      It should but time and again SCOTUS and the circuit courts have ruled it does whenever the facts of a case does _not_ match the preciseness of the facts of previous cases where the courts found the cop clearly broke his qualified immunity! 😠😡🤬👿

      They might go over that at trial, but right now, we're at the procedural posture of simply figuring out which court to go to, and people have lost their GD minds over a normal court process. It makes me wonder if we should just make a law saying. If you don't have at least more than a bachelor's degree, then you can't see any court proceedings other than the main one. People forget not being educated comes with a cost.

      Qualified Immunity is literally a cop-out constructed by SCOTUS. It needs to be either explicitly eliminated entirely or VERY narrowly defined to eliminate baseless complaints against public officials.

      That’s what sucks about all of this. The news has very broad rights under the First Amendment, but saying the cop killed the victim could open them up to a defamation/libel lawsuit since it wasn’t officially declared by a court.
      Let this serve as an example at how “The Ministry of Truth” manifests itself in American society, even when we have the First Amendment to fight against such suppressions of truth.

      Catching up to other vehicles in a surveillance team does NOT constitute an emergency. Even when ANY LEO is going code they are still REQUIRED to practice due diligence.
      The DEA agent needs to be prosecuted under State law but should be found guilty regardless. NO IMMUNITY for receckless driving, period.

Had he been following a fleeing criminal and if he lost site of him the suspect could potentially escape then I could see the need for immunity but that is not the case.

      @@jondoe406 Qualified Immunity is actually at its core a pretty sensible doctrine that you can't sue an official like a clerk for doing legitimate work that happens to negatively affect you, but it has been warped and twisted by our utterly corrupt court system into a special protection for any public official against any kind of damages in any situation regardless of the facts and responsibility.
      They don't need that much protection though

      Never forget that Ms Amy Potter, a federal _prosecutor,_ is defending this DEA agent. This case is not just about one DEA agent trying to get away with murder. The entire system, including Potter and Judge McShane, is trying as hard as it can to make sure that average citizens can be slaughtered by law enforcement with absolutely no consequences. Amy Potter only cares about citizens being killed if it means she gets to step on the neck of a peasant. She is the worst of humanity and would feel very much at home in totalitarian North Korea.

      What you're not aware of is that the so-called government went private in 1933 and declared war on the American people. It has always been a corporation chartered in 1791 to manage foreign trade and protect individuals' property. What's more is the fact that the District of Columbia usurped the constitution that bound them when the CONSTITUTION OF THE UNITED STATES was counterfeited in its place. The Bill of Rights attached to the original was also usurped in place of amendments that look and sound the same but have different definitions and interpretations of language. When one claims an amendment, one claims a privilege , not a right. For some reason, i can't seem to get this "verifiable " information into the thick indoctrinated minds of the masses.

      I’d like to know a bit more information about the incident. If it was critical to speed and run stop signs, why wasn’t he utilizing a siren or lights? Was this “fentanyl dealer” an immediate threat to the public? Did the agency know the “dealer’s” home of record? Had the rest of the team lost the “dealer’s” whereabouts? If the “dealer” was that much of a threat to the community, why was the dealer out free? Negligent homicide for sure. If I am operating a forklift and I drop a load on a customer or customer’s vehicle, I am responsible for those consequences even though I am acting in my work capacity.

      The existence of the DEA is a violation of the Constitution, as is the DOJ. Neither can be found in the Articles of the Constitution that formed the government, and by their very nature, they violate the Bill of Rights just by breathing air each day.

      Some qualified immunity is a must. Every society has those. The only question is when does it end/start. I'd imagine we would fail as a society, if we cancel QI just because a law enforcement officer ran a stop sign
      without immunity, every cop would quit, or at least just stop enforcing the law, because he would be putting his life at risk just by carrying out duties. Cops would get sued 24/7 and they would be attending court hearings from every arrested individual, rather than doing their job

      You are are a little off on your definition. The charge of " murder" or homicide doesn't require intent to kill. You're thinking of first degree murder charges. Which requires you to show the killing was premeditated. Most states will have felony murder or negligent homicide laws. @@KF...

      Drugs like fentanyl are not victimless in any way. It’s impacting a lot of people and especially when mixed into other cocktail drugs. Remember George Floyd? He swallowed a speed ball which had I recall 3 times the safe limit. He did it to himself. But it was not victimless. It got cops who were following job guidelines put in prison because he was black. That impacted 3 cops lives right there. Not an over fan of cops these days, but this case was text book.
