@@SnD340 When you get handed the check from the customer you take that check and call the bank its written through which is obviously their bank. Give the bank that person on the checks name and when/if asked Routing Number on the check at the bottom and the amount the check is written for and the bank will tell you if there are funds available to cover it or not right then and there. Same thing gets done at 99% of places when you write them a check if you write a check and they make you wait a few minutes before telling you your all set that's what they are doing calling and checking with the bank that the check is covered or not. Funds isn't there take the check back to the customer and inform them their check is no good and go from there. Bank tells you the check is covered tell the customer they are all set, shake their hand, and take that check directly to your bank and deposit it do NOT wait.
I set up and recover pool tables for a living. After a whole day on one job a lady tells me that she cant get her husband on the phone to confirm the payment amount we agreed on. I sat down on her couch, got real comfortable, propped my feet on the coffee table, and told her not to worry, I wasn't in any hurry, I could wait all night. She somehow managed to get her husband on the phone and get a check in my hand pretty quick.

I had a guy didn’t want to pay. He was in Jersey, I was in MD. I went through the channels to collect (a little over $800 bucks). He refused. I went to the the local city/township to press charges. While there, I saw a gigantic plaque on the wall with the names of the Mayor and Councilman who were in office when the building went up. Who was the former Mayor??? Go ahead you have one guess. So the chief calls the guy and tells him I’m in his office and ready to press charges. I had another check in 30 mins. The chief said take it to the bank and cash it. If the bank would not cash it, come back and he would arrest the former mayor. The check was cashed.
I had a landscaper that I did welding work for on his trailer and he told me to exit his property when I was done welding so he could pay me. Well, I was 2 steps ahead of him, I moved the trailer outside his property with his automatic gate closed behind me. Called, called, and called and no answer. 2 hours later, and about 5 text messages, I decided to take his trailer until he called back. Then later on, he texts me saying he has the money ready and where was I at?....I forced the guy to meet me down the street from where I was staying, or there will be a delivery charge for work that I did and also for a late payment. Sometimes you gotta do things to show them you are serious about payment.
Back in the 70's as a kid, i worked my first job on a sod farm. The owner got stiffed on a bill for sod delivered. He told me to get in the truck, and we headed to Columbus Oh and loaded up the landscapers irrigation equipment (pump, hose, and pipe) and drove home. Used that stuff in the fields for years. Second incident, he was not paid for sod installed at an apartment complex at completion of the job. He told the installers to start pulling up the sod and load it up. Magically the check appeared. My non legal advise, is repossess your work. If you install handrails, and are not paid, go back, cut it out and use it on the next job.

@@tambosnipes1652 True, I've avoided any troubles in the past by agreeing upon Cash On Delivery with clients before commencing installations. I had one instance where the client didn't pay when I arrived with fabricated components and I just started packing up, they changed their tune real fast 😂
Being a Gunsmith and sometimes Welder I "Always " get my parts and materials $$$$ upfront and on firearms if i don't get paid in full within 30 days of completion "i own it" and nothing leaves the shop that hasn't been paid for. At least this way all i have to do is eat my labor if i get screwed. I have on occasion repoed things like handrails etc. i'm not above showing up after hours and taking a battery sawsall and leaving with my work. I even had a guy enlist the help of a lawyer to get back a Mauser rifle i built for him and hadn't heard for the guy in a year with no payment. I sent the rifle back and undid everything i did to the rifle. i had drilled and tapped it for a scope. so i welded back up the holes and ground them back down and polished the action like they were never there. i put on a new bolt handle, so i took it off and gave him an un modified military bolt like he sent me stripped the bluing off the firearm and i took the barrel and put it in the lathe and drilled out the chamber i put in it etc. it went back just like how i received it in pieces. Fuck Me? No Fuck You.
I had this happen when I welded a dock leveler in place. I went round and round with the owner for payment after the check bounced. After 6 months of screwing around I went to the customer and cut the leveler back out and set it on the ground in front of the dock opening.
I took a guy to small claims once and won. Dude never paid so I went to the court clerk. She started a garnishment. When I told her the guys name, she says, "Get in line". He had 7 people garnishing his wages! It took me a year to collect $900.
Fun story from the construction field. I worked for a guy/company and we did a huge house all the windows all the siding and a bunch of other renovations. We finish the job and our boss goes out to collect payment for the finished work... The old lady that had all this work done (She also had two other contactors out there working on other things in her house along with us so she did this to at least 3 companies at the same time) comes out and tells my boss "I'm sorry but, I just filed for Bankruptcy a couple days ago so I cant pay". My boss as well as the other 3 companies pretty much was screwed with almost no options for recourse legal or otherwise. Basically just leans on her house but, that's it and no one will get anything from those till she pretty much dies and the house gets awarded to one of her family members. The either whoever gets the house will have to pay those off before getting the deed or the house could be auctioned off the pay those first. Also worked for another guy doing siding and we did a house and once it was done the lady kept telling my boss that her husband was out of town and had the checkbook.. So after about a week or so of that my boss comes to the job we are all on and tells us to load up the tools in the trucks and follow him back to that house. He asks the lady once again for the payment and same story. So my boss comes and tells us to start taking his materials back since he paid for them and they refuse to. We took 2-3 pieces off the house and her husband comes running out of the house screaming to stop and cuts my boss a check... That one was by far one of the strangest cases of not wanting to pay I ever experienced or heard of.
When I had my shop I put "bounce" checks in "for collection", what happens is as soon as enough money goes in to the account it's drawn on to cover it it gets paid FIRST, worked 99% of the time, simple and effective.
I’ve had sketchy customers. I demand COD payment from them. Once a customer told me to come back tomorrow for A check. I could tell he was not going to pay. I told him he could give me a post date a check if you need a time to come up with the money, He freaked out. I told him I wasn’t leaving the property without a police report or a check. And he wrote the check

