Keep in mind, the way they negotiate this deal is making Harvey become scapegoat and enslaved for a whole year for this landlord for free, and Harvey didn't even know he become a scapegoat while these two women parading around like they're a good negotiator
You're thinking of episode 3 from season 9.
Unrealistic that if a landlord asks for a written document you would not discuss this with the laywers in your lawfirm first.

This is very unrealistic…Donna would have immediately realized he was gay.
This happening with Fox takes place immediately after the events
from the night before when she resigned, then Harvey shows up at her door and finds out that he has chosen her over his romantic relationship with Paula.
Seems like enough reasons to justify why she is distracted, confused and careless.
I think the writers actually wanted to show that Donna is strong and honest and doesn't give in if she's wrong, but looks for solutions to solve the problem without compromising.
