    You're right. It isn't the fault of the dog. It is the fault of an owner who doesn't know what he's doing and ultimately ended up creating the dog equivalent of a sociopath.

      Um, no. I mean I don't even believe in free will, but dogs are like people in that way. If any of them are responsible for anything. They all are. There is no way of knowing *how much* the owner contributed. But to pretend the dog is this 100% innoscent animal that *never* would have hurt anyone is just silly. That's not how mammals work. Any dog can bite anyone at any time. History shows it over and over and over.
      And to be clear: I don't think it's their fault in reality. But we have to act like it is. As they did in this case.

      @@JaneDoe-tr5xy Ah, yes … blame the woman for feeding a dog and trying to treat it like all the other dogs after the owner explicitly gave her the okay to do so. Blame her for doing the same exact feeding routine she’d been able to do with all the other animals there.
      Do you realize what you’re saying? lol you’re basically admitting in a roundabout way that the dog breed is so dangerous that it can’t even be treated like other dogs, that it needs some sort of special rules to follow due to how dangerous it is … meaning it had no business being there - no business being anyone’s pet let alone in that place around any human.
      You sound like the same types of wackos that call themselves “pit mommies” and nickname their pets “velvet hippos” that sit and mock and blame victims from vicious attacks, especially ones that result in death of a human or death of other small pets. It’s always the person that got bit’s fault … never the animal and the breed itself for its aggression and way it was raised.

      The women isn't on trial and ultimately the dog does seem to be dangerous so it doesn't really matter at this point, if this dog were to get out it seems to be a big risk of hurting others regardless of these specific instances.

      Neither one seemed to care about the bite victims and gave the impression of, "It's your own fault!" And I don't believe the kennel handler would make up a story about being given permission by the doctor to take the dog out for walks. She admits she violated policy, and she did, but I don't think she lied about permission.

    As someone who has grown up with an Akita/Chow mix (both are guard dog breeds), I can say that the owner is the one fully at fault here. That dog would not have been dangerous whatsoever if he had taken the time to train him properly to not attack people or just train him properly in general. The owner wanted a dangerous dog so that's how he taught the dog to be. It pisses me off that the dog had to be put down because of the arrogant actions of a person who should never own any animals if all he wanted was one that would do nothing more than attack people. The owner should be put in jail as well for training an dangerous animal as well.

      This, Absolutely! The biggest thing that pissed me off from the original case was the fact that before the neighbor was attacked for just saying hi outside of Diata's gate the dog had already gotten out before and shown aggression to others. In the original trial we had testimony that the dog liked to get out of its yard at night and wander and patrol around the area well beyond Diata's property, even to the point of staring someone down while they were just putting their garbage out. Diata knew of the issues and didn't do anything about it until after the attack that left his neighbor without the full function of her hand any more. And even then, his "solution" was to just try and put up an invisible fence around his yard and call it fine. Diata was willfully ignoring the basics of what he needed to do with a dog like an Akita because he thought he knew better than everyone else. This whole sovcit shtick is just to avoid taking responsibility and to feed in to a victim complex.

      Did anyone think to check the food the owner brought the dog for any additives that shouldn't have been in the food? I wouldn't put it past an owner to to do that in order to sue the county/facility trying to make this their fault ... people do weird/horrendous things for $.

      Akitas are literally listed as a dangerous dog breed and are banned from being owned in towns and cities, and even entire states, across the country. The fact is that an Akita requires intense socialization and obedience training, as well as constant vigilance on the part of the owner, to be viable as a pet. The vast, vast majority of owners are neither cut out for, nor aware of, these absolute necessities. Very few people have any business owning such an animal - the Akita breed should be banned so this exact circumstance doesn't occur, because the dog is the one who will have to pay the price.

      Some dogs are aggressive despite of training. He doesn't necessarily have to train the dog to bite. But I agree that when adopting any dog, especially a large, powerful or aggressive breed, you need to provide proper training and keep the dog out of trouble. He definitely failed there.