Yes lol. An excavator boom. Also on a driveway job, a couple hundred tons of rubble. I have never, ever let people slide. Once you do it the word gets out and you will have half the town screwing you. On the flip side everyone in my community knows not to screw me. It was worth a few days in jail.
I live in Argentina and things here aren't as regulated as in the states. Someone doesn't pay you and you have to sue and hope for the best (usually takes years). Heard of someone who did a whole fence with garage gate and door. Since the guy stopped answering he put it's truck on the sidewalk, chained everything to the hitch and rang the doorbell. Got paid pretty quickly, but then again, here you can get away with something like that, perks of living in a 3rd world country
had a friend who was a fellow hvac worker. dunkin donuts put too much cream cheese on his bagel so he shut their gas meter off. lol a bit egregious but funny nonetheless
If it's a small job (not worth fighting over), arrange to meet the customer on site to get payment on the spot. If it's a really big job, arrange for a fractional payment ahead, or multiple payments along the way.

I am not a welder but enjoy watching how you fix things. This seems to me that you should do a monthly video like this in a shop setting to educate your viewers. You did a great job explaining and keeping it simple to understand. I built a small fence for a homeowner, after I called him about 20 or more times, he wouldn't answer his phone, I went to his house, he wouldn't answer the door, I left a message that Monday to pay me by Friday, no response. When Monday came. I got a 20 ft. Chain and hooks and drove to the house, I knocked on his door, no answer. I noticed that the note I left on his door was gone, so I assumed he read it. I think he was home as his car was there, I backed my truck. up to the fence, hooked my chain around the fence and ripped it out of the ground and I made sure I totally ruined as much as possible, so he couldn't straighten it out and reinstall it !! Then I left a note on his door "PAID IN FULL" I have done "small claims court", before and for $1,500.00. It's to much work with all the filing and court time and more filing fee's. I lost my labor, but he paid for the materials. He never called me !!
I had a guy bounce a 3500 dollar check in Florida. I left him a message where I stated the law where in Florida if you knowingly issue a check that bounces you can sue in small claims court and he would be liable for up to 3x the face value of the check and any court costs. He called back right away and had cash in hand that night.
I believe treble damages are generally for cases involving fraud. I suppose you could make the argument that it is fraud if the person knowingly, and for the purpose of avoiding payment, issued an NSF check. My mom owned a small boutique years ago. Most of her sales were less than $150. She would often hold a hot check for several weeks while calling the bank it was written on to verify funds. As soon as they verified, she would cash it at that bank. I think she made a couple people mad when they assumed that they had gotten away with it, then a month later their rent check bounced.
All good advice Anthony! my best advice about getting my money is this: meet as many people in town and have as good a rapport with them as humanly possible. I know everyone in my city, and everyone knows that I know everyone. I also have an impeccable reputation. The last thing any of them would want is for me to start informing the other contractors that I got screwed. That being said, I have had a couple of checks bounce on me over the years but I handled it coolly and got my money afterward (one guy paid me cash on the spot because he felt like an A-hole). After 21.5 years in business I am only out $186.00 to date and that guy went belly up so i guess he needed it more than me..

if you get a check and it bounces, just take that check to the District Attorneys office, They will collect it and add $1000 to1500 on top of it for them, if the funds were not in the account when the check was written, it gets ugly real quick but if the funds were in the account and he just put a stop payment then you have to file a theft of services case
Was killing time, n watched your video dude. I used to be a farrier n smith making custom shoes. I didn't have allot of problems but the ones I did have were doctors n lawyers n business owners that were in debt. I always tried to give the benefit of the doubt. As we all fall behind due to sickness or tough times ect. I have gone back n pulled shoes off of several horses. Yet never in harms way of the horse itself. I had one doctor that I had been asked to help a foundered horse that got into a feed bin. I made custom front shoes wide with clips ect. It took 3 months to get my money for the job. Some people are just narcissists arrogant jerks, n think because they are the privileged high class they can jerk people around. I generally never took on their needs again. I knew a guy that was renting a house to tenants, they didn't pay, so he went over and took out all the window glass. They moved fast. Another time a guy was renting a room from my mother he did not pay a few months,, she called me, i went over took all his stuff out of room and put it on the front lawn. That was that.

