Did a great job of not giving the viewer the truth and showing the effects of the justice system on all of its participants. This is how it is for the lawyers involved especially, when the circumstances of a case are not clear and defined. This movie raises a lot of questions about the justice system.

  • @tanthan8376

The plea rate in criminal cases is much higher than the quoted 58%. More like 85% and may be higher.
I have seen innocent people take plea deals rather than take the risk of loosing at trials and face stiffer sentences.
For those who take to trial, less than 50% get a not guilty verdict.
So it does not matter what strategy one takes when being charged criminally, the odds are stacked against that individually greatly.

This must be a shortened version of this movie. I remember seeing this movie where the defendent's attorney went to the place where the crime was committed and found that the lighting was not enough to make a perfect identification and he also brought out that the victim was under the influence of drugs. The defendant got off. Why this movie ended this way is beyond me. Where is the whole movie?

    • @doranziegler2303
      @doranziegler2303 8 років тому +3

The job of a Legal Aid attorney is not to get the accused off, their job is to make sure
the accused has the appearance of being represented. The state does not want to be
accused of railroading people, so they assign a lawyer to stand next to the accused and
hold his hand explaining what is going on.
What the state calls "representation" is a joke. Legal Aid attorneys do not put up defenses.
They are also there to grease the wheels of "justice" and to dispense each case as
quickly as possible. They never want to go to trial and very rarely do. As seen from this
movie, expedience is a top priority.
What most people do not understand is that what is called the "justice" system is in reality
a big business. The business dictates that if you have no money, you will get poor
representation. If you can afford a lawyer you will get good representation. If this movie was
a real case and the accused could have afforded a lawyer, the charges would have been
      dismissed for lack of evidence.
A word of caution to people who are represented by Legal Aid. Legal Aid lawyers are NOT
on your side. They are agents for the courts to guard against costly trials and possible
appeals. We have a system with thousands of laws, but very little justice. We have been
led to believe that justice is the primary issue in the legal system, it is not. Making money
and the APPEARANCE of "justice" are the primary issues.
Thousands of prisoners doing time state they are innocent. Every one scoffs at this as
laughable, but one look at all the prisoners who have been freed for whatever reason is
a testament that they are telling the truth. Under represented people when given a choice
between a minimum sentence as opposed to a long sentence will always opt for the
minimum. Prosecutors are like basketball players, the more points they score the better,
so they will bend the laws to obtain convictions.
If anyone wants to see one of the greatest failures of justice, just check out the millions
of foreclosure cases taking place across this country. Banks are stealing homes with the
help of local judges. Banks routinely come into court with forged documents or many times
no documents at all which are necessary to prove their right to foreclose. The judges are
ignoring hundreds of years of laws because they are corrupt and in league with the banks.
It is similar to the courts always taking the word of a lying cop over that of a civilian.
In foreclosure cases it is the judges believing the lying banks.
There is no justice, there is only law.

She's the only one lying because she lied to the Grand Jury and stated that she went to see her friend Anthony and the police investigation proved no one named Anthony lived there. Also she lied and said that she wasn't using drugs when in fact she began smoking Crack after she purchased it in the hallway. Her judgment is impaired by the Crack use, vision impaired by the cut under the eye and the dark hallway at night

I didn't get it though why he suddenly changed his mind to plea bargain when he saw her.
At first I thought he knew her from the past and they probably had misunderstanding/quarrel and he thought she's out to get her vengeance by nailing him on a crime he didn't commit. And that probably she used a different name hence he didn't know until he saw her who the accuser was.
I'm afraid I'm not explaining it well what I'm thinking...

I also thought what you mention, however the other side could just be that, because of his own feeling (extensive to all jury members), he "knew" he was going to lose the trial... or he just didn't want to fight her and just give it all a somehow "equitative" and quick ending...

I think Ms. Moore was running for Jesse. Who says to the person that's robbing you, you're going to pay? Either you're really bold or you know someone that's going to take care of it.
Where did Jesse get the money for the diapers? He said he bought them but he didn't have a job.
She does drugs but still has things she doesn't sell or part with; earrings, necklace etc. She's doing okay. She disappeared after the robbery. Because she does drugs Jesse assumed she took off or was high somewhere. He took the plea at the end because he knows her and was scared she had much, much more to tell. He knew he didn't have a chance. She feels it was his fault she was robbed and cut. Justice all the same for her even if the story is a little different. She wanted him to get more time in the end.

I was wrongfully arrested for a very serious charge in Washington state. The DA should never have charged me but things went ahead anyway. 10 years was the time I’d get if convicted at trial…I conferred with some law enforcement officials from other juridstictions(FBI,etc) and the consensus they came up with is that I had about a 20% chance to be found guilty at trial…After 4 years the DA(with tons of coercion from my top dog$40k lawyer)finally offered me a lesser charge and dropped the enhancement and the time was 365 days in Benton County jail. With good time I spent 8 months incarcerated and now I’m a convicted felon at 55 years old. Anyone can get caught up in the system…Random shit happens all the time…Ask for a lawyer immediately!!! I’ll wonder for the rest of my life if I should have went to trial…But I was so fucking frightened of spending 10 years in prison that. I chickened out…

Its not perfect, but the Best One So Far .. every time I return to the United States I kiss the ground because we hav it so good here and everyone gets a fair trial .. we are presumed Innocent and thats a preface many other countries do not giv .. they hav base, deep corruption that exceeds anything here and bribery that is shameful and transparent .. at the end he wanted the deal because he was counting on her not even showing up, and yet she did .. hence, was guilty all along ..

Why he changes his plea at the end: He sees Rosie; he sees the massive scar; and he knows a jury will feel sympathy for her and that his goose is cooked. So rather than go to trial, be found guilty, and get a long prison term, he takes the plea deal: no trial by jury and a much shorter prison term.

Without plea bargaining the entire court system would shut down. There is not enough court time and space to accommodate all the people who get charged. Prosecutors just offer deals to plead out. Plus it is incentive for people to not to go to trial. Also it provides the prosecution a sure result.

In a way the flaw remains in root on the belief of the people resolving the crime by bringing somone to justice while the case is marked as controversial. Then guilty or not everyone would respond the same. Thus one has to pray that a similar crime ( pray for a crime!!!!), would be committed while reside behind bars and the blues could link the crimes in question to seek of a truthful solution to the cases in total
