    Me and the wife just yesterday received notice that her marriage based 10 year green card was approved without an interview. However, we did have an interview when we did the 2 year green card. From Pittsburgh, Pa.

      Congratulations! Can I ask when you applied for the 10 year? My spouse and I submitted the paperwork on June 1st 2019. We're also in Pittsburgh. 👋

      @@katiek4538 Hi Katie....we submitted our paperwork last July so it took a little over 10 months for us. I'm surprised you haven't heard from USCIS yet.

      That gives us some hope. My wife and I had our interview in July 2019 about two and a half years after marriage/paperwork.
      We waited and waited and recently when we called them in April 2020 they said they will be scheduling a second interview. Which doesn't make sense. It has taken them nine months to just let use know this. Based on what I am reading here we are hoping they will waive off the interview for us. Considering our first interview went smoothly I don't see any reason for them to even schedule a second one. Any input would be appreciated. Location NYC.

    I am a nurse in the Philippines. We were interviewed last year. We had undergone a medical exam before the embaasy interview and have been vaccinated. The clinic where we had our medical exam said they will just be sending the results to the embassy. But when during our interview they found out that i the principal applicant's
    medical exam was not forwarded to the embassy. Now when we were interviewed the consul said he will just wait for the arrival of my medical result . All of my 2 dependent's medical result were forwarded to the embassy. Then the consul also added that we are recommended for approval , only he will have to wait for my medical exam results for 2-3 weeks. And we repeatedly asked the consul if we are approved or not , and he said just the same we are to be recommended for approval. So i presumed that we are approved. Because our passport was also not
    returned to us. I contacted the clinic where we had a our medical exam and they said they have already forwarded it . Days laterI I checked the ceac website and I the principal applicant was on administrative processing and my 2 dependents were on a ready status. After 2 months our passports was returned to us. And after a month I received a letter that our case was returned to USCIS. In the letter it says that we were refused due to INA 221g section (5).
    My employer had filed something to the USCIS and said that w/in 60 days there will be a response , it's been 60 day and I am not able to get a response.
    Question: Is there a possibility for us to undergo a medical exam only and no embassy interview to approve w/o unde interview , only

    ME and my wife didn't go to an interview back in 2017 when she had her condition removal. Our marriage is legit in a first place. I put my wife's name in every assets we have, bills, insurance, life insurance, bank accounts. If I own something her name is included to that particular thing. I sent those documents to the USCIS when she applied for her condition removal. Same thing when she applied for her U.S. Citizenship. Everything went very smooth. Our case became more solid when we included the birth certificate of our first child.

    I just received an approval notice of my green card / AOS application (EB1A AOS). Card scheduled to arrive today. USCIS waived the interview.

    what about VAWA I-360 form can be approve faster? and after that interview wave for I-485? Married with U.S citizen

      Hi Gazelle, this is a great question. I have a client who just had his Form I-360 approved but his I-485 is still pending. I think this could go either way (either require an interview or approve without an interview). I am hoping the interview gets waived and the case gets approved!

      I got my I-360 approved last week without an interview and my I-485 is pending, I also hope it gets waived, I’ll just have to wait and see. I’ve Been waiting 2 yrs, so I advice...be patient. Wish you the best ♥️🙏🏼

    I’m a Cuban citizen and I applied for my green card based on the Cuban adjustment act. I had my second interview just before the USCIS closed due to the Covid-19. I haven’t heard anything about my case. What can I do? Can you help me? Thank you very much again !!

    My daughter's file is at NVC and we were told to waiting for interview at the USA embassy in Yaounde, for 9months, we haven't heard from them.

      There's another case, who is in the u s on students[ nonmigrant ] Visa. Her file reached the NVC, more than a year ago. What procedure do we undertake for an adjustment of status?

    my wife and i applied for removal of restrictions on her green card. we received an extension for her green card then a notice of reassignment of our case to another office and then our interview was waived, so she now has her 10 year green card. we will be applying for citizenship for her in august of this year

    It is great they waive interview. But USCIS still need to do the background check. Service appointment center for fingerprint is still close. Hope it would reopen soon.

    Thanks, I've been trying to get my wife and daughter here, It's been almost 4 years and we were denied for fraud, I'm a army veteran and my vision is poor! Navigating through this process is more difficult than a combat mission! How can we prove that our relationship is bona fide When this process is keeping us apart? I've been flying back and forth to Africa for the past three and a half years, I have a newborn daughter that is a US citizen because of my citizenship, I've been a model citizen! I'm having regrets that I served a country that won't serve me!!!

