- Recently on Twitter, somebody posted a tweet saying they bought a trademark for Garten of Banban. In this video, we'll be diving into the timeline of these events & uncover what happened.

*It’s only funny for two reasons:*
1) why in the would you release a game and not trademark anything in it, even if it’s just the title? even if you did it after release, do it the moment you see it getting any kind of attention. That was dumb on the dev’s parts.
2) they released the trademark quickly after doing it. They got it for a joke, they released it and apologized.

I can't help but find it funny that the most interesting parts of Garten of Banban are things that happen around the game rather than the game itself.
if people really hate this game so much, and think it's such an abhorrent disgrace of indie horror, then just stop giving it attention. i think it's a bad game, but i won't play it, won't rant about it, etc. it's not that hard. the internet just loves to find something to whine and moan about
People are allowed to be vocal about games they think are bad though. And if the brothers don't like criticism and block anyone who tries to explain why they think it's bad, pelple will double down.

Regarding your point at 2:50; this actually happened to the SCP universe a couple of years ago. Some Russian guy trademarked SCP and the logo, and then used the trademark to take down writers of SCPs in Russia, sell art and SCP wiki entries (that were licensed under Creative Commons), used his trademark to take down the official Russian SCP social media pages, and tried to turn the official Russian branch of the SCP wiki into an adertising/merch website.

Here's the thing about registering a trademark. Your trademark could be pending and it could still be legitimately used. Your trademark's registration could also be suspended and that wouldn't really change much either, because, in most cases, it's just them processing all the other trademarks.
Here could be the same situation, where the trademark is in the process of registration, not actually registered yet.

0:55 that is objectively wrong. In the US, you own copyright of a creation THE MOMENT YOU CREATE IT. You don’t need to file anything.
I could see Daggz actually getting in legal trouble, if he tried to make something that would replace the game in the market.
But aren't the Euphoric Brothers based in Canada? That might mess with the copyright laws but I have no idea about it, so if you do know about the copyright laws in Canada feel free to let me know

Yeah, I wanted to say this. Registering a Copyright just makes it easier when dealing with lawsuits, but is in no way a requirement to receive copyright protection. Your work is copyrighted the moment you create it, period. That's why unreleased footage/content also counts as copyrighted, because it doesn't matter if it wasn't released, it was created.

Abusing copyright isn't funny when music groups unfairly claim reviews. It isn't funny when a larger creator uses the copyright system to unfairly take down a video. It isn't funny when some random person trademarks a property that they don't own, even if it's "for the lulz"

All that happened was Daggz immediately lost the trademark and just left up the tweet cuz it was funny lol. He took it down during a stream with The Badd3st.

Garten of banban is just another random game just like any other and the fact that "its just popular" doesnt change anything at all, it could be literally any other bad horror game and thats my point, they all suck
I think the main difference is that a decent amount of people knew about the creators themselves before the game came out
@@ElFreddy508 it’s because it’s a soulless cashgrab, follow the trends of bad games before it, like Poppy’s Playtime. They have a merch link in bio, like Jake Paul and Poppy/Banban. They follow the trend of “child mascots become scary” trend, one that has outworn its welcome. It targeting kids, once more, just like Jake Paul and Poppy/Banban. And is just low quality in general.
In essence, it’s everything people hate about the “standard” modern indie game rolled into one, created the perfect storm.
If you ask me, I personally don’t care for it, nor about it. Though I think we can all agree, death threats are too far.
What we need now, IMO, is a game that tries something new, because things are starting to get repetitive. The same thing happened in the early 2010’s with Slender/Amnesia games. Then the original FNAF came out and did something new.
I for one, would love to see a new Dinosaur Survival Game in 2D. Where the major focus is evading the dinosaurs, or distracting/scaring them off. Perhaps have herbivores be more dangerous and unpredictable, like how Buffalo and Elephants are in Africa. They kill more people than Lions annually.
Garten of Banban is going to be one of those games that'll just fade into obscurity after the next super popular thing comes out. And I hope it's a much better game than this.
I mean, if someone competent has the trademark, they can probably use it to make a much better game. Game 1 and 2 could be chapter 1, and the horror aspect could focus more on liminal spaces and creeps, rather than mascot horror. They did that perfectly with the colourful hallway and office and stuff.
Frankly, I await the day I can carry the Hello Neighbor franchise so I can fix that mess. Or, y'know, make my own original game?
But I'd rather let them fix their own franchise rather than loss it.