      @@DebbieDavissaid I picked up what you were laying down when you asked if his previous dog was spayed/neutered- one of the biggest reasons to do that is to prevent wandering which helps prevent dogs getting hit by cars

    I must point out ... Debbie Davis is an animal lover too, and I fully believe that having to carry through this case hurt her heart even more than it hurt any of our hearts to see it. (Hugs to her for it.)
    I don't think for one minute that Judge M enjoyed having to reach the only conclusion legally available either.

      I'm sure Judge M and Ms Davis were both torn up to have to put the dog down. All of us are. But the owners created an adult dog that wasn't socialized. So sad.

    Diata has always said the dog was an akita and german shepherd mix. Now Diata said the dog is purebred and intact for possible breeding purposes.

      That dog doesn't even look like a purebred Akita in the picture. You can tell it's a mixed breed. Not that I have an issue with mixed breeds, I've owned mixed dogs most of my life but lets be honest - he's not a purebred anything.

    After the live stream, I went over and looked at the photos. Not a doctor and don't play one on tv, but I wanted to see the damage for myself. The wounds had clean edges so the doctors were able to get them closed up. The scars don't look too bad considering all the stitches and she has a plastic surgeon on the case. I wonder if she will be able to do her job after the trauma. So sad. I feel sorry for the dog. He never stood a chance. Improper training, encouraged to be aggressive, not neutered to calm his tendencies. His owner seems proud that his dog is dangerous. The longer he is kept in those stressful circumstances, the worse he will get. I'm going to go love on my teeny doxie now.

      Doesnt really matter if a plastic surgeon can make her face and arm look a little better. Its the fact the dog is unpredictable and cant be out in public. Im an animal lover too. But akitas are known to be this way. especially if they are not properly trained. She should not have to go through surgeries or the pain. And the first person should not have been attacked either. Do we give the dog a third chance to be unpredictable? That would be negligent at best. I dont think the judge or debbie like making these decisions.

    Hey all, at about 10:15 AM EST, NOV 30, 2023, a SOV-CIT came into the Georgia courthouse I work at and it was everything you could imagine. It was painful! He lectured straight from a SOV-CIT bible. I'm going to have nightmares about it!!

      Can confirm. Chiripractors are quacks, not doctors. There is no medical efficacy whatsoever to chiropractic "medicine". You're more likely to walk out of a chiropractor's office with an injury you didn't have when you walked in than you are to have them actually fix something.
      You ever notice how whenever apologists try to defend these quacks, they say: "That's not true! I've been going to my chiropractor for years for my back pain and..."
      If I was going to a real doctor for the SAME ISSUE for years and I was still having to go back, that means HE'S NOT FIXING IT!

    The dog didn't bite because the employee ignored the sign. It was the employees fault she put herself at risk by not adhering to the sign. However, the dog bit regardless of signage. Period. And will bite again

      yeah, that. most dogs dont bite if you go into a kennel with them. most dogs, if they feel they might have to protect themselves, will growl, bark, raise their fur on their back & neck, back away before making a lunge, snap at the air etc. the fact that this dog didnt, and only stared at her is super scary. its seems predatory, like the dog viewed her as a valid target to attack

      To me it is a dangerous sign that the dog would attack unprovoked someone the dog was familiar with. How can you keep a dog like this in your house and guarantee that is would not accidently get out of a fence or even a door?

    I have rescued many dogs and trained German Shepherds. I work with a dog behavioral consultant. Some dogs are dangerous and cannot be rehabilitated.

      It's true. Particularly when they've had the misfortune to land with the wrong owner who is keeping the wrong breed for the wrong reasons, and doesn't understand the particular characteristic traits of the breed.
      If Mr Diata did not fully understand that Akitas are highly-bred guard dogs that are bred for strong aggressive/defensive drive, high energy, and lack of growling/barking before attack ... if he did not understand that they are challenging dogs to raise and demand experienced, skilled, firm owners who give them expert training ...
      ... then he had no business owning an Akita.
      They are beautiful, wonderful dogs, and I love the breed. But they are not dogs for just J Random Dog Lover. They are working dogs, bred to a particular job, and this needs to be front-and-center in any prospective owner's mind.