    Hello, hope you're doing well. Thank you for makeing this video. BTW, I did applied for green card thru marriage since April 2018 and I just got green card early April 2020. At the same time my husband also apply for my daughter who live in Thailandand not married also under 21 year old. Until now USCIS still didn't approved her case yet I would like to know when she'll get approve and she'll being weive for interview too? when she can fly here.

    NVC APPROVED MY DOCUMENTS AND MAIL ME THAT MUMBAI EMBASSY WILL CONTACT ME FOR INTERVIEW
    ITS BEEN 6 MONTHS DUE TO PANDEMIC
    SO WHAT WILL BE NEXT
    AND WHEN U WILL BE GET INTERVIEW LETTER

    I field a I190 application to renew my wife's green card three months ago I paid the fee of $540 on line .after that I received a letter in the mail confirming that my application is received by the USCIS however further instructions will be mailed for finger print .but yet we did not receive any further instructions By the way my wife green card is permanent 10 years card just expired three months ago .

      Hi Derek! Unfortunately, we have not seen the same thing with consular processing interviews. For consular processing, the interview is an essential step. We have not seen the consulates waive the interview requirement.

    My application was 601a I get the interview day from NVC and I went to country I was born for consulate interview I did my medical exam and I receive email from consulate 4 days before my interview was saying all interview is cancel because of the covid-19. Do you think there will reschedule the interview from who ever was first. I been a way from my family over 2 months now and I did send them email about emergency review but they send me email back and saying my case is not emergency they will give me interview days ones they reopen.     I'm a Canadian citizen trying to apply for my permit and my green card or whatever necessary paper now I've already called your office and it seems like the people that I talk to says I cannot get anything now please explain to me why I cannot get anything because I'm a Canadian but everybody else around the world is getting her papers here what is it about Canadian people who cannot fly for any paperwork here on their own

      Hi Lateefat, yes it is possible (but not guaranteed) that the parent of a U.S. citizen might have their interview waived.

    Michael, thanks for the update! Do you have any clients with pending cases that were under investigation that started getting response? Someone I know had responded to his RFE in February and hasn’t heard back ever since. Thanks!

      Hi Nayla, thank you for your question! By "under investigation," do you mean cases where an RFE (request for evidence) was issued? We have a few cases pending with RFE's issued, but we have not yet heard back on those cases. I hope this helps.

      Ashoori Law Yes, their family based application was under investigation and an RFE was issued for more evidence. Response has been provided and so far no answer from USCIS. I told them it’s a good sign at least there is no NOID. However, it would be great to know if other clients started receiving response or there is an overall air silence. Thanks for your videos!

    Hii! We filed Adjustment of Status last November and we were supposed to be interviewed for Green Card last April 13. But it was cancelled and uscis sent us a letter that says it’s cancelled and will be rescheduled. I hope they’ll just approve the green card and not require interview anymore 😂

    Hello !! Is there any news regarding E2 VISAS ? Either for applying for I-94 extensions or to renew them in the Consulate. For what I know Consulates are still closed ( I need to renew in Argentina)

      Hi Marisa, great question! USCIS is still processing extension of status applications for E2 status. To do this, your application should be filed before the expiration of your current I-94.
      If you are renewing your visa, you can apply for the renewal but the consulates are currently not conducting routine visa interviews. Also, travel to the U.S. is more challenging right now due to increased travel restrictions (aimed to slow the spread of COVID-19). Therefore, if you are in the U.S. and your status is expiring in the near future, you may wish to consider an extension of status.

    Applied for AOS EB3 category. Had our successful interview end of February.. just before the pandemic started. USCIS officer told us all is good and he will approve it. Is now 3 months later.. i assume as our priority date is not current (was current in February)..will take some time. How do we see/know that it got approved and we are just waiting for the prio date to become current ? On the USCIS website when i log into my case it still says that the interview got scheduled. Called USCIS like a month after interview.. that call was useless. Appreciate your feedback.