What happened to 'forgive those'? I have had people not pay in the past, but I let it go because I am not a greedy man. So long as I had food in my stomach and could pay the bills, all was well. They are building negative karma by not paying, leave them to their own folly, for one day it will come back on them when they least expect it. Being an old man I have known the pleasures money can bring, but they are short lived. Love and compassion are what count more than anything else, the more we fight with one another, the more problems we create. You strive to become financially free from burden, and then just as you think you've won, along comes cancer to pi$$ all over it. Live each day as if it is your last, love, share and rejoice in your inner self.
Anytime I filed a lien (They're called Mechanic's Liens here in Texas) it always worked. Even in a tenant situation. The property owner won't even be able to get a loan if their credit is checked because that lien will pop up and the finance company wants that settled before they'll loan them money. They cost $25.00 to file the last time I needed one and when I got the call that I was expecting, I told him cash only! When he showed up with the entire amount in cash, I signed the release. Don't accept a partial payment either. Hell, I'd have set up a payment plan for them if they'd told me they were strapped but it's too late for that once I've had to take out a lien. I've already made tons of phone calls by this time and sent registered or certified mail and after all of that, I just want my money. I have had to write off one job though, it was under 2K and not worth pursuing any further.
I remember hearing a story like this Tenant had work done and refused to pay which resulted in a lien.... On a 450 unit building.... Owned by a govt.-owned property company..... That he worked for.
I use contracts that break down if a check from a customer/contractor bounces a check I will charge them a $60 fee(because I get charged $30 for the bounced check), it states also that on trailers/equipment that payment is failed to be payed I have right after 90 days to sell said trailer/equipment if payment has not been payed. It also says payment is due 2/3 at the start of a job and 1/3 at completion and inspection of owner/contractor. Also it goes into detail for a break down of legal procedures that will happen if no payment is ever paid.
Gota learn the hard way being self employed. I flat out quit working for people I don't know, gota have a good reference too. There's a holes out there known as professional consumers and being able to spot bad money is huge.

I find the bigger the company the worse they are at paying there bill . Unfortunately a lot of large projects I do are so big, taking it down or away isn’t a option . I just go straight down the legal route . I always take 50% up front so if I get shafted it’s not so bad.
In Tx you file a claim in Small claims Ct . for amounts up to $10,000 ! So , if contractor doesn't show UP , judge issues a declaretory judgement in YOUR favor ! Then , you go file this judgement IN EVERY COUNTY that the person has REAL Property....He cannot sell until judgement PLUS accrued interest IS PAID !!!
If I ever get a bounced check and the customer says to redeposit I go to their bank, if check is made out to me I cash it. If it is made out to the business they will not cash it for you but you can pay them a fee of about $15 to have it converted to a cashiers check to your company. Well worth it in my opinion.
in australia and presumably in america as well there are professional debt collectors who work with small business and often they have two options either they buy the debt for a small amount like 50c on the dollar you take your money cut your losses and they chase it for you or they chase it for you and you pay the fees they have solicitors and all the paper work to chase it for you
Had it happen to me a few times. Here in England it is a slightly different process. I have never given in, taken people to court myself and won or won out of court. I refuse to let people get away with screwing me over. I save legal fees by doing all my own due process and following it to the letter of the law. But hey, l am a grump old git! 😂😂😂😂

That's a good philosophy. If you let someone screw your, it'll happen again in no time, those dbags are always looking for someone to scam and they spread the word. Doesn't matter if I have to spend 500 bucks to make you pay the 200 you owe me.
Bounced checks, states have different laws about this situation. I live in Indiana and they take a very dim view of bounced checks. Our county prosecutor has a department that their job is to go after people who write bouncing checks. I had a individual who wrote me a bad check for $50. So I went to this department in the prosecutors office to see what could been done. First I was to try and contact this person (no such luck) next to send a copy of their bounced check along with info from the bank stating check had bounced this was mailed by me registered mail. Came back to me as undelivered by the postal service. Next I took the returned letter (unopened) to the prosecutors office and they told me that they would collect the money and the charges from the bank for processing this check. They ask for my phone number and said they would call when they collected the money. It took two weeks and I was paid. from the time I received the bounced checked till I was paid it was about 6 weeks.
Well, seeing how we live in the 21st century, I do not take Checks... ever. Unless it's a certified bank note. With Cashapp, Zelle, Venmo, Google Pay, Apple thingy, etc etc there is no reason to take a check. That said though, my highest was 5K, so it's not like I am working in the big time.
Checks are actually good as long as your paid prior to leaving or releasing the item. I take checks all the time since a check clears the same day you deposit it, at night, and it absolutely cannot be disputed once it’s cleared unlike a credit card they can dispute a charge a year later and the bank automatically sides with the card holder and pulls funds out of your account temporarily until it’s proven. I had that happen and it took a month before I got all my money back. Oh and checks don’t have processing fees like credit cards do
as a single manager(with ein) llc, sole proprietor, even an s-corp you are the person out front so you had better learn to read the client in front of you. i have been at it for decades and am in the process of calling it quits. there are certain groups i will not work for, there are certain jobs i know that the customer is weak and will be a problem. these skills do not come to you overnight, it is a learning process. on a couple of occasions i have had to negotiate on a price because the customer felt there was a problem or there was a miscommunication. i bite the bullet (within reason) and move on. however, as a solo operator, in the course of your work life, you are going to have people come to you and want to partner up. don't go there, stay small, if you want to go bigger do it alone. you can avoid lawyers and depositions that way.
Small claims is a joke in Texas. We are a “judgement proof” state. That means that if you sue an individual and win, their property or income cannot be seized/garnished… on the other hand if you sue a business and they don’t pay the constable can literally, no BS, chain the doors shut and hold a public auction to sell your property until the debt is satisfied… 🤦♂️ oh and I sued an individual one time who skipped out on a payment to me, he failed to show up to the court date, and the judge STILL found in their favor even though I had a signed agreement because the judge “couldn’t verify that was his signature”… last time I wasted my time on kangaroo court
Here if you get a bad check give them a legal 10 day notice and take it straight to police and they will follow up and send to prosecutor. I’ve done it a couple times.
I welded a bucket on for a guy and he didn’t pay after a few weeks I when to his job at night and took my plasma cutter and cut the whole bucket off. I was thinking about cutting a Square out of his excavator boom to really make him mad lol

