  • @arianefr78
    @arianefr78 2 роки тому +44

    WHAT? The plaintiff is supposedly a lawyer yet didn't ask for a contract. The old pipes were already coming out of the ground and he had to connect them to the new white joints, which he did. Unless he was being paid to completely dig up all the old pipes to lay them slightly further apart, then he did exactly what he was asked to do, and since when does an owner leave all the pipes exposed, as soon as you put a box cover around it all, no-one will see whether or not they are slightly skew-whiff. I don't see why he was made to refund her $400, he had to buy extra parts, he did the job and it all worked perfectly...

      @arianefr78, It is one of the few times I do not agree with a JM verdict.
      The defendant did exactly what he was hired to do, those pipes were crooked long before he arrived, it wasn't his responsibility to straighten them.
      Coming from a trades/construction family as the good judge as shared many times, how did that one go over her head?

      i believe the defendant and there is no way on earth that this woman is a lawyer and just the way she spoke to the judge was proof she had no courtroom experience or knowledge regarding how to address a judge and i cant believe the judge did not cross examine her claims more.

      and not to seem prejudiced but americans must be very careful when doing work for immigrants from east european countries because there are language barriers to overcome when making verbal agreements and it seems that people from east europe are more likely to use the legal system and sue rather than people from other parts of the world .

      I completely agree that in a perfect world, the defendant should have won. Unfortunately for him, he shot himself in the foot by not producing receipts. Neither to the plaintiff or, more importantly, the Judge. That is why he lost. Failing to produce evidence on his behalf caused him to look unprofessional and possibly shady and/or lazy. Even though I disagree with the verdict, I understand why it happened.

    I don't understand the logic for the lawsuit. The pipes were crooked before the defendant arrived. If she wanted the pipes straightened, that should gave been part of the scope of work, and fully costed (and paid for). There was nothing shoddy about the defendant's work. The motor and filter were installed correctly, and it still works. What did he do wrong?

    • @michelehemlokhexwhite4310
      @michelehemlokhexwhite4310 2 роки тому +5

      She was also claiming it "leaked". Of course, it like only came up in fly by. It was all about anesthetics, exactly.
      My dad is a retired plumber & pipes especially 40+ yr old 1s can only move so much w/o risk of breaking or cracking. You're not just looking at the exposed area that can be damaged by manipulation but what's underground by the movement. If that happens it's gonna cost them a great deal more than $700 to repair. She'll probably sue the next guy claiming he did all the damage if that happens even though it's just what happens to things as they age... they break down over time.

And if she lied about that so freely and easily then the defendant must be telling the truth about he told them about the pipes being crooked. She's no lawyer, not once did she use any legal terms and I highly doubt a lawyer would have paid someone in full for a job as disappointing as the plaintiff's are saying, I just do not believe them. Did not agree at all with this verdict. I don’t believe this messed their entire summer up. They still could use the pool. If the defendant is really at fault it would be for not providing receipts for the extra costs. That amount should have been what was returned to the plaintiffs. Didn’t see how JM got her figures for what was owed since the plaintiff’s didn’t provide another estimate and how did she know if the work was done poorly without another expert opinion. I fabricate and install aquariums and ponds from scratch for over 30 years....
    My business is in Los Angeles.
    I have dealt with thousands of outdoor projects relative to the plaintiffs.
    The judge surely got this one wrong 100....
    The installer is correct by not wanting to move old existing pvc or abs pipe and fittings as they can crack easily when weather worn and pressurized over past years...
    I speculate and trust the defendant gave them an option and bid of digging out and re piping almost everything....
    This coat was much higher than just the attachments to the new sand filter and pump....
    700 bucks is nothing......
    He was not lying about the cost of valves and fittings , sand, glue et al.....
    Fill that dirt hole and the piping does not look crooked as they made it look much worse by digging down.
    The large mistake the defendant made was not giving a clear invoice of the cost of parts used....
    Guys like this and in my trade often have spare valves and fittings from years of work laying around and is likely why he has no receipts....
    He did not prepare evidence for this case and lost his labor profit..
    He should have gone back to check and may have won just on that.....
    Lesson to the public out there......
    CHEAP IS NOT GOOD!
    YOU GET WHAT YOU PAY FOR!.
    I would have charged 2 thousand for that job and all would look clean and immaculate with clear glue....
    Yes they would have paid 3 x amount however the plumbing would last decades and East to replace pump if needed with union firings to plug and play....
    Great service people always think ahead....
    CHEAP CHEAP CHEAP.......

    Could of been fixed w/a cute wooden cover. A lot of people cover the pool systems. Ours was in a small bathroom and changing room.

    The look on the woman's face when the judge asked why she didn't get it fixed says everything, it works but doesn't look pretty so why get it fixed when you can build a box around it and get a very stupid tv judge to pay her for it!

    Another poor decision from the judge. Those pipes were crooked to begin with. She always says she is from a long list of contractors. I would love to see there work and see it. I wonder if they are perfect. She has it in on cotactors. I think the lawyer just wanted a free job or close to it.

    I love Judge Milian but she needs to stop using "I have OCD" as a casual term. People are actually suffering with it. Liking things a certain way is much different than a disorder that can ruin your life.

    Milian certainly does seem like she does have OCD. I knew she had something so I'm happy she finally admitted it. But the job the defendant did was horrible which is why the plantiff recieved some money back.
