The documents did not belong to Trump when he was still POTUS, and for sure not now that he is out of office. Work product, regardless of classification, belongs to the employer, which is us - the citizens of the U.S.
He s not being charged for taking the documents or having the documents. He is being charged under the espionage act for conspiring with Nauta, DeOlivera, even his lawyer to hide them and not let the US government have them back. It isn’t like any other President or vice president taking work home with them and voluntarily giving them back when they realized they still had them. Trump knew he had them and tried to keep them. He Tried to “negotiate” to trade them for the Russia investigation evidence, and moved them around, telling NARA twice that they had everything back. People have gone to prison for 5 years for one sheet of paper. Of all the cases, this one is the worst. That’s why he has done everything in his power to delay the trial. Cannon (the judge) should be impeached.😡