      @@CindyLouWho77 actually, no. She & her brother were brought in to the shelter where i was a volunteer. Brother was very sweet. She had problems, but i was not going to separate them or leave her behind. Had them for 10 years now. Love them both.

    I had almost the same thing happen to me. I used to work at a vet clinic. I was broading dogs. I had an onwer where the dog comes aggressively at you if you try to get him. Once you get him away, he wasn't a bad dog. He listens to my commands. One day owner was yelling at one of the doctor and his dog got aggressive. He lose control of his dog. I quickly grab the dog's collar. His dog starts try to bite so i had to put him down. The doctor had the get the owner out so the dog can calm down. The dog finally calm down and we asked the owner to never come back until his dog is train. Three weeks later he tried to sue the vet clinic and me but he decided to drop it. If you can not train your dog, you shouldn't have one.

    Sometimes I wish they'd say "sir you are now a corporate entity because by coming into the meeting without saying 'permission to come aboard' you have created joinder, permanently granted this court jurisdiction in this matter, and dissolved the billion dollar trust once kept in your name. You will now need a license to drive and a separate license to travel.

    All of the policy questions were most likely to head off any sort of civil suit. I'm actually surprised that Ms. Davis didn't object to the relevance. I also found it hilarious that the defense attorney wanted a postponement due to not having the pictures he already had access to. He then asked questions about specific details of one of the pictures. Finally, if the dog had been destroyed after the first attack, this woman wouldn't be living the rest of its life disfigured and terrified.

      So is this hearing because of the other judge's stay, or because someone else was attacked? How long and how many times will this dog attack people until it's finally settled?

      @@molliannstocks2217 This hearing is because an additional case was filed after the stay was put in place. When the last case happened, where Middleton had ordered the dog put down, this incident had just happened a few days prior and this dangerous dog case hadn't been filed yet. It takes time to get all the paperwork together for filing something like this because once you do it triggers a lot of timetables to start taking effect. The prior order to put the dog down was due to the dog's attack against the neighbor originally, they just had some basic testimony about this case added in to show the animal was still dangerous during that previous hearing.

    I considered this "doctor" a liar and a self centered jerk from the very beginning.
    He's lied under oath, several times and doesn't care about anyone but himself.
    Because of him, the dog must pay the penalty.
    I looked him up.
    He's exactly what I thought he was, a freaking chiropractor.
    I would never use the word doctor to describe a chiropractor.
    I lived just down the street from the country's leading chiropractor school in the 80's.
    Almost every person I met, who attended school there, was nuts.

      my aunt had her neck badly messed up by a chiropractor. recent studies show people are more likely to have strokes after neck adjustments because their arteries in the neck can become damaged

    From the last hearing, it boggles my mind that the owner tried to use the defence of the dog being in a kennel with sings saying "do not go near" or words to that effect. If a dog is that concerning then it absolutely has severe issues and should not be allowed back in the public at all.
    Sad, but you gotta make the public safe.

      @@railmaverick It reminds me of when I worked in car insurance. More than once we'd get a car wreck that we'd have to have moved to a storage yard ASAP because of course twisted sharp hunks of metal that leak fluids can be dangerous. And sometimes they don't get picked up quickly enough and someone gets injured by it, whether just walking past or something inane like that. Guess who was responsible? Us as the insurers.
      You have something that's dangerous and know it, then if things still happen, you're still responsible.

    I quite believe how she describes things in hospital. I've had a couple of small puncture wounds from dogs in the past and they hurt like a bastard (I get regular kindey stones these days and the pain's up there). So I can quite empathise with her feeling sick due to the adrenaline and shock. I've been there.

