      Paternity test should be mandatory at the birth of every child. It sounds like this chick was just baby trapping him.
      Part of the reason I believe that dude should get a vasectomy as young as possible. And then get it reversed if you want to have children.
      Don't be holding the bag for some chick who was a good lay Maybe a few days out of your life.

      Which is why he needs to hurry and divorce her. Each passing day adds up to another year that she eventually can claim in the divorce when nothing legal is on file to move to a dissolution of the marriage.

    She wasnt talking to a guy "a couple days later" this has been on going for months but she kept quiet about it to have her husband as a back up while she waited to see where the new fling would lead to, the sudden "being done" is the byproduct of months of infidelity and the idea that she thinks she's found something more valuable than her current standing

      Absolutely. The decision doesn’t come first and then suddenly you have a new relationship right away. She simply stopped hiding it from him once she told him she was done and he is such a kind hearted dude to his detriment he believes that it just started. The same thing just happened to a friend of mine and similarly his wife doesn’t work and wanted to remain in their home despite the ending of things. It just sucks to see

    My ex-wife did this, too. She even went so far as to say she wanted to divorce me but still live together so I could support her. I yanked the rug out from under her and she lost everything. Now her side piece is stuck supporting her while she pays me child support. This guy needs to do the same.

    I had the same thing happen. He needs to hire a lawyer and get tough. He needs to demand the house, full custody and child support from her. She needs to get an apartment not him. The one who cheats moves out.

      @@shachede6828 Statistically men only receive child support 15% of the time. Female payments are 56% less on average than males. There are unlimited programs and resources for single mothers. Men get thrown in jail for failing to pay. Times have not changed.

      First rule: Get a proper attorney.
      Here are the FACTS based on the LAW:
      If you have enough reason to suspect that your wife is pregnant with a child who isn’t yours, an attorney can help you establish your grounds for adultery.
      When it comes to proving this, you have a few options:
      You have a paternity test with an accuracy of at least 98 percent
      Proof of cohabitation, adultery, and enough circumstantial evidence to support your claim
      IF you divorce your wife on the grounds of adultery, the same will be mentioned in the final divorce order. The court will usually NOT impose permanent alimony in the event of a finding of adultery. MOREOVER, if your wife is pregnant with someone else’s child, the court may not impose child support depending on the circumstances and whether you are able to establish that you are not the father.

      You can tell all she was doing was baby trapping him. For the money. This is part of the reason I think you could solve a lot of these problems by just getting a vasectomy at 18. Maybe even younger.
      Then if you find the right person just get it reversed.

      Similar mind set to my ex when i was in the military. Wife wanted to move back home with her friends bc she was so unhappy with me but conveniently wanted to stay married. Told her i wouldn't keep her and our kid there unhappy for 2 more years but we were getting divorced b4 she moved states to protect my parental rights.

    My ex husband wanted a divorce and stay in the house. It was so incredibly painful to see him everyday interacting with kids and going thru the divorce. It lasted a month I asked him to leave. It was the first step toward healing. I wish him the best It does get better. ❤

      In New Zealand you have to be separated and living apart for 2 years before you can actually apply for divorce, and I think that's a very good idea

      In my state you CANNOT live together and get a divorce because the court assumes that you're cohabiting (sleeping together), and cohabiting invalidates the divorce process. Stops it cold.

      Maybe the time could be a bit less, but it makes sure that nobody is blindsided by a divorce that they didn't see coming, and makes sure the divorcer is committed to the decision.
      Not that divorce is quick and easy, but being able to notify someone that they are being divorced by handing them some papers doesn't seem right to me

    She's busy talking to other men so she has a place to go next in case you do make her leave. Get a lawyer asap and protect your child. He doesn't need to be with a mom who's house hopping, man hopping and unstable. Be prepared to stand strong when she comes back later wanting you back because she realized the grass isn't greener.

      I’ve been called for jury duty dealing with post divorce issues several times including
      paternity by estoppel with single mothers.
      You’ll be surprised what a judge and a nasty lawyer can do in a courtroom.

    You need to file for divorce and petition custody. I went through a divorce at 24 and my wife wanted to do the same thing. Luckily we didn't have a kid involved, but there's no way you can properly grieve or move on when the person who did/is doing this is living in the room next door.

      This is why I say that every man as young as safely possible should get a vasectomy. You can always reverse it later when they want to have children.
      But that would effectively alleviate the woman from having to take a bunch of birth control chemicals.
      Plus dude wouldn't be getting baby trapped.
      Side note. At the birth of every child there should be a paternity test. Maybe two or three paternity test.
      Get rid of the welfare and social security as well.. and watch how quickly people start solving their own problems.
      There has to be more incentives to keep something working together versus tearing it apart.
      America's currently a tear it apart disposable relationship country.

My nephew takes them to all events for school pays for everything and is teaching them to cook, clean and now they are driving age. He is raising amazing twin girls.     What I love about this show is Dave is very honest and not afraid to tell the callers the truth. Poor guy he doesn't realize she wants the house and bring her lover in later. She knows what she wants take everything he's got and played him. Unfortunately he's too naive. He needs to get a lawyer and get her out ASAP.     I had to deal with almost the exact same situation! She started "staying the night at her mother's house," meaning she was already seeing someone else. I told her on the second weekend that this was unacceptable. She could live with me and be with me, or she could move the he*l out of my house! She showed up Sunday with a moving truck. Turns out she was already planning on moving.

    Dave, Why was your advice not, "First , get a good Lawyer! Find out what your options really are." My Son just went through a difficult divorce. The best thing he did was to get a good lawyer. He actually got joint custody of his children.

It wasn't until he met with the lawyer that he found out that she had no right to do that. From the beginning it was one threat after another.     I was in the same situation. He beat me just once. I wouldn't give him a chance to do it again. He wouldn't move out, so, I did. A few people offered to let me stay with them until I could get my own place.
    It seemed like a bad idea to me. As an adult, I knew what I had to do. It was very difficult at first, I made it on my own.

      The husband getting child support is a tall order. The family courts are stacked against guys. Most cases where I've known the dad, unless the wife is on drugs and going to jail, the mother gets custody... that's even when she doesn't have a job or a place to live. But it is ruled this way in "the best situation for the child. "

    I’ve been in this type of situation. It’s frustrating cos you feel held hostage. I’m glad Dave didn’t try to push the blame on the guy. He needs to seek an attorney advice immediately. He needs to get a DNA test on that kid asap cos the guy she’s talking to is probably the child’s father. She should move in with the new guy.

      @@joannbarthold3032 And just what is her side then? We know this guy isn’t abusive because she’s boldly told him she doesn’t love him but what’s to stay in the same house as him. That makes zero sense if he’s the dominant party.
      She has a right to not want to be married anymore, but she doesn’t have a right to financially move on while still enjoying the benefits of a spouse.
      Let’s be real here, she didn’t find a new fella to talk to right after she told him she was done. BF was there long before that happened.
