Losing the Carrot of the Chevron Deference

Columbia Law School Professor Kathryn Judge says that the Supreme Court's reversal of the Chevron doctrine removes a key incentive for agencies to engage in rulemaking through the notice-and-comment process, which could have an effect on banking regulations.