    The loser in this is of course the dog. He's only 2 years old. Very sad.He clearly loves his dog, but I'm not sure what the Dr. thought going SovCidiot would accomplish. And given why the dog was there, WHY would the Dr. even consider telling this kennel staff that the dog "was trusting her" or suggest that she have ANY contact with him? Dumb, dumb, Unfortunately Akitas are not easy to train and steadfast loyal to their person and leary of others. Typically 1 person. They can also be unpredictable. Throw that on top of being locked up in a strange place and without your person. While I feel really bad for the victim, I've watched previous hearings and am not impressed with how they handled this dog. And again. knowing why the dog was there, it should have been a big fat NOPE on her part to ty to get close to him.

      Me. As a person he seems like a great guy, but as a judge he's soft. The more I've watched him over the last few years, the more respect I lose. He's all bark and no bite. Criminals don't believe he'll hold them accountable. They aren't scared in front of him. It's pathetic.

    FOIA Request, no it's called discovery, and if it was needed it's up to your attorney to request it.
    Not just a dangerous dog, a dangerous owner not willing to accept he has a dangerous dog, whether that be a pet, or guard dog, if it was a guard dog he should have been more careful with it in the first case.

    What particularly bothers me about this case is that it seems certain that Dr Diata is going to get another big dog, perhaps another Akita, and that dog, too, is going to be dangerously aggressive.

    *As someone who is working with dogs and has helped the police/animal control with dangerous dogs, the owner is 100% at fault to begin with.* I feel though that the facility is also at fault *to some degree.* Only dogtrainers *with experience in handling dangerous dogs should deal with these types of dogs.*
    The woman broke procedure/policies and sadly got bit. It seems she have misread the dog in my opinion *based on her description of his behavior,* which is my point as to why the facility also is to blame, they should only have experienced, educated dogtrainers handling these types of dogs.
    I cannot state it as fact since I wasn't there and haven't seen the dog I didn't get to witness it's body language, but by her description it seems that her lack of knowledge also led to the bite, which is why I say the facility should have a super strict policy that only experienced handlers should deal with. I would even say they should be kept in a separate area with a door that has a coded lock that only experienced handlers can go through.
    I would not have opened the kennel if he showed the behavior she described. Again I'm not blaming her for having a heart and probably loves dogs and felt bad for him.
    It's the owners fault who did not train the dog properly. Akitas are fierce, and needs copious amounts of training and a knowledgeable handler. He is now paying the price due to the negligence of the owner who did not take responsibility and time to handle and train this sort of dog.
    Just as an FYI
    A dog that stares at you can be an indicator of them being ready to act. Like "I'm watching you, do not take one more step into my space or else." . Esp. if they are cornered, in a small space and following your every move, being very alert, raised tail ,raised ears and so on. She came in with a high value resource (wetfood) into his space, akitas are more a "one person dog "
    The dog had been with the worker together with the owner. Making the dog accept her in the owners presence. The owner is at fault the whole way.
    This is just to inform everyone, a dog that tenses up, raises it tail and locks its eyes on you can be a sign of them "loading" /or is ready to engage. Some dogs do not growl. Esp if the dog is punished or told no every time they try to communicate something to you/others. The dog can raise its hackles without it being due to aggression, it can happen due to excitement. It's important to learn how to read dogs and not think that a wagging tail = happy dog.
    Police dogs can be seen wagging their tails when biting someone as an example, out of excitement.
    Also, neutering doesn't guarantee changes in behavior since the adrenal glands also produce testosterone and according to studies its hard to say how much that plays a part in behavior. Neutering to early can lead to healthcomplications as well
    Train your dogs. Learn how to read your dog. Always have a collar on even if you use a harness. Take responsibility, learn about your breed, socialise your dog, spend 15-20 minutes every day working on a select few commands at least, I work my dogs for atleast 2hrs every day, but that's due to them having an owner who works with dogs, and who uses these dogs to help rehabilitate dogs with behavioral issues
    I feel for this dog who will lose its life due to the negligence of the owner. He should not be allowed to own animals ever again
    Should be some kind of "license" to own a dog, atleast certain breeds. Like a drivers license but for dogs.

