- The plaintiff says the defendant was driving carelessly, crossed over the yellow line, and smashed into his car. He says the defendant admitted it was his fault and begged him not to call the insurance, but now he’s refusing to pay up. He’s suing for the cost of car repairs. The defendant claims it was a snowy day and the plaintiff was fishtailing.
Cannot understand why the defendant had to bring the little girl in. What was the relevance? Sad that she had to witness her Dad caught out for lying on national tv

I googled that street. It's very narrow. the plaintiffs story makes a lot more sense. So do the photos.
"It was icy and snowy and I was coasting with my brakes" means one of two things (likely both): the defendant didn't have control over his vehicle (you can't control your car on ice riding the brakes) and/or he doesn't know what either coasting or brakes means. 😉
Also, if his story was true why would he stop beside the parked car and not pull in behind it so the car wouldn’t hit him

It's super simple. A car entering a roadway must yield to traffic.
If an accident occurs between a car traveling the roadway and a car entering the roadway, the car that's entering is always at fault, even if the traveling car is speeding or swerving (and I don't think the plaintiff was doing either).
The Defendant is a Shyster! Brought his daughter to court to teach her the ropes. He Failed.

I dis that once under the advice of the police. They told me it would be best not to go through insurance when I was hit and my car was total! This was in the late 80,s when this occurred.
I listen to the police and when I reached out the person that hit me, he dis not return any of my calls and he lived in florida. The accident took place in New York.
My brother told me not to listen to police. He said you are a young black man and he’s an elderly white man. They best interested is not for you. He was right! Never again, if that person doesn’t want to go through insurance, they can pay the company back or take the insurance total and pay it out right!
It's always a smaller and colorless world when you look through a lens of only black and white.

Why on earth did the defendant bring his young daughter in to court, did he think he would get more sympathy? JJ would never have allowed that. And what did the defendant mean when he said he was 'coasting with his brakes' does he mean he was skidding on the ice, in which case the accident was most definitely his fault...

I love Mariyln Millian she's my absolute favorite Judge on TV. She is fair and never mean to anyone for no reason unlike another older female Judge that I simply won't watch.

I had a guy hit me in a parking lot and I just gotten into my car didn't even start it..He said that he would pay for it not to go through insurance blah blah blah well he ended up giving me a fake phone number and his license had a previous address on it so after 4 months I found out where he lived sued him and got my money.. Also my uncle & friend both owned body shops and the estimates were in my favor to say the least 🤷
My thing is how does the judge know that the planiff didn't let his insurance lapse? Not saying he's lying,I do know I did once,but how does she know he wasn't being lazy and wasn't paying attention to his expiration date? Not saying he's at fault but something tells me he didn't have active insurance at the time of the wreck. If I were the judge I'd make him call his insurance company or do something to justify he had it.
But your focusing on him and not the evil plaintiff actions says a lot…

@@claypartridge7553 there was this case where a poor family was being evicted from their home and they needed to move into a shelter but the shelter didn't allow pets. So they asked a friend to take care of their chihuahua. I think his name was Pepe. Anyways, the case was dismissed so that the family could take it to a proper court and get custody of the dog. It's the best case of People's Court I ever saw. You ever heard of it? It was covered by many news stations, but I can't find it anymore. It was probably 10-15 years ago.

an answer to Harvey's question I would say if you have evidence of a confession for example having it recorded and then it's end of story, but this case is a he says she says or he says he says and there's no way to prove he did or did not confess which is why there is continued adjudication

I believe the defendant brought the child for Milian to be swayed in ruling in his favor but the plaintiff had overwhelming evidence backed up by proof so he won. Pretty cut and dry case

Two VERY different parenting styles. One parent teaches their kid turns to be honest & be a stand-up person using truth and facts while the other shows their kid to try manipulating the system with favoritism.