    Hi dear friend.thank you very much for your help .I have a question plz .I am from Morocco .my brother participated in the green card lottery and everything went well they gave him the visa approval in February he booked his ticket for march 20 .then his travel was cancelled due to the flight ban .now he has got till August before he visa will be expired and he will loose his dream to go to the US .is there any hope the ambassy will extend his visa bc it's out of his will.

    Y missed my biometrics appt due to the virus on march 31 and now my resident card got expired cause of all this virus and i have not recieved nothing on the mail no info on what to do no info when will they reopen i been waiting since march 31

    Are family based cases are waived for people who don’t currently live in the US as well? I applied for GC for my mom who’s 70 years old, in October 2019. What would her chance to get her green card without interview?

    My wife’s online status shows that we will have an interview for her 10 year green card. We have not received the letter yet. This was updated 3-4 days ago. Her two friends received their cards this week. Is it possible for this to be a mistake and the interview will be canceled?

    The waiver seems to be randomly used with employment-based visas. How is it determined who gets the waiver? Is it a lottery? Do some cases seem less believable, thus needing an interview?

    My mom is here on a B2 visa.(3years with multiple entries) she supposed to go back on May 11th 2020.but her flight has been canceled and borders has been closed as well, due to Covid-19.We did applied for visa extension(I-539)a month before the day she supposed to return. The only thing we received from the USCIS it's a notice stating that the have received the application. And nothing else since. Is she in trouble for not returning on time? if she leaves now, which action can we take for her to be able to come back in the State without any problem. Thank you.

      Hi Lina, generally if an extension of status application is filed timely, the applicant does not accrue unlawful presence while the application is pending. However, if the case is denied, and the applicant's I-94 is expired, the applicant will accrue unlawful presence from the date of the denial and their visa will likely be cancelled.     My father did an interview back in 2018 but requured additional waiver. The waivers got approved earlier this year and we recently submitted police clearance, and DS-260. Does my father need another interview or can we expect it to be approved without one?

      Hi Farzana, people outside fo the United States are still required to attend a visa interview to receive a non-immigrant or immigrant visa. As of today, the embassies and consulates are mostly not handling routine visa interviews. It is not yet clear when the consulates and embassies will resume these services.

    Thanks for the video, do you have information as to what made these cases where approvals were made without interview unique? I had an employment-based adjustment of status interview cancelled in April in Los Angeles, everything else in my case has gone smoothly, but no word from the USCIS since...

      Hi Casey, I don't have any specific data on what USCIS has considered when deciding to waive these particular interviews.     Now I have been waiting for 4 months the result about interview.

    My I-485 was sending to NBC, my visa vawa was approved in January 2020 in Vermont. In july Vermont sent to me my EAD C09 but my last name was wrong so i sent it back to Vermont with a letter explaining the mistake, my question is do i need to send a explaining letter to NBC too? Due to the EB3 retrogression in March, is to correct to assume that all EB3 based green cards AOS (whether they are filed earlier) will be put to hold until the visa number is current? How likely do you think that the 2020 October visa bulletin will have EB3 current?

      I renew my greencard I-90 last year september, six months before expiration. I’ve done my biometrics last october 5. Until now i dont recieve any reply or email. My card is already expired.

    Good day Sir Ashoori, via Emma live agent I was told that my case was transferred to FO on March 30, 2023, last reviewed on April 4th. I'm employment based (EB3-1)PD March 18, 2022, RD Jan 10, 2023. My medical and 'all' required documents were sent in. Should I expect interview to be waived, and also does last reviewed mean they are actually reviewing my case or it's now placed in a line? I am only able to see fingerprinting on my case status.

      Great question. If the EB2 NIW applicant is outside of the U.S. and is applying for an immigrant visa they will have to attend an interview. If they are in the U.S. and applying for an adjustment of status, they will still have to likely attend an interview, but there is a chance that the interview might possibly be waived (not a guarantee though).

      Hi Desiree! Thank you for subscribing and thank you for your question! It is possible that USCIS could waive the interview for a two-year green card (but not guaranteed). The waiver of these interviews is not a formal policy by USCIS. This is just something that we have observed since in-person interviews were cancelled to slow the spread of COVID-19. While it is possible that they could waive the interview requirement for a marriage based adjustment of status, it is also possible that they can wait to schedule the interview once USCIS resumes in-person interviews.     Do you know if the process is the same for citizenship? I just helped a family member file and am hoping that its a quick process so renewing their greencard( will exp in 2021) won't be neccesary.
