  • The plaintiff rented an apartment from the defendants, who he says hid the fact they were in foreclosure on the building. The bank is going to take the building and kick the tenants out with nowhere to go, so the plaintiff is suing. The defendants admit the bank will take the building, but they say the plaintiff won't be kicked out due to the foreclosure.

      It's always telling when the plantiff just "It was an illegal unit and I stayed there for eight months so I should get my eight months back and emotional distress".

      I’m honestly certain that he just had no idea how his lease worked considering he had all these middle men giving him vague information about a foreclosure. I don’t think he understood that he automatically went to a month-to-month basis afterwards either, you can see it in his face when the judge informs him. Given so, he probably felt like he lost a home, money, and wasn’t going to continue losing being so late in and getting kicked out.
      All things considered in his shoes, who wouldn’t think that suing would be the best thing to do to understand what the hell is going on? 😅😂

      @@mario23sb that's problem isn't it? Suing is the last thing I would think to do when I dont know anything about how a foreclosure affects a rent contract. Suing is time consuming and costs money. It's crazy to me that someone who knows this little about how a rent contract works would have the drive to sue. Usually, a lack of knowledge makes u humble, not more sure of urself. But this might be me being a stuck up educated person thinking things I have learned is common knowledge for all when it's privelege.

      @@dance4life1208 I think u should assume that yes. But to think that means u get all the past months money back? That doesn't make any sense. It smells like he smelled an opportunity to me. His logic makes no sense.

    The defendants are crooked AF. Collecting rent but not paying the mortgage. They must've had a friend at that bank to slide for 2 years.

      It's unethical but I wish they would make it illegal. There was a big trend years back of this and poor folks being kicked out suddenly.

      Debts exceeded their income...living beyond their means or maybe one of them got sick.

      Probably by that time the bank didn't want the money, they wanted the property and wasn't going to accept anything without all the fees attached.

      These cases were recorded years ago, and considering the defendant said he tried to short sale his home he was probably upside down on mortgage payments. With the amount of money he could save up by not paying and also renting to the plaintiff, all the money would go in his pocket and he could purchase a cheaper home

      @hadley407 facts! The predatory lending back then was ridiculous, too. Once people realized they couldn't escape the foreclosure, they just had to go with the flow and scrimp and save by any means necessary. Credit was shot at that point, and some couldn't even buy a new home for years!!

      It’s Kurt. I believe he did the interviews after the case until around 2015 or so. But I could be wrong. Doug is shady, but Kurt was MEAN! Haha

    Not only did the defendant get to put the mortgage payment in his pocket, he got to put the plaintiffs rent payment in his pocket. He should have had a lot of money saved up to purchase a new place when his home was foreclosed upon.

      @@lukerinderknecht2982 Because it's not "illegal" to pay rent in such a circumstance, even if it could (somewhere) be "illegal" to accept it. Yeah, I don't see how either, but my take on the plaintiff's use is that it's certainly not the right word.

      BTW, (sic) is used in the case of spelling or grammatical errors, not factual errors.

      "The Latin adverb sic (pronounced [sɪk]; "thus", "just as"; in full: sic erat scriptum, "thus was it written")[1] inserted after a quoted word or passage indicates that the quoted matter has been transcribed or translated exactly as found in the source text, complete with any erroneous, archaic, or otherwise nonstandard spelling, punctuation, or grammar. It also applies to any surprising assertion, faulty reasoning, or other matter that might be interpreted as an error of transcription."
      Note that last sentence.

    That's the chance you take, signing a month-to-month contract. I always did a standard 12 months. It also helped that I've been at the same job for 33 years.

      I feel this way about adults in general. Reading isn’t a super power and the internet is everywhere. Make use of a smart phone that isn’t scrolling the TikToks and actually understand the circumstances you’re in and what you can do.

      @@juliettek.9440It’s not the reading that is the problem, it’s being able to process the information that they have read about and the ability (or lack of…) to analyze things, situations, circumstances, events…. Analyze life in general!
      And sadly enough, there are many people who can’t do that.
      In THIS case however, the plaintiff was just lazy and only saw the dollar signs before his eyes!!!!!

    The city shut the water down on my street for two days upgrade, so I'm not paying the months rent cause my lease states the landlord pays for water.
    If only that was the case lol.😂

      Sad thing is that there are people that are that delulu. That would like everyone here in South Louisiana where I live that they aren't going to pay their mortgages or rent for the time that we were without power after Hurricane Ida 2 years ago. Just not how things work.

    How in the world did he think he'd get back all the rent he paid?? That's illogical. And if the situation were reversed, would he hand over 5k to a renter if his property foreclosed?? Absolutely not. This is a risk of renting, but it is not illegal.

    I don't like the silly announcement in the beginning and I don't like this theatralic yelling from the judge. The only authentic judge show is and will be forever Judge Judy. Noone else comes close to her.