My grandfather had this cliënt who didn't pay for s long time. Nu grandfather went to his wedding and started opening envelopes with cash people had hiven the newly weds. Kept opening envelopes untill the bill + previous legal costs were covered. The customer didnt like it and got involved with it. My grandfather presented him with a black eye and the newly added bill for the previous legal costs.
Perks to being a pipe welder. Usually working for multi million/billion dollar outfits that always pay. $1000/day every day. I couldn’t imagine chasing jobs every day to small clients hoping they pay for that 2 hour job I did 3 weeks ago haha

I was the quickest and the best on the job !! 😎 I have my mobile equipment welding business for many years now! I am blessed to have the customers I do because they chase me down to pay me a lot of times.. I specialize in heavy Earth moving equipment welding.. Fly by the nightt coal stripping Companies are they worst to deal with Getting paid ! Daily work daily pay ! Call the bank and verify the check each day! All of my other customers I do not have to worry about ! Love my job !! American pride !!! *"AMEN "* !!!
No one should accept checks anymore. Most businesses wont take them. Always charge a deposit up front to cover costs and never accept a job from someone who won't follow your payment schedule.
I won't leave the job site. My understanding is, as long as you're on the job site it's criminal once you leave its civil. As the job progress i'll check in with the customer (pro-tip drop some bad news around finances for see if they flinch).
You should consult a lawyer once a year to validate your plan (laws change). In my state that would take a trespass to a criminal trespass pretty quickly. In addition a bounced check is criminal in my state (most states as far as I know). So in a situation with a bounced check the state has an interest and I would have my civil interest. That is some decent leverage. A criminal trespass gives the other guy leverage against me. I'm not keen on that.
@@ShainAndrews I'm not sure how you'd get criminal trespass if you were requested to be onsite? A check written from a closed account is criminal but a check written from insufficient funds isn't. The thing to remember is you're going to have to be willing to make a scene and review your situation with law enforcement. Having their signature on a paper copy of your terms of services is a huge advantage if you want the thief to be arrested for "Theft of Services" on the spot.

@@ShainAndrews They can't prove someone willing wrote a bad check, intent, unless the person says so. I don't think you've been involved in many less than ideal situations.
I'm not sure how it works in all states but "Theft of Services" is an actual criminal, arrestable offense in Alabama. You simply call 911, they will send an officer, then tell them you want to press Theft of Services charges against the person, They will be arrested on the spot. I'm not sure how this works with just a bounced check though. The couple of times we had to do it, the customer stood right there after the job was completed and said they were not paying. One time we were involved in moving a 6-bedroom household 2 states away, and the other time we worked for 2 weeks on a guy's 4-story business replacing and setting up every single computer system in the building. Neither person got arrested though. Once the cop said "Place your hands behind your back", they decided they would pay after all.
I dont know if anyone mentioned this before but collections may be an option. Often, they will buy the debt from you at a discounted rate and attempt to collect on it. This way, if they cannot collect, they can pursue civil suit. This is also a good way to convert bad debt into at least some revenue.
Never go and destroy the work if they dont pay. Even though you did the work, its their property. I know people who went and tore out things they installed and not only did they get arrested for destroying private property, they had to replace and pay another contractor to reinstall what they tore out.
If a check bounces it’s a legal issue and you could report it to the police. Maybe threaten them with that and if they don’t pay have them cops do the work.
Checks? In 2022? Down here in OZ the digital cashless society has arrived ,and all of my customers get an invoice which has clear instructions on how to pay electronically (with x number of days to pay) .I haven't written a check or Cheque in 20 years. I haven't received one in 15 years. A lot of businesses here won't even accept them .

In Newhampshire it's criminal to write a bad check. They will get jail time just for writing the bad check. This much I know... not easy working for your self. I have tried. It has never worked out.
Lawyer fees add up quick and no one wants to pay thousands to potentially recover hundreds. And the thieves posing as businessmen, know this. One supplier in our town would put up anyone's name, a copy of the bounced check at a conspicuous place at the customer desk. Word soon got around who was trustworthy and who was not.
The one thing you didn't mention is getting paid upfront with cash or certified funds BEFORE you do the job. Where is it written that the customer gets to pay for a job after it's done? Sorry, if it's a first-time job with someone new I always say cash upfront until you establish credit with my company and that takes several jobs and a full credit check. One other avenue you didn't mention is they deposit the full amount in an Escrow account. They pay 100% in the Escrow account and any fees for that are paid by the buyer in lieu of cash or certified check. I've been doing business this way for 30 years and have never been stiffed for a dime. If they have a problem with any of my rules, then they are the people that would have stiffed me. Honest people don't have a problem dealing honestly upfront. Small claims court does not guarantee you get the money.
Sort of related to guys getting screwed over. The place my buddy works at laid off all their highest time welders because they were tired of paying for all their accumulated vacation time and topped out wages (some of these guys had 25 years at the company). Then they waited until the recall date passed and hired them back at the bottom of the scale. Right back at square one. The guys actually took the job and went back to work like nothing happened. I'd be way too tempted to go back and fuck some shit up.
Writing a bad check is criminal! Never post date a bill,always for the date the work was done. Call state police ,you may have to send registered mail and then police can arrest the persons! They'll come up with the cash then ,in full only!!!
I went to welding school, while working full time, and finished number 1 in my class... everywhere I go to get a welding job “I don’t have enough experience” so I have since bought a welder, and work out of a shed.... I’ve had family members come and pay me.... but EVERY job I’ve done for a stranger I’ve been stiffed, or shorted.... or ghosted.... no complaints... most LOVE the work... every happy, I get a feeling they think I CANT fix the rusted piece of shit item they brought, and are surprised as fuck that I was able to do what I did, and never had ANY intention of actually paying....
Great fucking information, most of the time these larger businesses are dependent on the people who work in their accounting department or are just too busy and don't realize they haven't paid the bill yet. Great algorithm to not burn any bridges and doesn't make you look like a dick to your customers.
Listen up! To all the young bucks: "Get your money in thirds" and make a contract, don't use a boiler plate contract. One third in advance, one third on arrival, one third on completion. Emphasize that in the contract and that this format must be adhered to or work will stop. Period! For little jobs, don't bother and move on. Money is a river flowing through your hands. Don't get attached to it.

