cooperate is not sufficient for reasonable suspicion. (Florida v. Bostick 501 U.S. 429, 437 (1991)-). If that was legal, then any cop could force anyone to ID and give information simply by saying they match a description of any crime they choose. That's a very dangerous slope because if we allow that then what's next? Now we can search because they "fit a description?" Why not just allow them to arrest anyone who "fits a description?" It's all good and easy for you to say just give your ID, until YOU are the one they are asking! What about when your child is the one they search because they fit a description. I am assuming you are not black as well, if you were then you would understand how "fit a description" applies to you every time you are walking down the street, or driving and you get stopped for no reason because you fit that description. The description: Black. Driving while black. Walking down the street while black. These are crimes apparently in this country because innocent black citizens get stopped over and over again and ID'd and searched simply for being black and they guise it under the name of "fit the description". You would be hard-pressed to find a black citizen in most parts of this country that has never been stopped by the police because they "fit the description". You are very ignorant and you prove how stupid you are when you write things like this.

      Eye witnesses are the least reliable evidence. If the guy matched the description exactly they probably would have let him go because they're never right.
