Stewart got sued and lost. Jorge Ben (the brazilian dude) settled the dispute amicably, asking Stewart to donate the profits from his song to UNICEF, and he agreed. This is the kind of man he is.
Rod indeed plagiarized Ben's while visiting RIO for Carnival with Elton John. There is an Elton video interview whereby Elton throws Rod under the bus asserting that Rod "stole Do Ya Think I'm Sexy from Jorge Ben". Both JB and RS are amazing artists. The legal disputes settled and WE won because we love their music!
Thank you for posting this comparison here. It's important to show how americans and europeans actually stole another countries' songs and other artistic expressions and worst, it's they that are recognized as the creators
Rod never claimed he owned the famous melody once he was sued he admitted in court under oath that he heard in Brazil and later used in his song Also rod didn't copy an entire song he used a melody which I think sounds better when jorge does it but besides that point
Pablo Eklund He said it was "unconscious plagiarism" but I think he got bad legal advice when he settled out of court. There really is just one melodic phrase in the entire Jorgen Ben Jor song that sounds similar to a melodic phrase in the chorus of Rod Stewart's song! I've heard a lot worse copyright infringement than this. Led Zeppelin blatantly ripped off from a lot of lesser known artists and got away with it. Rod probably figured "that's what I get for writing a disco song" and since he was a multi-millionaire already he didn't care. Besides the royalties were donated to charity which is good!
total rubbish. Rod BOUGHT the single by Jorge Ben when he was touring Brazil with Elton John, recorded Do Ya Think I'm Sexy' soon after.. Elton's confirmed that and agreed it was pinched. The fact Stewart settled out of court which proves that he KNEW he was guilty of copyright infringement. Other than that, use ya fkin EARS man!
Of course a song about "being sexy" is better than a song about the history behind the construction of a historical monument (Taj Mahal)! Guess some people didn't evolved right.

(Being "Americans" were, the United States's, since that's how they call themselves)

GREGORIOUS TAJ MAHAL ITS THE ORIGINAL SONG
were?
There are some similarities in the melodies but the phrases are distinct enough to be considered two different melodies.

"Use ya fkin ears man", priceless.
I agree ☝🏻
Hola, Nacho. Todo bien? Soy brasileño y tengo una sugestión: America - Thin man vs Seu Jorge Burguesinha. Gracias
?
😂😂😂😂
Look at the bright side. Rod made the song better.
Jorge ben jor é muito melhor
no way