Bank tells you the check is covered tell the customer they are all set, shake their hand, and take that check directly to your bank and deposit it do NOT wait.

I set up and recover pool tables for a living. After a whole day on one job a lady tells me that she cant get her husband on the phone to confirm the payment amount we agreed on. I sat down on her couch, got real comfortable, propped my feet on the coffee table, and told her not to worry, I wasn't in any hurry, I could wait all night. She somehow managed to get her husband on the phone and get a check in my hand pretty quick.

I had a guy didn’t want to pay. He was in Jersey, I was in MD. I went through the channels to collect (a little over $800 bucks). He refused. I went to the the local city/township to press charges. While there, I saw a gigantic plaque on the wall with the names of the Mayor and Councilman who were in office when the building went up. Who was the former Mayor??? Go ahead you have one guess. So the chief calls the guy and tells him I’m in his office and ready to press charges. I had another check in 30 mins. The chief said take it to the bank and cash it. If the bank would not cash it, come back and he would arrest the former mayor. The check was cashed.

I had a landscaper that I did welding work for on his trailer and he told me to exit his property when I was done welding so he could pay me. Well, I was 2 steps ahead of him, I moved the trailer outside his property with his automatic gate closed behind me. Called, called, and called and no answer. 2 hours later, and about 5 text messages, I decided to take his trailer until he called back. Then later on, he texts me saying he has the money ready and where was I at?....I forced the guy to meet me down the street from where I was staying, or there will be a delivery charge for work that I did and also for a late payment. Sometimes you gotta do things to show them you are serious about payment.
Back in the 70's as a kid, i worked my first job on a sod farm. The owner got stiffed on a bill for sod delivered. He told me to get in the truck, and we headed to Columbus Oh and loaded up the landscapers irrigation equipment (pump, hose, and pipe) and drove home. Used that stuff in the fields for years. Second incident, he was not paid for sod installed at an apartment complex at completion of the job. He told the installers to start pulling up the sod and load it up. Magically the check appeared. My non legal advise, is repossess your work. If you install handrails, and are not paid, go back, cut it out and use it on the next job.
There are laws that prevent you from destroying property and usally judges side on the owners of the property side

Being a Gunsmith and sometimes Welder I "Always " get my parts and materials $$$$ upfront and on firearms if i don't get paid in full within 30 days of completion "i own it" and nothing leaves the shop that hasn't been paid for. At least this way all i have to do is eat my labor if i get screwed. I have on occasion repoed things like handrails etc. i'm not above showing up after hours and taking a battery sawsall and leaving with my work. I even had a guy enlist the help of a lawyer to get back a Mauser rifle i built for him and hadn't heard for the guy in a year with no payment. I sent the rifle back and undid everything i did to the rifle. i had drilled and tapped it for a scope. so i welded back up the holes and ground them back down and polished the action like they were never there. i put on a new bolt handle, so i took it off and gave him an un modified military bolt like he sent me stripped the bluing off the firearm and i took the barrel and put it in the lathe and drilled out the chamber i put in it etc. it went back just like how i received it in pieces. Fuck Me? No Fuck You.

I had this happen when I welded a dock leveler in place. I went round and round with the owner for payment after the check bounced. After 6 months of screwing around I went to the customer and cut the leveler back out and set it on the ground in front of the dock opening.
I took a guy to small claims once and won. Dude never paid so I went to the court clerk. She started a garnishment. When I told her the guys name, she says, "Get in line". He had 7 people garnishing his wages! It took me a year to collect $900.
You can also garnish directly from a person's bank account
Fun story from the construction field. I worked for a guy/company and we did a huge house all the windows all the siding and a bunch of other renovations. We finish the job and our boss goes out to collect payment for the finished work... The old lady that had all this work done (She also had two other contactors out there working on other things in her house along with us so she did this to at least 3 companies at the same time) comes out and tells my boss "I'm sorry but, I just filed for Bankruptcy a couple days ago so I cant pay".
My boss as well as the other 3 companies pretty much was screwed with almost no options for recourse legal or otherwise. Basically just leans on her house but, that's it and no one will get anything from those till she pretty much dies and the house gets awarded to one of her family members. The either whoever gets the house will have to pay those off before getting the deed or the house could be auctioned off the pay those first.
Also worked for another guy doing siding and we did a house and once it was done the lady kept telling my boss that her husband was out of town and had the checkbook.. So after about a week or so of that my boss comes to the job we are all on and tells us to load up the tools in the trucks and follow him back to that house. He asks the lady once again for the payment and same story. So my boss comes and tells us to start taking his materials back since he paid for them and they refuse to. We took 2-3 pieces off the house and her husband comes running out of the house screaming to stop and cuts my boss a check... That one was by far one of the strangest cases of not wanting to pay I ever experienced or heard of.
When I had my shop I put "bounce" checks in "for collection", what happens is as soon as enough money goes in to the account it's drawn on to cover it it gets paid FIRST, worked 99% of the time, simple and effective.