    I was surprised last time that the judge accepted to call the defendent doctor, considering he is a "doctor of chiropractic" and not an MD. I think it was out of sympathy for his situation and because he felt bad he had to declare the dog dangerous and order its destruction. This time, after the Sov Cit bullshit, he is calling his mister! 😂 I like this judge!!

    This case breaks my heart! I was really really hoping something good would happen to this dog…and it’s obvious his family REALLY loves him. Coming to see him daily, bring food and treats…
    That said, something is wrong with this doggie. I do think most of the blame goes to the training he was given. But, some dogs just seem to have a couple wires crossed. So so sad but that dog really does need to be put down…😢
    PS: Mr Diota was obviously a complete liar and really made himself look bad saying “he said leave his dog alone.” BUT he wanted the dog to be able to run. Attorney was an a** and Mr Diota…and ur dog bit 3 people!!! Good god!!

      This a thing with some sovs -- I dunno whether it's machismo or paranoia, but they gravitate to what I think they see as 'war dog' breeds.
      And then of course they go as full Dunning-Kruger on dog raising as they do on pretty much the rest of life, and they produce dangerous animals.
      And then this outcome arrives and the dog has to pay the ultimate price for the humans' selfishness.
      This story has produced a depressing number of cases.

      We can find that this is a dangerous dog but also find the kennel worker grossly negligent and derelict in her duties.
      The reason for the distinction is whether or not the owner has civil liability for the kennel worker’s injuries. And I don’t think he should be liable. I also don’t think he should get the dog back.

    The defense attorney sounded more like he's trying to protect his client from civil liability, making the argument that the dog was somehow not dangerous sounded like an afterthought. I'm guessing the owner has been told by his attorney that that he might be facing some liability and that's where the SovCit thing comes in.

    Mike, I must beg to differ. Yes it's sad. Yes it's horrible. I don't like that animals are considered chattel by law any better than anyone else.
    But it is interesting and I think it would be good to follow the case to its conclusion, at least as much as possible considering the Berrien County judge may not livestream it.
    I love how Dr. Diata said you wouldn't see warning signs of you didn't know the dog. Then when asked what Miko's warning signs were: "I don't know."
    Guess he doesn't know his own dog! No wonder his DIY training didn't turn out so well!
    For the record, I'm not against people training their own dog...when they know what they're doing! Doc Borogove clearly didn't.

      I agree. My best friend was attacked by a dog (pit boxer mix) several years ago. The owners were extremely irresponsible and the way that they trained their dog (or lack of training) resulted in this dog attacking a child, then my friend. The dog had to be put down because of these incidents. The dog was not leashed or chained and ran out of the owners garage to attack my friend who was walking past the house on the sidewalk. The dog did not respond to commands to stop and had to he pulled off her by the owner. Shame on these owners who allow these incidents to happen.

      We had 3 German Shepherds and although 2 are service dogs they are also our guard dogs when we are home. The only thing they do is bark. It is a deterrent to anyone because of that, especially when I am home alone with mine. Our dogs have never growled.
      (Guard) dogs that do not bark, growl, or having hair stand on end is very very scary. No warning whatsoever.

      @@Axelsmomyeah, like if a dog is supposed to guard, I would think part of that is barking to dissuade funny business. Like the hope is that actual biting isn't necessary.
      Of course, akitas were originally bred to hunt and/or guard against bears, so I suppose it makes sense you wouldn't want the bear to be warned. But something tells me they didn't have Miko to guard against St. Joe County's, or Calhoun County's, burgeoning bear population. Since I don't think we have bears in Michigan outside of the upper peninsula. Maybe very very northern lower peninsula. but not Battle Creek or south thereof.