This kind of thing happened with Shazam. In the comic book days he was called Captain Marvel, But then Marvel took the name Marvel and the name Captain Marvel. DC sued them but lost, so I think a similar thing COULD happen.
btw as far as copyright goes, garten of banban, the game, is copyrighted by the euphoric brothers. you don't need a certificate or something to hold the rights to your own intellectual property, and garten of banban, again, the game, is the intellectual property of the euphoric brothers, whether the trademark for the name is owned by some seventeen year old online or not.

I checked the Canada Trademark Office, since iirc the Euphoric Brothers are French Canadian, and there is a trademark for GOB there, by some person named in Ontario who seems to have no connection to the Euphoric Brothers from what I can see.

i thought as soon as someone made something creative it was automatically copyrighted to them? that's terrifying to think that some rando could just trademark someone's creative property and it be legal... what if someone did that to a small artist? just to piss them off? a small artist that can't pay 1000$ for a trademark, but they're working their ass off to make something like a comic or cartoon that they publish free online? i think its pretty messed up that person did that, its cool that they were just tolling and apologized, i dont think they should be betting harassment. but, im most definitely worried about what i mentioned above, as a small artist who's working on a lot of creative projects ;-;

So here is the thing, Daggz lied multiple times before saying it was a bit. Even about the trademark not being had.
Why would we even believe they paid the money for a bit when the fake photo doesn't match the sites shown?
If anything their behavior says they were trying to instigate things when they said the opposite.
It wasn't just for the funny, it was to cause genuine issues and make people panic. When facing backlash or their choices they back peddle saying it was for the funny. They didn't actually apologize either.
They apologized to the brothers... but if they didn't get the trademark or anything they didn't just cause damage to the brothers. They actually caused wide spread concern on the entire community. The community they were playing for the funny.
They could've apologized proper but they didn't and tried to push it as just a joke not taking responsibility.
Legitimate apologies won't try to push it as just a joke, they take responsibility even if the outcome wasn't as intended.

Just the concept of doing something like that is messed up in my opinion. Like I'm not really a huge fan of the games, they seem boring and incoherent, and it's certainly not the prettiest game on the planet but people seem to hate this game and its devs because it's fun to do so and that's about it. Again, the games aren't great but these guys aren't evil or malicious from what I can tell, and bad games aren't an excuse to go this far even in jest. Honestly they seem like they just want to make games people will like, ironically or otherwise. That's not worth actively messing with them like this and how they've been messed with in the past, I just don't find this funny.
I have to wonder though, if no one was laughing and the user who did this was being harshly called out for his little joke, is it truly a joke? If he's the only one laughing, and the joke is at the expensive of others who did nothing wrong, aren't laughing, and can be potentially hurt by it, can it still be considered a joke? Or is it just bullying disguised as humor? Would people have done this if FNAF was a bad game that caught on the same way Banban did? I certainly hope not.
People hate the devs with reason lmao, not only are they insufferable, whining constantly on social media or acting with a sense of superiority, but they also made a game which pokes fun at school shootings, seemingly treating them like a joke, and seeing how they're developing a sequel to said game it's not unfair to say that they feel proud about it. The hate Garten of Banban is getting stems from the fact that it is uninspired and intentionally poorly made, designed solely as a trap for children by using the genre of Mascot Horror to make a quick buck.
There's no way you compared FNAF with GOB, FNAF was the last effort to fulfill the dream of a depressed family man with financial problems that hadn't even had the opportunity to get a proper education, the game was made with love, Scott put his sweat blood and tears into it, and it paid off, GOB is, as mentioned before, a lazy cash grab (and that's not even talking about their, also poorly made, overpriced merch) made by overall deplorable people; they're getting messed with because they asked for it.
I haven’t watched a single let’s play of the game but I’ve seen 2 videos talking about how it’s bad, so think marks the third video I’ve ever seen on it