I told him he could give me a post date a check if you need a time to come up with the money, He freaked out. I told him I wasn’t leaving the property without a police report or a check. And he wrote the check

Yes lol. An excavator boom. Also on a driveway job, a couple hundred tons of rubble. I have never, ever let people slide. Once you do it the word gets out and you will have half the town screwing you. On the flip side everyone in my community knows not to screw me. It was worth a few days in jail.

I live in Argentina and things here aren't as regulated as in the states. Someone doesn't pay you and you have to sue and hope for the best (usually takes years). Heard of someone who did a whole fence with garage gate and door. Since the guy stopped answering he put it's truck on the sidewalk, chained everything to the hitch and rang the doorbell. Got paid pretty quickly, but then again, here you can get away with something like that, perks of living in a 3rd world country
had a friend who was a fellow hvac worker. dunkin donuts put too much cream cheese on his bagel so he shut their gas meter off. lol a bit egregious but funny nonetheless
If it's a small job (not worth fighting over), arrange to meet the customer on site to get payment on the spot. If it's a really big job, arrange for a fractional payment ahead, or multiple payments along the way.

I am not a welder but enjoy watching how you fix things. This seems to me that you should do a monthly video like this in a shop setting to educate your viewers. I built a small fence for a homeowner, after I called him about 20 or more times, he wouldn't answer his phone, I went to his house, he wouldn't answer the door,
I left a message that Monday to pay me by Friday, no response.
When Monday came.
I got a 20 ft. Chain and hooks and drove to the house, I knocked on his door, no answer.
I noticed that the note I left on his door was gone, so I assumed he read it.
I think he was home as his car was there,
I backed my truck. up to the fence, hooked my chain around the fence and ripped it out of the ground and I made sure I totally ruined as much as possible, so he couldn't straighten it out and reinstall it !!
Then I left a note on his door
"PAID IN FULL"
I have done "small claims court", before and for $1,500.00. It's to much work with all the filing and court time and more filing fee's.
I lost my labor, but he paid for the materials. He never called me !!
I had a guy bounce a 3500 dollar check in Florida. I left him a message where I stated the law where in Florida if you knowingly issue a check that bounces you can sue in small claims court and he would be liable for up to 3x the face value of the check and any court costs. He called back right away and had cash in hand that night.

I believe treble damages are generally for cases involving fraud. I suppose you could make the argument that it is fraud if the person knowingly, and for the purpose of avoiding payment, issued an NSF check. My mom owned a small boutique years ago. Most of her sales were less than $150. She would often hold a hot check for several weeks while calling the bank it was written on to verify funds. As soon as they verified, she would cash it at that bank. I think she made a couple people mad when they assumed that they had gotten away with it, then a month later their rent check bounced.

my best advice about getting my money is this: meet as many people in town and have as good a rapport with them as humanly possible.
I know everyone in my city, and everyone knows that I know everyone. I also have an impeccable reputation. The last thing any of them would want is for me to start informing the other contractors that I got screwed.
That being said, I have had a couple of checks bounce on me over the years but I handled it coolly and got my money afterward (one guy paid me cash on the spot because he felt like an A-hole).
After 21.5 years in business I am only out $186.00 to date and that guy went belly up so i guess he needed it more than me..

if you get a check and it bounces, just take that check to the District Attorneys office, They will collect it and add $1000 to1500 on top of it for them, if the funds were not in the account when the check was written, it gets ugly real quick but if the funds were in the account and he just put a stop payment then you have to file a theft of services case

Was killing time, n watched your video dude. I used to be a farrier n smith making custom shoes. I didn't have allot of problems but the ones I did have were doctors n lawyers n business owners that were in debt. I always tried to give the benefit of the doubt. As we all fall behind due to sickness or tough times ect. I have gone back n pulled shoes off of several horses. Yet never in harms way of the horse itself.
I had one doctor that I had been asked to help a foundered horse that got into a feed bin. I made custom front shoes wide with clips ect. It took 3 months to get my money for the job. Some people are just narcissists arrogant jerks, n think because they are the privileged high class they can jerk people around. I generally never took on their needs again. I knew a guy that was renting a house to tenants, they didn't pay, so he went over and took out all the window glass. They moved fast. Another time a guy was renting a room from my mother he did not pay a few months,, she called me, i went over took all his stuff out of room and put it on the front lawn. That was that.

What happened to 'forgive those'? I have had people not pay in the past, but I let it go because I am not a greedy man. So long as I had food in my stomach and could pay the bills, all was well. They are building negative karma by not paying, leave them to their own folly, for one day it will come back on them when they least expect it. Being an old man I have known the pleasures money can bring, but they are short lived. Love and compassion are what count more than anything else, the more we fight with one another, the more problems we create. You strive to become financially free from burden, and then just as you think you've won, along comes cancer to pi$$ all over it. Live each day as if it is your last, love, share and rejoice in your inner self.