    I’m a huge dog lover and used to believe that any dog could be rehabilitated. That simply isn’t true. A family member got a Pyrenees mix puppy. He was properly socialized and trained by an experienced dog owner. But there was always something off about him. As he grew to well over 100 pounds he became far more dangerous. He had certain tells and triggers that would precede most attacks. But he would also attack with absolutely no provocation or indication sometimes. These attacks were like a blind, thrashing, snarling, snapping, charging rages. It was terrifying. He went after me several times. We consulted with multiple vets, trainers, behaviorists and they all eventually refused to work with him and recommended behavioral euthanasia…all of them. He also suffered from recurrent ear infections. But he would attack anyone who tried to get near his ears. Treatment was virtually impossible. Ultimately the decision was made that he had to be put down. It was extremely difficult and extremely sad. He could be very sweet at times. But he was so unpredictable and so powerful there was no other safe & ethical choice. He was going to maim or kill someone eventually

    I was a full time dog trainer for many years. Dog breeds that are bred for guarding, hunting down slaves (look it up), bear baiting, dog fighting are inherently more dangerous than those bred for rabbit hunting or duck hunting etc. it's a combination of genetics and training, but genetics will always prevail. People need to realize this before they get in over their heads like Mr sovcit here. He gets sh*t dog owner of the year. This poor kennel employee will never be the same.

    When I was a kid we had a German Shepard. We had to have him put down because he bit a teenage boy. After we put him down we found out that everyday that kid would throw rocks at our dog . The day the dog bit him the kid was playing croquet with my brother. The ball hit the dog. I said I’ll get the ball” He said “Rick knows me he won’t bite me”. Well I still miss that dog.

      When I was a kid, I was bit on my head/face by a Saint Bernard while playing with the neighbor boy. I never did anything to that dog, she got loose and the boy went into the house to tell his mom. I was afraid of the dog and went to go into the house too, and that's when she attacked me. The family had her put down. Once a dog attacks like that, you just can't trust it won't happen again.

    Didn't the initial attack take place in his presence? The fact he can't even tell when the dog is going to go off is also a huge problem. These people need to be banned from future dog ownership.
    Edit: They shouldn't have gotten the first stay. They didn't file in time. Middleton was too nice and it resulted in another attack.

      @@cleobinx Yes but they were out of time to file that stay in the first place. Middleton gave them an extension so they could file. Then another judge approved it, but it never should have gotten there.

    I would guess that the defense attorney wasn't there to argue that the dog wasn't dangerous. Judging by the way he crossed the kennel worker, I'm guessing he was hired to protect the Diatas from civil litigation. (i.e., if you can't save your dog, at least save your pocketbook).

    This dog owner is horribly negligent if he does not know his own dog, a breed he has owned for years, and cannot say what his dogs alert signs were. ANY dog has its cues, whether it be standing more alert, its ear position, its tail position, fur, sounds, etc. He also said his dog had no professional training, he trained it, and clearly his training is insufficient. Overall he is a negligent owner and I’m sorry his dog has to pay the price and I’m so sorry that two people will carry the reminders of their attacks for the rest of their lives.
    And I swear the doc was giving me motion sickness from moving around constantly!

    Akitas can be great dogs, but they can be rambunctious, very aggressive with other animals and are not real keen on strangers, and have a high prey instinct. They need serious training and socializing from the time they are very young puppies and on an ongoing basis. They are powerful dogs, and if he's dangerous, he's dangerous - let's note here that is 100% on the owner for not doing or getting the PROPER training. I'm sure no judge or prosecutor relishes the decision to put someone's beloved pet down. It's sad no matter how you slice it. 😢

      i was very concerned when the owner said he trained the dog himself but was using him as guard dog, from what i understand a real guard dog undergoes a lot of professional training. he's a chiropractor, he could afford a good dog trainer.