Anytime I filed a lien (They're called Mechanic's Liens here in Texas) it always worked. Even in a tenant situation. The property owner won't even be able to get a loan if their credit is checked because that lien will pop up and the finance company wants that settled before they'll loan them money. They cost $25.00 to file the last time I needed one and when I got the call that I was expecting, I told him cash only! When he showed up with the entire amount in cash, I signed the release. Don't accept a partial payment either. Hell, I'd have set up a payment plan for them if they'd told me they were strapped but it's too late for that once I've had to take out a lien. I've already made tons of phone calls by this time and sent registered or certified mail and after all of that, I just want my money.
I have had to write off one job though, it was under 2K and not worth pursuing any further.

Thanks for sharing this with us. A number of us may be hobbyists...but the info you shared may one day be beneficial should the situation arise.
I use contracts that break down if a check from a customer/contractor bounces a check I will charge them a $60 fee(because I get charged $30 for the bounced check), it states also that on trailers/equipment that payment is failed to be payed I have right after 90 days to sell said trailer/equipment if payment has not been payed. It also says payment is due 2/3 at the start of a job and 1/3 at completion and inspection of owner/contractor. Also it goes into detail for a break down of legal procedures that will happen if no payment is ever paid.
You should write this contract up and post it so others can use it, I know I would love to have that
Gota learn the hard way being self employed. I flat out quit working for people I don't know, gota have a good reference too. There's a holes out there known as professional consumers and being able to spot bad money is huge.

I find the bigger the company the worse they are at paying there bill . Unfortunately a lot of large projects I do are so big, taking it down or away isn’t a option . I just go straight down the legal route . I always take 50% up front so if I get shafted it’s not so bad.

In Tx you file a claim in Small claims Ct . for amounts up to $10,000 ! So , if contractor doesn't show UP , judge issues a declaretory judgement in YOUR favor ! Then , you go file this judgement IN EVERY COUNTY that the person has REAL Property....He cannot sell until judgement PLUS accrued interest IS PAID !!!
If I ever get a bounced check and the customer says to redeposit I go to their bank, if check is made out to me I cash it. If it is made out to the business they will not cash it for you but you can pay them a fee of about $15 to have it converted to a cashiers check to your company. Well worth it in my opinion.

in australia and presumably in america as well there are professional debt collectors who work with small business and often they have two options either they buy the debt for a small amount like 50c on the dollar you take your money cut your losses and they chase it for you or they chase it for you and you pay the fees they have solicitors and all the paper work to chase it for you
Had it happen to me a few times. Here in England it is a slightly different process.
I have never given in, taken people to court myself and won or won out of court.
I refuse to let people get away with screwing me over. I save legal fees by doing all my own due process and following it to the letter of the law.

Bounced checks, states have different laws about this situation. I live in Indiana and they take a very dim view of bounced checks. Our county prosecutor has a department that their job is to go after people who write bouncing checks. I had a individual who wrote me a bad check for $50. So I went to this department in the prosecutors office to see what could been done. First I was to try and contact this person (no such luck) next to send a copy of their bounced check along with info from the bank stating check had bounced this was mailed by me registered mail. Came back to me as undelivered by the postal service. Next I took the returned letter (unopened) to the prosecutors office and they told me that they would collect the money and the charges from the bank for processing this check. They ask for my phone number and said they would call when they collected the money. It took two weeks and I was paid. from the time I received the bounced checked till I was paid it was about 6 weeks.
Well, seeing how we live in the 21st century, I do not take Checks... ever. Unless it's a certified bank note. With Cashapp, Zelle, Venmo, Google Pay, Apple thingy, etc etc there is no reason to take a check. That said though, my highest was 5K, so it's not like I am working in the big time.
Checks are actually good as long as your paid prior to leaving or releasing the item. I take checks all the time since a check clears the same day you deposit it, at night, and it absolutely cannot be disputed once it’s cleared unlike a credit card they can dispute a charge a year later and the bank automatically sides with the card holder and pulls funds out of your account temporarily until it’s proven. I had that happen and it took a month before I got all my money back. Oh and checks don’t have processing fees like credit cards do
as a single manager(with ein) llc, sole proprietor, even an s-corp you are the person out front so you had better learn to read the client in front of you.
i have been at it for decades and am in the process of calling it quits. there are certain groups i will not work for, there are certain jobs i know that the customer is weak and will be a problem. these skills do not come to you overnight, it is a learning process. on a couple of occasions i have had to negotiate on a price because the customer felt there was a problem or there was a miscommunication. i bite the bullet (within reason) and move on. however, as a solo operator, in the course of your work life, you are going to have people come to you and want to partner up. don't go there, stay small, if you want to go bigger do it alone. you can avoid lawyers and depositions that way.

Small claims is a joke in Texas. We are a “judgement proof” state. That means that if you sue an individual and win, their property or income cannot be seized/garnished… on the other hand if you sue a business and they don’t pay the constable can literally, no BS, chain the doors shut and hold a public auction to sell your property until the debt is satisfied… 🤦♂️ oh and I sued an individual one time who skipped out on a payment to me, he failed to show up to the court date, and the judge STILL found in their favor even though I had a signed agreement because the judge “couldn’t verify that was his signature”… last time I wasted my time on kangaroo court

Here if you get a bad check give them a legal 10 day notice and take it straight to police and they will follow up and send to prosecutor. I’ve done it a couple times.
This has happened to me twice. I let them both know that I could remove my work even faster than I put it in. I was paid Very quickly.

No one should accept checks anymore. Most businesses wont take them. Always charge a deposit up front to cover costs and never accept a job from someone who won't follow your payment schedule.
I won't leave the job site. My understanding is, as long as you're on the job site it's criminal once you leave its civil. As the job progress i'll check in with the customer (pro-tip drop some bad news around finances for see if they flinch).
You should consult a lawyer once a year to validate your plan (laws change). In my state that would take a trespass to a criminal trespass pretty quickly. In addition a bounced check is criminal in my state (most states as far as I know). So in a situation with a bounced check the state has an interest and I would have my civil interest. That is some decent leverage. A criminal trespass gives the other guy leverage against me. I'm not keen on that.
@@ShainAndrews I'm not sure how you'd get criminal trespass if you were requested to be onsite? A check written from a closed account is criminal but a check written from insufficient funds isn't. The thing to remember is you're going to have to be willing to make a scene and review your situation with law enforcement. Having their signature on a paper copy of your terms of services is a huge advantage if you want the thief to be arrested for "Theft of Services" on the spot.

Bad check go to court and you will get a judgment against them all it means is that they owe you doesn't mean you get paid

I'm not sure how it works in all states but "Theft of Services" is an actual criminal, arrestable offense in Alabama. You simply call 911, they will send an officer, then tell them you want to press Theft of Services charges against the person, They will be arrested on the spot. I'm not sure how this works with just a bounced check though. The couple of times we had to do it, the customer stood right there after the job was completed and said they were not paying. One time we were involved in moving a 6-bedroom household 2 states away, and the other time we worked for 2 weeks on a guy's 4-story business replacing and setting up every single computer system in the building. Neither person got arrested though. Once the cop said "Place your hands behind your back", they decided they would pay after all.
I dont know if anyone mentioned this before but collections may be an option. Often, they will buy the debt from you at a discounted rate and attempt to collect on it. This way, if they cannot collect, they can pursue civil suit. This is also a good way to convert bad debt into at least some revenue.
You can look up holder in due course rule, it's related to buying of bad debts.

Never go and destroy the work if they dont pay. Even though you did the work, its their property. I know people who went and tore out things they installed and not only did they get arrested for destroying private property, they had to replace and pay another contractor to reinstall what they tore out.
If a check bounces it’s a legal issue and you could report it to the police. Maybe threaten them with that and if they don’t pay have them cops do the work.
Some cities won't take action unless it's 500K or above or involves a mass amount of people.

Down here in OZ the digital cashless society has arrived ,and all of my customers get an invoice which has clear instructions on how to pay electronically (with x number of days to pay) .I haven't written a check or Cheque in 20 years. In Newhampshire it's criminal to write a bad check. They will get jail time just for writing the bad check. This much I know... not easy working for your self. I have tried. It has never worked out.
In Florida you can file lean on property if you are working for contractors even if you were repair ng equipment used to do job

One supplier in our town would put up anyone's name, a copy of the bounced check at a conspicuous place at the customer desk. Word soon got around who was trustworthy and who was not.
The one thing you didn't mention is getting paid upfront with cash or certified funds BEFORE you do the job. Where is it written that the customer gets to pay for a job after it's done? Sorry, if it's a first-time job with someone new I always say cash upfront until you establish credit with my company and that takes several jobs and a full credit check. One other avenue you didn't mention is they deposit the full amount in an Escrow account. They pay 100% in the Escrow account and any fees for that are paid by the buyer in lieu of cash or certified check. I've been doing business this way for 30 years and have never been stiffed for a dime. If they have a problem with any of my rules, then they are the people that would have stiffed me. Honest people don't have a problem dealing honestly upfront. Small claims court does not guarantee you get the money.
Escrow is great advice for large jobs. You know the money actually exists
I use arvest bank and I always take a pic of it and deposit it right then and you know within a few minutes...
Sort of related to guys getting screwed over. The place my buddy works at laid off all their highest time welders because they were tired of paying for all their accumulated vacation time and topped out wages (some of these guys had 25 years at the company). Then they waited until the recall date passed and hired them back at the bottom of the scale. Right back at square one.
The guys actually took the job and went back to work like nothing happened.
I'd be way too tempted to go back and fuck some shit up.

Writing a bad check is criminal! Never post date a bill,always for the date the work was done. Call state police ,you may have to send registered mail and then police can arrest the persons! They'll come up with the cash then ,in full only!!!
I went to welding school, while working full time, and finished number 1 in my class... everywhere I go to get a welding job “I don’t have enough experience” so I have since bought a welder, and work out of a shed.... I’ve had family members come and pay me.... but EVERY job I’ve done for a stranger I’ve been stiffed, or shorted.... or ghosted.... no complaints... most LOVE the work... every happy, I get a feeling they think I CANT fix the rusted piece of shit item they brought, and are surprised as fuck that I was able to do what I did, and never had ANY intention of actually paying....

Great fucking information, most of the time these larger businesses are dependent on the people who work in their accounting department or are just too busy and don't realize they haven't paid the bill yet. Great algorithm to not burn any bridges and doesn't make you look like a dick to your customers.
If it has to be filed 45 days after start of work or whatever and they tell you they are a net 60 company up front

Listen up! To all the young bucks: "Get your money in thirds" and make a contract, don't use a boiler plate contract. One third in advance, one third on arrival, one third on completion. Emphasize that in the contract and that this format must be adhered to or work will stop. Period! For little jobs, don't bother and move on. Money is a river flowing through your hands. Don't get attached to it.
